Key Takeaways
- You can sponsor partner from Mozambique on a Subclass 309, Subclass 820 or Subclass 300 visa if you are an Australian citizen, Australian permanent resident or eligible New Zealand citizen aged 18 or over and the relationship is genuine and continuing.
- Mozambican civil documents are issued in Portuguese, so birth, marriage, divorce and police records need English translations that meet the Department's requirements.
- Under Mozambique's Family Law, a religious or traditional marriage has legal effect only once it is transcribed by the civil registry, so the registration status of a customary union decides whether it can be relied on as a marriage.
- Many Mozambican partners have lived, studied or worked in South Africa, which usually means a South African police clearance certificate as well as a Mozambican one, and documents from two legal systems.
- Couples who lived together in South Africa or another third country prove their de facto relationship with that country's leases, bills, bank records and residence documents, explained in a clear timeline.
To sponsor partner from Mozambique, the Australian partner must qualify as a sponsor, and the couple must prove a genuine and continuing relationship with evidence the Department can read and verify. A decision to sponsor partner from Mozambique usually involves Portuguese-language documents, a marriage that may be civil, religious or traditional, and a relationship that has often been lived partly in South Africa or another country.
This guide explains each of those issues from the Australian sponsor's point of view. It covers sponsor eligibility, the right visa for the partner's location, translation of Portuguese documents, how a traditional or religious marriage in Mozambique is treated, partners with South African residence or work history, police certificates from more than one country, and how to prove cohabitation that took place outside both Mozambique and Australia. The firm's partner visa lawyers advise sponsors on these matters.
The practical lesson is simple. A case to sponsor partner from Mozambique is won or lost on documents. Each document must be translated, consistent and connected to the couple's actual history. For a general overview before the country detail, read the complete guide to partner visas in Australia.
Can you sponsor partner from Mozambique on an Australian partner visa?
Yes. An eligible Australian sponsor can sponsor partner from Mozambique on a partner visa if the couple are married, in a de facto relationship, or engaged and intending to marry, and the relationship is genuine and continuing.
Mozambican nationality does not change the legal test when you sponsor partner from Mozambique. The criteria in the Migration Act 1958 and the Migration Regulations 1994 are the same for every applicant. What makes a plan to sponsor partner from Mozambique different is the type of evidence available and the countries it comes from.
When you sponsor partner from Mozambique, the Department makes two decisions inside one visa decision:
- Is the applicant eligible? The Mozambican partner must show the relationship, and must meet the health, character, identity and passport criteria.
- Is the sponsorship approved? The Australian partner must meet the sponsor criteria, and sponsorship approval is assessed at the time of decision.
The guide on partner visa eligibility explains the applicant's side, and the guide on partner visa sponsorship assessment explains how the Department assesses the sponsor.
What must you show to sponsor partner from Mozambique as the sponsor?
The sponsor must be an Australian citizen, an Australian permanent resident or an eligible New Zealand citizen, aged 18 or over, and must not be prevented from sponsoring by the sponsorship limitation or the sponsor character rules.
The partner visa sponsor requirements set out each element. Three points arise often when Australians sponsor partner from Mozambique:
- Proof of status. The sponsor proves citizenship or permanent residence with an Australian passport, citizenship certificate or visa grant. The guide on sponsor proof of citizenship or residence explains what is accepted. A sponsor who is an eligible New Zealand citizen should read the guide on the eligible New Zealand citizen sponsor.
- Previous sponsorships. Regulation 1.20KB generally limits a sponsor to two partner sponsorships in total, and prevents a new sponsorship within 5 years of a previous one, or within 5 years of the sponsor's own partner visa grant, unless compelling circumstances apply. The page on partner visa sponsorship limitations explains the rule and the exception.
- Police checks. Regulation 1.20KC allows the Department to ask the sponsor for Australian and foreign police checks. A sponsor who has lived in Mozambique or South Africa for 12 months or more may be asked for checks from those countries. The guide on the partner visa sponsor police check explains the process.
A sponsor who is working in Mozambique or South Africa at the time of application should read the guide on a partner visa sponsor living overseas. The sponsor will need to show an intention to live in Australia with the partner. The answer on whether an Australian living overseas can sponsor a partner gives a short summary.
Can a sponsor working in Mozambique or South Africa still sponsor?
Yes. An Australian citizen or permanent resident who is living in Mozambique or South Africa can still sponsor partner from Mozambique, provided the sponsor meets the sponsor criteria and the couple intend to live together in Australia.
Many sponsors meet their Mozambican partner while working in the region, for example in mining, energy, construction, development or aid work. The couple may have lived together for years before deciding to move to Australia. In that situation, the Subclass 309 is normally lodged while both partners are outside Australia.
Three issues need attention:
- The sponsor's own status. A permanent resident sponsor who has spent a long time outside Australia should check that their permanent residence and travel facility are still valid. The guide on a partner visa sponsor holding a resident return visa and the guide on a partner visa sponsor with an expired travel facility explain the risk.
- The plan to return. The sponsor should show a real plan to live in Australia, such as a job offer, a lease, or arrangements to return. The guide on a partner visa sponsor returning to Australia explains the evidence.
- The undertaking. The sponsor undertakes to provide accommodation and financial assistance for the partner's first 2 years in Australia. The guide on the partner visa sponsor undertaking explains what this means.
A sponsor living abroad should also expect to be asked for police checks from the country where they have been living. A plan to sponsor partner from Mozambique from abroad is common and workable, but the sponsor's own documents need as much care as the partner's.
Which partner visa should you use to sponsor partner from Mozambique?
The right visa depends on where the Mozambican partner will be when the application is lodged and whether the couple are married.
- The partner lives in Mozambique or South Africa. The usual choice is the Subclass 309 partner visa, lodged from outside Australia, followed by the permanent Subclass 100. The partner can lodge from Mozambique or from a third country such as South Africa.
- The partner is already in Australia. If the partner holds a visa that allows a further application, the Subclass 820 partner visa may be lodged in Australia, followed by the permanent Subclass 801.
- The couple are engaged and will marry in Australia. The Subclass 300 Prospective Marriage visa allows the partner to enter Australia and marry within the visa period.
The answer on whether to choose the Subclass 820 or the Subclass 309 explains the trade-offs. For most couples who sponsor partner from Mozambique, the Subclass 309 is the starting point, because the partner is usually living in Mozambique or South Africa. The guide on the offshore partner visa explains how the offshore pathway works, and the guide on partner visa offshore lodgement covers the lodgement rules.
Portuguese documents and English translation
Every Mozambican document that is not in English must be lodged with an English translation, and Mozambican civil records, marriage records and police certificates are issued in Portuguese.
Portuguese is the official language of Mozambique, so almost every Mozambican document used to sponsor partner from Mozambique will need translation. That includes the birth record, any marriage record, divorce documents, the police certificate, and many relationship documents such as messages, letters and family statements. The guide on partner visa evidence translation explains the Department's general expectations.
A sponsor who wants to sponsor partner from Mozambique should plan translation in three tiers:
- Core civil documents. Birth, marriage, divorce and police records. These must be translated in full, including stamps and annotations. The answer on how to translate a marriage certificate explains why a partial translation causes problems.
- Relationship documents. Portuguese messages and letters can be translated selectively, with representative samples rather than every message. The answer on how to translate messages for a partner visa explains how to choose them.
- Statements. Statements from family members in Mozambique, written in Portuguese, need English translations. The answer on overseas friends' statements explains how statements from people outside Australia are used, and the guide on Form 888 witness statements explains statements from Australian citizens and permanent residents.
Name consistency matters in every application to sponsor partner from Mozambique. Portuguese names often include several given names and family names, and the order can vary between documents. The passport, birth record, marriage record and police certificate should show the same name, or the variations should be explained. The answer on different names and dates on documents and the answer on certified copies explain how to present documents correctly.
Can you sponsor partner from Mozambique after a traditional or religious marriage?
Yes, if the marriage has legal effect in Mozambique. Mozambique's Family Law recognises three forms of marriage, civil, religious and traditional, but a religious or traditional marriage produces legal effects only once it is transcribed by the civil registry services.
Lei n.º 22/2019, the Mozambican Family Law, states in article 17 that marriage is civil, religious or traditional. Article 18 provides that a religious or traditional marriage produces the effects set out in the law only if it is duly transcribed by the civil registry. Article 85 provides that the transcription of a traditional marriage takes effect only after the preliminary publication process has been completed. Article 20 states that registration of a marriage is mandatory.
For an Australian sponsor, this is the most important legal point in a plan to sponsor partner from Mozambique through a customary union. A traditional ceremony, even one attended by both families and accompanied by customary gifts between the families, is not necessarily a legally effective marriage under Mozambican law unless it has been transcribed. If it is not a valid marriage in Mozambique, it cannot be relied on as a valid marriage for an Australian spouse application.
The Australian test is in Part VA of the Marriage Act 1961. A foreign marriage is generally recognised in Australia if it was valid where it took place and would be recognised as valid under Australian law. The guide on whether an overseas marriage is recognised in Australia explains the test, and the guide on a partner visa where the overseas marriage is not recognised explains what happens when the test is not met.
Before lodging a spouse application to sponsor partner from Mozambique, a sponsor should check three things:
- Was the marriage transcribed? Obtain the civil registry record of the transcription, not only photographs or a community document.
- Were both partners free to marry? Any earlier marriage of either partner must have ended. Mozambican law defines marriage as a union between one man and one woman, and Australian law does not recognise a second concurrent marriage. The answer on polygamous marriage and a spouse visa explains the Australian position.
- Do the dates match? The date of the ceremony and the date of transcription may differ. The couple's statements and the application form should explain both.
The answer on a religious or cultural marriage and a partner visa and the answer on an unregistered marriage and a marriage visa explain how the Department approaches ceremonies that were not registered.
The Tribunal has considered marriage validity under local law. In 1706602 (Migration) [2019] AATA 5299, decided on 9 October 2019, a Subclass 309 matter, the reported issues were the validity of the marriage, the status of the applicant's previous marriage, and whether the marriage was solemnised and recognised under local laws. The decision under review was remitted. Couples who sponsor partner from Mozambique on the basis of a traditional marriage should expect the same questions.
Can an untranscribed traditional marriage still support a partner visa?
Yes, in many cases, but usually as a de facto relationship rather than as a marriage. A couple whose traditional marriage has not been transcribed may still qualify as de facto partners if they can show the de facto relationship requirements.
Under the Migration Act 1958, a de facto relationship requires a mutual commitment to a shared life to the exclusion of all others, a genuine and continuing relationship, and that the couple live together or do not live separately and apart on a permanent basis. The applicant generally must also show 12 months of de facto relationship immediately before applying, unless the relationship is registered in an Australian state or territory or there are compelling circumstances. The answer on the legal definition of a de facto relationship and the guide on the de facto partner visa explain the requirements.
A traditional ceremony is still valuable evidence in a de facto case to sponsor partner from Mozambique. It shows family recognition, social acknowledgement and commitment. When couples sponsor partner from Mozambique as de facto partners, the ceremony should be presented as part of the relationship history, with photographs, family statements and an explanation of what the ceremony meant to both families.
There are three practical options where the traditional marriage was not transcribed:
- Transcribe the marriage first. If the marriage can be transcribed by the civil registry in Mozambique, the couple may then lodge as spouses. Obtain current advice in Mozambique on the process.
- Lodge as de facto partners. If the couple meet the 12-month requirement, they can lodge on that basis now. The answer on when the 12-month de facto period starts explains how the period is measured.
- Hold a civil marriage. A civil marriage in Mozambique or in Australia creates a clear legal marriage. A marriage in Australia requires a Notice of Intended Marriage given to the celebrant at least one month before the wedding.
The right option to sponsor partner from Mozambique depends on the couple's history and timing. A sponsor who wants to sponsor partner from Mozambique should decide this before lodgement, because changing the basis of the application later can create inconsistencies.
Partners who live or work in South Africa
Many Mozambican partners have lived, studied or worked in South Africa, and that history affects which documents are needed and where the couple's evidence comes from.
South Africa is Mozambique's neighbour, and movement between the two countries for work and study is common. If the Mozambican partner has lived in South Africa, the application to sponsor partner from Mozambique will usually include South African documents as well as Mozambican ones:
- Residence documents. South African permits or visas showing the partner's lawful residence, with dates.
- Address evidence. South African leases, utility accounts and bank statements.
- Police clearance. A South African police clearance certificate if the partner lived there for 12 months or more in the last 10 years since turning 16.
- Employment or study records. Letters from South African employers or institutions.
Documents from two legal systems must fit together when you sponsor partner from Mozambique. The partner's name and date of birth on South African documents should match the Mozambican passport. Where a South African document uses a different spelling or order of names, the difference should be explained.
A partner who lives in South Africa can lodge a Subclass 309 from South Africa, and many couples who sponsor partner from Mozambique do exactly that. The guide on partner visa offshore lodgement explains the general rules, and the answer on help with an offshore Subclass 309 and Subclass 100 summarises the process. The firm's answer on a partner visa lawyer for South Africa explains the firm's work with couples connected to South Africa.
Police certificates from Mozambique and South Africa
The Mozambican partner needs a police certificate from Mozambique, and from South Africa or any other country where the partner has lived for 12 months or more in the last 10 years since turning 16.
Official government guidance for applicants needing a Mozambican police certificate states that it is called the Certificado do Registo Criminal, that residents apply at the Criminal Records headquarters in Maputo or at the civil records office in most provincial capitals, and that non-residents can designate a local resident to submit the request. The same guidance for South Africa states that the South African Police Service issues a Police Clearance Certificate, that residents apply at a local police station, and that non-residents apply through a South African embassy or by mail to the police office in Pretoria.
Timing matters when you sponsor partner from Mozambique, because each certificate has a limited useful life. Police certificates from two countries may take different times to issue. The guide on partner visa overseas police certificates explains when to obtain them, and the answer on how long a police certificate and health check remain valid explains why timing matters. If a certificate cannot be obtained, the answer on what to do if you cannot get a police certificate sets out the options.
The guide on partner visa character requirements explains how the Department assesses character under PIC 4001. A partner with any conviction in either country should disclose it and obtain advice before lodging. The guide on overseas convictions explains the approach.
A practical document plan to sponsor partner from Mozambique
The most reliable approach is to list every document the application needs, identify which country and which language each comes from, and obtain and translate them in a planned order before lodgement.
A document plan to sponsor partner from Mozambique usually has four parts:
- Mozambican civil documents. The partner's passport, birth record, marriage record or transcription, and any divorce or death record for a previous marriage. Each is translated from Portuguese into English.
- Third-country documents. South African residence, address, employment and police documents, or equivalent documents from another country where the couple lived.
- Sponsor documents. Proof of the sponsor's citizenship or permanent residence, the sponsor's Australian police check if requested, and any foreign police checks from countries where the sponsor has lived.
- Relationship evidence. Evidence under the four headings, the couple's statements, and Form 888 statements from Australian citizens or permanent residents who know the couple.
The partner visa document checklist and the guide on partner visa sponsor documents set out the general lists. A partner visa application review before lodgement helps to identify missing or inconsistent documents. Lodging with a complete set of documents reduces the chance of a request for more information, as the answer on a decision ready partner visa explains.
The applicant lodges the visa application first. The sponsor then lodges the sponsorship online, using the application's Transaction Reference Number. The guide on partner visa sponsorship lodgement explains the timing. When you sponsor partner from Mozambique, both lodgements should use identical details for both partners.

How to prove cohabitation in a third country
Couples who sponsor partner from Mozambique after living together in South Africa or another third country prove that cohabitation with that country's records: leases, utility accounts, bank statements, residence permits and travel records showing both partners at the same address over time.
This situation is common when Australians sponsor partner from Mozambique, and it is not a disadvantage if the evidence is well organised. The sponsor may have worked in South Africa, or the couple may have met while both were living in a third country. The Department does not require the couple to have lived together in Australia or Mozambique. It requires evidence that they lived together, or did not live separately and apart on a permanent basis, wherever that was.
Strong third-country evidence usually includes:
- A lease or property document in both names, or a lease in one name with evidence that the other partner lived there.
- Utility accounts and correspondence addressed to both partners at the shared address.
- Bank statements showing shared expenses, transfers between the partners, or a joint account.
- Residence evidence for each partner in that country, such as permits or visas, showing they were lawfully there during the same period.
- Travel records showing the couple entering and leaving the country together, or one partner joining the other.
The guide on partner visa household evidence and the answer on what counts as living together explain what the Department looks for. The answer on living together overseas for 12 months is directly relevant where the cohabitation was abroad. Where a joint lease was not possible, the guide on a partner visa without a joint lease explains alternatives.
Documents from a third country may also need translation. South African documents are usually in English, but documents from other countries may not be. A clear relationship timeline that shows where the couple lived, and when, makes the evidence easier to follow. Periods apart, for example when one partner returned to Mozambique for family reasons, should be explained. The answer on time apart during the 12-month de facto period explains how short separations are treated.
In Rahmani (Migration) [2022] AATA 3881, decided on 2 November 2022, a Subclass 309 matter, the reported issues were that the couple were validly married in a third country, that the sponsor wife was significantly older, and that very little time had been spent together. The decision under review was remitted. The case shows that a relationship connected to a third country can be assessed on review when the evidence is properly presented.
Relationship evidence when you sponsor partner from Mozambique
The Department assesses four aspects of the relationship: the financial aspects, the nature of the household, the social aspects, and the nature of the couple's commitment to each other.
The guide on the four pillars of a partner visa explains each aspect. In a case to sponsor partner from Mozambique, the evidence often comes from several countries and in more than one language, so organisation is important.
- Financial. Shared expenses, money sent between the partners, and joint planning. The guide on partner visa financial evidence explains what helps.
- Household. Where the couple lived and how they shared domestic responsibilities. For couples living apart, plans for the shared household in Australia.
- Social. Recognition of the relationship by both families and by friends. A traditional ceremony, a lobolo or similar family process, or a church wedding is strong social evidence even where it is not a legal marriage. The guide on partner visa social evidence explains how to present it.
- Commitment. Contact during periods apart, visits, future plans, and decisions made together. The guide on partner visa commitment evidence and the answer on messages, emails and call records explain what to include.
In Nguyen (Migration) [2022] AATA 185, decided on 27 January 2022, a Subclass 309 matter, the reported issues were cultural engagement, a marriage registered in the home country, and daily communication during COVID-19 travel restrictions. The decision under review was remitted. When couples sponsor partner from Mozambique, cultural ceremonies and the civil registration that follows them should both be documented, together with evidence of contact during any period apart.
The guide on partner visa evidence organisation explains how to structure evidence from several countries, and the answer on how much relationship evidence is needed gives a practical guide.
Health, identity and biometrics for a Mozambican partner
A sponsor who intends to sponsor partner from Mozambique should know that the Mozambican partner must satisfy the health criteria, the character criteria, the integrity criterion in PIC 4020 and the passport requirement in PIC 4021.
Australia's official travel advice lists an Australian Consulate in Maputo that provides limited consular and passport services, and refers people to the Australian High Commission in Pretoria for full services. Visa applications are lodged online with the Department, not at a consulate. If biometrics are requested, the Department tells the applicant where to provide them. The guide on partner visa biometrics explains the process, and the guide on the partner visa medical examination explains health examinations with a Department panel physician.
Identity consistency is central to any plan to sponsor partner from Mozambique. The Mozambican passport, birth record, any marriage transcription, South African documents and police certificates should all match. Under PIC 4020, a document the Department considers bogus, or false or misleading information, can lead to refusal. The guide on PIC 4020 for partner visas explains the consequences, and the answer on the difference between an honest mistake and PIC 4020 explains how errors are treated. A passport renewed during processing should be reported, as the guide on a change of passport explains.
Cost and processing time to sponsor partner from Mozambique
The partner visa application charge is from AUD 11,710 as at October 2026, covering the temporary and permanent stages of the onshore and offshore partner visas.
As at October 2026, Department processing times for 50% and 90% of applications are: Subclass 309, 21 and 32 months; Subclass 100, 9 and 21 months; Subclass 820, 22 and 30 months; Subclass 801, 8 and 19 months; Subclass 300, 14 and 26 months. These figures change. The guide on partner visa processing times explains them, and the guide on partner visa cost explains the charges. Translation, police certificates from two countries, transcription of a traditional marriage and travel are extra costs when you sponsor partner from Mozambique.
What if the Mozambican partner visa is refused?
A refusal of a Subclass 309, Subclass 820 or Subclass 300 can usually be reviewed by the Administrative Review Tribunal, but the application must be made within 28 days after notification of the refusal, or 7 days in immigration detention, and that time cannot be extended.
If you sponsor partner from Mozambique and a Subclass 309 or Subclass 820 is refused, the visa applicant applies for review. For a Subclass 300, the sponsor applies. The ART fee is AUD 3,727, with a 50% reduction for financial hardship, payable before the deadline. The page on partner visa refusals explains the options, and the answer on the review deadline for a partner visa refusal explains the timing. Before refusal, the Department usually issues a section 57 letter inviting comment, and a strong response at that stage can prevent refusal. The guide on partner visa refusal reasons lists the common grounds.
Common mistakes when Australians sponsor partner from Mozambique
The most frequent mistakes involve the legal status of a traditional marriage, incomplete Portuguese translations, and missing police certificates from a second country.
- Relying on an untranscribed traditional marriage as a legal marriage. If the ceremony was not transcribed by the civil registry, it may not be a valid marriage.
- Partial translations. Translating only the main text of a Portuguese document and leaving out stamps and annotations.
- Forgetting South Africa. Leaving out a South African police clearance certificate where the partner lived there for 12 months or more.
- Unexplained gaps. Not explaining periods when the couple lived in different countries.
- Name variations. Portuguese names recorded in different orders across documents, without explanation.
- Ignoring the sponsor rules. Overlooking a previous sponsorship or the sponsor's own partner visa grant within 5 years.
The guide on partner visa application mistakes explains these errors in general terms. Avoiding them is the most effective way to sponsor partner from Mozambique without delay.

Frequently Asked Questions
Can I sponsor my partner from Mozambique for an Australian partner visa?
Yes. You can sponsor partner from Mozambique if you are an Australian citizen, Australian permanent resident or eligible New Zealand citizen aged 18 or over, and you and your partner are married, in a de facto relationship, or engaged and intending to marry. The relationship must be genuine and continuing. You must also meet the sponsorship limitation rules in regulation 1.20KB and may be asked for police checks under regulation 1.20KC. Your partner must meet the health, character, identity and passport requirements.
Is a traditional marriage in Mozambique recognised for an Australian spouse visa?
Only if it has legal effect in Mozambique. Under Mozambique's Family Law, Lei n.º 22/2019, a traditional or religious marriage produces legal effects only once it is transcribed by the civil registry services. If the traditional marriage was transcribed, it may be recognised in Australia under Part VA of the Marriage Act 1961, subject to Australian law. If it was not transcribed, the couple may need to transcribe it, marry civilly, or apply as de facto partners instead.
Can we apply as de facto partners if our traditional marriage was not registered?
Yes, if you meet the de facto requirements. You must show a mutual commitment to a shared life to the exclusion of all others, a genuine and continuing relationship, and that you live together or do not live separately and apart permanently. Generally, you must also show 12 months of de facto relationship immediately before applying, unless the relationship is registered in an Australian state or territory or compelling circumstances apply. The traditional ceremony remains useful evidence of family recognition and commitment.
Do Mozambican documents need to be translated into English?
Yes. Every document not in English must be lodged with an English translation. Mozambican civil records, marriage records and police certificates are issued in Portuguese, the official language. Core documents such as birth, marriage, divorce and police records should be translated in full, including stamps and annotations. Portuguese messages and family statements can be translated selectively. Names should appear consistently across translations, because Portuguese names often include several given names and family names in varying order.
What police certificates does a Mozambican partner need?
The partner needs a police certificate from Mozambique and from every other country where they have lived for 12 months or more in the last 10 years since turning 16. Official guidance describes the Mozambican certificate as the Certificado do Registo Criminal, issued through the Criminal Records headquarters in Maputo or a civil records office in most provincial capitals. Non-residents can designate a local resident to apply. A partner who lived in South Africa usually also needs a South African Police Clearance Certificate.
My partner lives in South Africa. Can they apply from there?
Yes. A Mozambican partner living in South Africa can lodge a Subclass 309 offshore partner visa from South Africa. The application should include South African residence documents, address evidence and a South African Police Clearance Certificate if the partner lived there for 12 months or more. Names and dates on South African documents should match the Mozambican passport. If biometrics are requested, the Department tells the applicant where to provide them, and health examinations are done with a Department panel physician.
We lived together in South Africa. How do we prove it?
You prove it with South African records showing both partners at the same address over time. Useful evidence includes a lease in both names, utility accounts, bank statements showing shared expenses, residence permits for both partners covering the same period, and travel records. A relationship timeline showing where you lived and when makes the evidence easier to follow. Any periods apart, for example when one partner returned to Mozambique, should be explained so that the de facto period is clear.
Can I sponsor my Mozambican partner while I am working overseas?
Yes. An Australian citizen or permanent resident living in Mozambique, South Africa or elsewhere can still sponsor partner from Mozambique, provided the sponsor meets the sponsor criteria and the couple intend to live in Australia. The sponsor should show a real plan to return, such as employment, accommodation or travel arrangements. A permanent resident sponsor who has been away for a long time should check that their permanent residence and travel facility remain valid before lodging.
Does the Australian sponsor need police checks from Mozambique or South Africa?
Possibly. Under regulation 1.20KC, the Department may ask the sponsor for an Australian police check and checks from each foreign country where the sponsor has lived for 12 months or more in the relevant period. A sponsor who has worked in Mozambique or South Africa may therefore be asked for police certificates from those countries. If requested checks are not provided within a reasonable time, the Department may refuse to approve the sponsorship, and the visa must then be refused.
Which visa is best to sponsor partner from Mozambique?
For most couples, the Subclass 309 offshore partner visa is the starting point, because the Mozambican partner usually lives in Mozambique or South Africa. The permanent Subclass 100 follows. If the partner is already in Australia on a visa that allows a further application, the onshore Subclass 820 may be possible. If the couple are engaged and plan to marry in Australia, the Subclass 300 Prospective Marriage visa may suit them. The right choice depends on the partner's location and marital status.
Is a lobolo or family ceremony enough to prove our relationship?
No, not by itself, but it is valuable evidence. A traditional ceremony or family process shows that both families recognise the relationship, which is relevant to the social aspects and commitment. The Department still assesses all four aspects of the relationship: financial, household, social and commitment. A ceremony that was not transcribed may also not be a legal marriage. The ceremony should be presented with photographs, family statements and an explanation, alongside other evidence of a shared life.
How long does it take to sponsor partner from Mozambique?
As at October 2026, Department processing times for the Subclass 309 are 21 months for 50% of applications and 32 months for 90% of applications, and for the Subclass 100 they are 9 months and 21 months. These figures change regularly. Time to transcribe a traditional marriage, obtain police certificates from two countries and translate Portuguese documents is additional. A complete application at lodgement is less likely to be delayed by requests for more information.
How much does a partner visa cost for a Mozambican partner?
The partner visa application charge is from AUD 11,710 as at October 2026, covering both the temporary and permanent stages of the Subclass 309 and Subclass 100, or the Subclass 820 and Subclass 801. Additional costs usually include English translations of Portuguese documents, police certificates from Mozambique and any other country of residence, health examinations, any marriage transcription or civil marriage, and travel. The couple should budget for these before lodgement so the application is complete.
Can my Mozambican partner and I marry in Australia instead?
Yes, through the Subclass 300 Prospective Marriage visa. The partner applies from outside Australia, enters Australia, and the couple marry within the visa period. The couple must have met in person and genuinely intend to marry and live together. A marriage in Australia requires a Notice of Intended Marriage given to the celebrant at least one month before the wedding. After the marriage, the partner applies for the Subclass 820 in Australia.
What happens if the partner visa for my Mozambican partner is refused?
The refusal can usually be reviewed by the Administrative Review Tribunal. The application must be made within 28 days after the refusal is notified, or 7 days in immigration detention, and this cannot be extended. For a Subclass 309 or Subclass 820, the visa applicant applies. For a Subclass 300, the sponsor applies. The ART fee is AUD 3,727, with a 50% reduction for financial hardship, and it must be paid before the deadline.
Can a Mozambican partner include children in the partner visa?
Yes, a dependent child of the applicant can usually be included in the partner visa application. Each child must meet the health and character requirements, and the application must show the child is dependent. If the child's other parent is not migrating, evidence of that parent's consent, or a court order, is usually needed. Mozambican birth records for the child must be translated from Portuguese, and the parents' names on the birth record should match their identity documents.
