Hearing this week

Is your ART hearing this week? We can still help.

Yes. If your hearing is days away, My Migration Lawyers can still prepare you for it if you contact us straight away. The sooner we have your file, the more we can put before the Tribunal.

Here is what to do right now:

  1. Send us your hearing date now. Use the form or call 1300 040 300.
  2. Send the hearing invitation and the Department's refusal decision.
  3. Confirm you will attend by the date in the hearing invitation, if you have not already.
  4. We review and prepare. We go through the reasons for refusal and work out what the Tribunal needs to hear.
  5. We get you ready. We prepare you and your witnesses, and can come to the hearing with you.

Do not wait until the day before. Every day before the hearing is time we can use to gather evidence and write to the Tribunal.

You are not alone

Hearing in days and still not prepared? You are not the only one.

Many people contact us with only days left before their ART hearing. Usually it is because:
Woman looking out of a window, ART hearing only days away
they thought they could just explain their case on the day
the Tribunal's letters sat unopened, or the date crept up on them
their previous agent or lawyer stopped acting or went quiet
they were waiting on documents or witnesses
they did not realise the hearing is usually their main chance to be heard
they were nervous and kept putting it off
Whatever the reason, there is still time to prepare while your hearing has not happened. Send us your hearing date today.

Get Ready for Your ART Hearing

Tell us your hearing date and the visa that was refused. A lawyer will look at your case and tell you what we can prepare before the hearing.
Tell us your ART hearing date, which visa was refused, and whether anyone else is representing you now. If your hearing is this week, say so first.

They took the time to understand our relationship, and their guidance made preparing our partner visa documents much easier. Very thankful for their support.

The hearing

What happens at an ART hearing?

An ART hearing is where a Tribunal Member hears from you directly before deciding whether to overturn your refusal. It is usually your main chance to be heard. The ART replaced the Administrative Appeals Tribunal (AAT) on 14 October 2024, so an AAT hearing is now an ART hearing. At the hearing:
the Member asks you questions about your case and the reasons you were refused
you can give evidence and explain anything the Department doubted
your witnesses can give evidence, if the Member agrees to hear from them
an interpreter can be arranged if you need one
your lawyer can attend with you and make submissions
Couple meeting a lawyer at a desk, what happens at an ART hearing
After the hearing, the Member either affirms the refusal or sets it aside and sends your case back to the Department. The decision may be given at the end of the hearing or in writing later. See If the Tribunal Sends My Case Back, Will My Visa Be Granted?

Common problems

What can go wrong before an ART hearing?

Most hearing problems come from one of four issues, and each one can be fixed if it is dealt with early.

01

You have not confirmed you will attend

If you do not reply to the hearing invitation by the date given, the Tribunal can go ahead and decide without you. Reply as soon as it arrives.

02

Your new evidence has not been sent

Evidence that answers the reasons for refusal should reach the Tribunal before the hearing, so the Member has read it before you walk in. See How Do I Organise My Evidence to Address Every Refusal Reason?

03

Your witnesses are not ready

Witnesses need to know when the hearing is, what they will be asked and how they will join, whether in person or by phone or video.

04

Your previous lawyer or agent has stopped acting

We can take over part-way through, review your file and prepare you for the hearing.

Common questions

ART hearing questions

My ART hearing is this week. Can you still help?

Yes, if you contact us straight away. Send us your hearing invitation and refusal decision now, and we will prepare you, send what we can to the Tribunal before the hearing and can come to the hearing with you.

Is the ART the same as the AAT?

The Administrative Review Tribunal (ART) replaced the Administrative Appeals Tribunal (AAT) on 14 October 2024. If you were waiting for an AAT hearing, your case is now heard by the ART.

Can my lawyer come to the ART hearing with me?

Yes. Your lawyer can attend the hearing with you and make submissions to the Member. We can come to the hearing with you. See Can a Lawyer Represent Us at a Partner Visa Tribunal Hearing?

Can I bring witnesses to my ART hearing?

Yes, if the Member agrees to hear from them. Tell the Tribunal who your witnesses are before the hearing, and make sure they know when and how to join. See Partner Visa ART Hearing: How to Prepare.

Can I have an interpreter at my ART hearing?

Yes. Ask the Tribunal for an interpreter before the hearing if you are more comfortable giving evidence in your own language. See Protection Visa ART Hearing: How a Lawyer Can Help You Prepare.

Can I send new evidence before the hearing?

Yes. The ART can consider evidence the Department never saw. Send it as early as possible, so the Member has read it before the hearing. See Can I Give the Tribunal New Evidence Not in My Original Application?

What if I cannot attend on the hearing date?

Contact the Tribunal straight away to explain why and ask for a new date. A new date is not guaranteed, and if you do not attend, the Tribunal can decide your case without you.
