Key Takeaways
- A partner visa application review is a lawyer's check of an application the couple have prepared themselves, carried out before it is lodged, to find the errors and gaps that commonly lead to refusal.
- A thorough partner visa application review covers validity, the choice of visa, the sponsor, the relationship evidence, consistency with earlier applications, character and identity documents, and the relationship statement.
- Inconsistent dates, addresses and relationship histories are among the most serious risks, because incorrect information can engage public interest criterion 4020 as well as the relationship criteria.
- A partner visa application review is most valuable before lodgement, while every document can still be corrected without having to explain the change to the Department.
- A review is not a guarantee of grant. It identifies risk and tells the couple what to fix, what to explain and what to leave out.
- My Migration Lawyers carries out partner visa application review work under the supervision of Principal Lawyer Weiwei Zhang, and can take over the full application where the review shows the matter needs it.
A partner visa application review is a lawyer's examination of a partner visa application that a couple have prepared themselves, carried out before the application is lodged. A partner visa application review checks whether the application can validly be made, whether the evidence meets the legal test for a genuine relationship, and whether anything in the forms or documents could cause a refusal or an integrity finding. It is designed for couples who want to lodge themselves but want a qualified check first.
This guide explains what a partner visa application review covers at My Migration Lawyers, what the firm looks for, the errors a review most often finds, and when a review is the right choice compared with full representation. What is a partner visa application review?
A partner visa application review is a structured legal check of a completed or nearly completed partner visa application before it is lodged with the Department of Home Affairs. The couple provide the draft forms, the relationship statement, the Form 888 statements and the supporting documents. The lawyer examines them against the visa criteria and against the couple's visa and relationship history, and then advises in writing on what must be changed.
A partner visa application review is different from full representation. In a review, the couple remain responsible for preparing and lodging the application. The lawyer advises on what is there and what is missing. In full representation, the lawyer prepares the application, manages the evidence and deals with the Department. Many couples start with a partner visa application review and move to full representation if the review identifies risks that need ongoing handling.
Why a partner visa application review matters before lodgement
A partner visa application review matters before lodgement because most errors can be fixed quietly at that stage. Once an application is lodged, the Department has the forms and documents as they were submitted. A later correction is possible, but it has to be explained, and some errors cannot be undone at all.
Three kinds of error are especially costly after lodgement. The first is an invalid application, where the visa could never have been granted because a validity requirement was not met. The second is incorrect information, which can engage public interest criterion 4020, the integrity requirement, as well as damage credibility. The third is a weak or inconsistent account of the relationship, which shapes how the case officer reads every later document. A partner visa application review is aimed at all three.
The partner visa process is also long. The temporary and permanent stages can span years, and the relationship evidence lodged at the start is the foundation for everything that follows. A careful partner visa application review at the beginning protects the whole application, not just the first decision.
What the Department sees that couples often do not
The Department sees far more than the documents a couple upload. It holds the applicant's and sponsor's earlier visa applications, travel movements, earlier sponsorships, any earlier partner visa applications, and any information received from third parties. A case officer assessing a partner visa can compare the new application against all of that. Couples preparing their own application usually see only what is in front of them.
A partner visa application review closes that gap as far as possible. The lawyer asks about every earlier application and every earlier relationship, and reads the new application the way a case officer would read it, looking for the questions it raises rather than the answers it gives. Where the couple cannot remember what was said in an earlier application, the review identifies that as a risk and advises how to manage it.
This is the main difference between a couple checking their own work and a partner visa application review. The couple check that what they have written is true. The review checks how what they have written will look next to everything else the Department already knows.
What a partner visa application review checks first: validity
A partner visa application review starts with validity, because an invalid application cannot succeed however strong the relationship is. Validity depends on the visa chosen, where the applicant is, the applicant's current visa and conditions, and the sponsor's eligibility.
The right partner visa
The review confirms which visa fits. An applicant in Australia usually applies for the Subclass 820 visa and the permanent Subclass 801 visa together. An applicant outside Australia usually applies for the Subclass 309 visa and the permanent Subclass 100 visa. A couple who are engaged and intend to marry may use the Subclass 300 prospective marriage visa. The partner of an eligible New Zealand citizen may have a different pathway through the Subclass 461 visa. Choosing the wrong visa is a basic but real error.
Visa conditions and onshore bars
For an onshore application, the review checks the applicant's current visa for conditions that restrict further applications, such as condition 8503. Our article on whether you can apply for a Subclass 820 visa with a no further stay condition explains the problem. The review also checks whether a previous refusal or cancellation in Australia affects which visas can be applied for. Our guide on applying for a partner visa after a visa refusal covers this.
Schedule 3 where there is no substantive visa
If the applicant does not hold a substantive visa when applying onshore, additional criteria in Schedule 3 to the Migration Regulations 1994 apply. A partner visa application review checks when the last substantive visa ended and whether compelling reasons need to be argued. Our guides to the Schedule 3 criteria and the Schedule 3 partner visa waiver explain the test, and our Schedule 3 waivers page sets out how the firm acts in these matters.
The sponsor
The review confirms the sponsor is eligible and checks whether any limitation applies, such as an earlier sponsorship of another partner or the sponsor's own grant of a partner visa. The partner visa sponsorship limitations page explains those rules, and our article on when a sponsor cannot sponsor a partner visa sets out the common situations.
What a partner visa application review checks next: the relationship
After validity, a partner visa application review examines the relationship evidence against the legal test. For a married couple, section 5F of the Migration Act 1958 requires a valid marriage, a mutual commitment to a shared life as a married couple to the exclusion of all others, a genuine and continuing relationship, and a couple who live together or do not live separately and apart on a permanent basis. Section 5CB sets out the equivalent requirements for unmarried couples.
The Department must consider four aspects of the relationship under regulation 1.15A or regulation 1.09A of the Migration Regulations 1994: the financial aspects, the nature of the household, the social aspects and the nature of the commitment. A partner visa application review looks at each aspect and asks two questions. Is there evidence? And does the evidence tell the same story as the relationship statement?
Financial aspects
The review checks for joint accounts, shared bills, money transfers, joint assets or liabilities, and nominations such as superannuation or insurance. Where the couple keep separate finances, it checks that the statement explains how costs are shared.
Nature of the household
The review checks evidence of living together, such as a joint lease or mortgage and mail at the same address, and how household tasks and any children are shared. Where the couple have lived apart, it checks the explanation.
Social aspects
The review checks photographs over time, joint travel, invitations, and the Form 888 statements. It looks for evidence that the couple are known as a couple to family and friends.
Nature of the commitment
The review checks the length of the relationship, periods living together, companionship and support, and evidence of future plans. Our guide to partner visa relationship evidence explains each aspect, and the partner visa document checklist and the 820 partner visa evidence checklist list the documents usually provided.
Partner visa application review for applicants on visitor or student visas
A partner visa application review is especially important where the applicant is in Australia on a visitor visa, a student visa or another temporary visa and intends to apply for a Subclass 820 visa. These applications raise particular questions that are easy to overlook.
The first is the visa conditions. Many visitor visas carry condition 8503, and some carry other conditions that affect what can be done in Australia. The second is what the applicant said when applying for the temporary visa. A visitor visa application usually asks about the purpose of the visit and ties to the home country, and a student visa application may ask about intentions after study. If those answers conflict with the relationship history in the partner visa application, the conflict must be explained. The third is timing. The application must be lodged before the current visa expires if Schedule 3 is to be avoided.
Our guide to moving from a tourist visa to a partner visa in Australia explains the issues in detail. A partner visa application review checks each of them against the applicant's actual visa record.
Partner visa application review where the couple have lived apart
Where the couple have lived apart for part of the relationship, a partner visa application review checks that the application deals with it directly. The law requires the couple to live together or not live separately and apart on a permanent basis. A period apart is not fatal, but the reasons for it, the contact maintained during it, and the plans to live together must be explained and supported by evidence.
Self-prepared applications often treat periods apart as something to minimise. A partner visa application review takes the opposite approach. It checks that the statement explains why the couple were apart, such as work, study, family obligations or visa restrictions, and that the evidence shows regular communication, visits and financial support during that time. An unexplained gap in the evidence is far more damaging than an explained one.
The consistency check in a partner visa application review
The consistency check is often the most valuable part of a partner visa application review. The Department compares the partner visa application with every record it holds: earlier visa applications, incoming passenger cards, earlier sponsorships, interview records and any earlier relationship declarations. An inconsistency that the couple never noticed can become the central issue in the case.
A partner visa application review compares the draft forms, the statement and the documents with the couple's visa history and with each other. It looks at:
- the date the couple met and the date the relationship started;
- addresses and the dates the couple lived at each one;
- marital status declared in earlier visa applications;
- previous relationships, marriages, divorces and children;
- employment and travel history;
- the names and details of family members; and
- the answers given about character, health and previous visa refusals.
Where earlier applications contain statements that do not match the relationship history, the review identifies them and advises how to explain them. Concealing an inconsistency is never the answer. Public interest criterion 4020 can be engaged by information that is false or misleading in a material particular, given in relation to the current application or to a visa held in the 12 months before it was made, and the consequences can extend beyond the current application.
The relationship statement in a partner visa application review
The relationship statement is the document a partner visa application review spends most time on. It is the couple's own account of how the relationship began, developed and works today, and it frames how the decision maker reads everything else. Our guide to the partner visa relationship statement explains its structure.
A partner visa application review of the statement checks whether it:
- tells the story of the relationship in order, with accurate dates;
- covers each of the four aspects of the relationship with specific detail;
- explains anything unusual, such as a quick marriage, a period apart, an age difference, or a relationship that began online;
- matches the documents and the earlier visa history;
- avoids generic phrases that could appear in anyone's statement; and
- is written in the couple's own words.
The statement remains the couple's evidence. A review does not replace it with a lawyer's version. It identifies what is missing, what is inaccurate, what is unclear and what should be explained, so the couple can correct their own account before it is lodged.
Common problems in self-prepared statements
Self-prepared statements tend to share the same problems. They are often too short, or so long that the key facts are buried. They describe feelings but not events. They leave out difficult periods, such as a separation or a family objection, which then appear elsewhere in the evidence. They use dates that differ from the forms. A partner visa application review catches these problems while they are still easy to fix.
Form 888 statements in a partner visa application review
Form 888 statements support the social aspects of the relationship. A partner visa application review checks whether each witness is eligible, whether each statement describes things the witness has personally seen, and whether the statements are genuinely different from each other. Statements that use identical wording carry little weight. Statements that describe specific events, over a period of time, from people who know the couple well, carry real weight. Our articles on Form 888 for partner visas and Form 888 example answers and common mistakes explain what each statement should contain.
The review also checks consistency between the Form 888 statements and the relationship statement. A witness who says they met the couple at a wedding in a particular year, when the relationship statement places the couple elsewhere at that time, creates exactly the kind of inconsistency a decision maker notices.
Identity, character and family documents in a partner visa application review
A partner visa application review checks the identity, character and family documents that must accompany the application. These are not about the relationship, but missing or defective documents delay processing and can lead to refusal.
The review checks passports and birth certificates for both partners, evidence of the marriage where the couple are married, and evidence that any earlier marriage has ended, such as a divorce certificate or death certificate. It checks that documents not in English have English translations. It checks the police certificates required, and whether a Form 80 personal particulars form is likely to be requested. It also checks that every dependent child included in the application has the required documents, and that any parent not included has given any consent the law requires.
Name changes and different spellings
Names spelt differently across documents are common, particularly where documents come from different countries or languages. A partner visa application review identifies each variation and makes sure the forms record every name used. Unexplained differences can look like identity concerns.
What a partner visa application review checks in the online forms
The online forms in ImmiAccount contain many questions that applicants answer quickly without understanding their legal significance. A partner visa application review goes through the draft answers with the couple before submission, because answers cannot simply be edited after lodgement.
The questions that most often cause problems are those about the relationship start date, the date the couple began living together, previous visa refusals or cancellations, character, health, previous relationships, and family members. A partner visa application review also checks the sponsorship form, which the sponsor completes, so that the sponsor's answers match the applicant's.
If a representative is appointed for the application, the Department is notified using Form 956. In a review only service, the couple usually lodge without a representative on the record, which is one of the practical differences between a review and full representation.
Previous relationships and divorce in a partner visa application review
A partner visa application review looks closely at previous relationships, because they affect both validity and credibility. Where either partner was married before, the marriage must have ended before the current marriage, or the couple must be able to show their relationship in the way the law requires. Evidence that the earlier marriage ended, such as a divorce order or death certificate, must be provided. Where an overseas divorce is relied on, the review checks whether it is likely to be recognised in Australia.
Previous relationships also matter for timing. If the current relationship started before an earlier relationship ended, the statement must say so and explain it. Decision makers compare the dates of the earlier relationship with the dates of the current one, and an overlap that is not explained can undermine the whole account. A partner visa application review lines up both timelines and identifies any overlap before the Department does.
Dependent children and family members in a partner visa application review
Where children are included in the application, a partner visa application review checks that each child meets the definition of a dependent child, that each child's identity and relationship documents are provided, and that the forms correctly list every member of the family unit. Children who are not included still need to be declared. Health and character requirements can also apply to members of the family unit who are not applicants.
Where a child is included and the other parent is not migrating, the review checks whether consent or a court order is needed. These requirements are easy to miss in a self-prepared application, and they can delay a decision for a long time.
Translations, certified copies and document quality
A partner visa application review also checks the quality of the documents themselves. Documents not in English need English translations. Scans should be clear, complete and legible, with every page included. Documents should be labelled so the decision maker can see what each one is without opening it. Multi-page records such as bank statements should be selected and highlighted, not uploaded in full without explanation.
These points seem minor, but they shape how the case officer experiences the application. An application that is easy to read is easier to approve. An application that is confusing invites requests for more information and delay.
Errors a partner visa application review most often finds
The same errors appear in many self-prepared applications. A partner visa application review is designed to find them before the Department does.
Inconsistent relationship dates
The relationship start date in the form, the date in the statement and the dates in the Form 888 statements do not match. Or the date conflicts with an earlier visa application in which the applicant described themselves as single.
Missing explanations
The evidence shows a period apart, a recent move, or a gap in the joint finances, but the statement says nothing about it. The decision maker is left to draw conclusions.
Evidence that does not prove what the couple think it proves
A large number of photographs from one holiday, or a joint account opened shortly before lodgement with no transactions, does little to establish a continuing shared life. A partner visa application review identifies evidence that will carry little weight and suggests what to provide instead.
Undisclosed history
An earlier refusal, an earlier sponsorship, a previous marriage or a criminal matter is left out of the forms. Disclosure is required, and failing to disclose can be more damaging than the history itself.
Validity problems
The applicant has a condition on their visa, has no substantive visa, or is affected by an earlier refusal, and the application has not been prepared with that in mind. These issues must be resolved before lodgement.
Poorly organised uploads
Documents are uploaded without labels or in the wrong categories, making the evidence hard to assess. A partner visa application review proposes a logical structure and index.
Our article on why partner visas get refused and our list of the most common Subclass 820 refusal reasons describe how these errors play out in decided cases.
Who should get a partner visa application review?
Any couple preparing their own application can benefit from a partner visa application review, but some situations make a review particularly important. A review is strongly advisable where:
- the applicant is in Australia on a visitor, student or other temporary visa, or does not hold a substantive visa;
- the applicant has had a visa refused or cancelled in Australia or elsewhere;
- the sponsor has sponsored a partner before, or was granted their own visa as a partner;
- either partner has been married before, or has children from an earlier relationship;
- the relationship is short, began online, or involves a significant age difference;
- the couple have lived apart for long periods;
- either partner has a criminal record or a health condition; or
- the couple have limited evidence of living together or of joint finances.
Where several of these features are present, a partner visa application review may recommend full representation instead, because the risks need active management throughout the process. Our article comparing a partner visa lawyer with doing it yourself explains when each approach suits.
The sponsor's part in a partner visa application review
The sponsor's information is as important as the applicant's, and a partner visa application review treats it that way. The sponsor completes a sponsorship form, provides identity and citizenship or residence documents, and in many cases provides police certificates. The sponsor's own relationship history, earlier sponsorships, and the way the sponsor obtained their own visa can all be relevant.
The review checks that the sponsor's answers match the applicant's answers on every shared fact: when the couple met, when they began living together, their addresses, and their previous relationships. It also checks that the sponsor's statement in support of the relationship tells the same story as the applicant's. Where the sponsor has a criminal record, the review considers whether any additional sponsorship assessment may apply and how that should be handled. A partner visa application review that only looks at the applicant misses half the application.
Partner visa application review compared with full representation
The difference between a partner visa application review and full representation is who carries the application. In a review, the couple prepare and lodge, and the lawyer advises on what to change. In full representation, the lawyer prepares the application, organises the evidence, lodges it, deals with requests from the Department and responds to any concerns.
A partner visa application review suits couples who are organised, have a straightforward history and want an expert check. Full representation suits couples with validity questions, integrity risks, previous refusals, complex family situations or limited time. Neither is right for everyone. Our articles on choosing between a partner visa migration agent or lawyer, on when you need an immigration lawyer for a partner visa, and on how to choose partner visa lawyers in Australia cover the decision in more detail.

Incorrect information and public interest criterion 4020
Public interest criterion 4020 is the integrity requirement that applies to partner visas, and avoiding it is one of the main reasons for a partner visa application review. It requires the decision maker to be satisfied that the applicant has not given a bogus document, or information that is false or misleading in a material particular, in relation to the current application or a visa held in the 12 months before the application was made. It also requires the applicant to satisfy the decision maker as to their identity.
The consequences of failing public interest criterion 4020 are serious. Apart from refusal of the current application, a refusal on that basis can prevent the grant of a further visa for a period of three years, and a refusal based on identity can have effect for ten years. There is a power to waive some of these requirements where there are compelling circumstances affecting the interests of Australia, or compelling or compassionate circumstances affecting the interests of an Australian citizen or permanent resident. A waiver is discretionary and cannot be assumed.
Most incorrect information in partner visa applications is not deliberate. It comes from guessed dates, forgotten addresses, or answers to questions that were misunderstood. A partner visa application review reduces that risk by checking every answer against the documents and the history before anything is submitted.
What Tribunal decisions show about the errors a review is designed to catch
Published Tribunal decisions show how errors of the kind a partner visa application review looks for can become central to a partner visa matter. The decisions below were remitted, which means the Tribunal sent the matter back to the Department for reconsideration. A remittal is not a visa grant, and each decision turned on its own facts and evidence.
- Burns (Migration) [2022] AATA 1657. A Subclass 309 matter involving incorrect information in the visa application about countries of previous residence, where compelling or compassionate circumstances and children born of the relationship were considered.
- Pham (Migration) [2021] AATA 4350. A Subclass 820 matter involving false or misleading information in a previous visitor visa application, in which the applicant had answered "married" when separated at the time and later divorced.
- Le (Migration) [2025] ARTA 2423. A Subclass 820 matter involving incorrect residential information in the visa application, assessed alongside a joint bank account and shared education expenses.
- Tran (Migration) [2023] AATA 3870. A Subclass 820 matter in which limited evidence at the time of application was a feature, and the financial, household and social aspects of the relationship and the nature of the commitment were assessed.
These matters reached the Tribunal. The better course is to find and deal with the same issues before lodgement, which is the purpose of a partner visa application review.
What to prepare for a partner visa application review
The more complete the material provided, the more useful a partner visa application review will be. Before the review, the couple should gather:
- the draft online application, or a full record of the answers they intend to give;
- the draft sponsorship form or the sponsor's intended answers;
- the relationship statement and every Form 888 statement;
- identity documents for both partners and any included children;
- marriage, divorce and name change documents;
- the relationship evidence, organised by aspect;
- any police certificates already obtained; and
- a full list of both partners' earlier visa applications, refusals, cancellations and sponsorships, with copies where available.
Where the couple do not have copies of earlier visa applications, that should be said. The firm can advise how the relevant history can be obtained. The point of a partner visa application review is to compare the new application with the old record, and that is only possible if the old record is known.
What happens after a partner visa application review
After a partner visa application review, the couple receive written advice. At My Migration Lawyers, the advice sets out the validity position, the risks identified, the changes required to the forms and statements, the documents to add or remove, and any matters that must be explained. Where a matter requires a decision, such as whether to lodge onshore or offshore, or whether to wait until more evidence is available, the advice says so.
The couple then make the changes. Where the review shows that the application can be lodged safely once the changes are made, the couple proceed. Where the review shows a serious risk, such as a validity problem, an integrity concern or a history that requires careful presentation, the advice will recommend that the firm take over the application. That recommendation is made because some risks cannot be managed by a one-off check.
A partner visa application review after lodgement
A partner visa application review is best done before lodgement, but many couples seek one after they have already lodged. That is still worthwhile. A review after lodgement identifies problems in the application as lodged, and advises whether further evidence should be provided, whether any information needs to be corrected, and how to prepare for a request or interview.
Changes in circumstances after lodgement are notified to the Department using Form 1022. Corrections to incorrect answers are made in writing with an explanation. Our guides to hiring an immigration lawyer after lodging your own visa application and to getting a second opinion from an immigration lawyer explain how the firm steps into a matter that is already with the Department.
What a partner visa application review cannot do
A partner visa application review cannot guarantee that a visa will be granted. The decision belongs to the Department, and it is made on the evidence and the law at the time of decision. What a review does is reduce avoidable risk.
A partner visa application review also cannot fix facts. If the relationship is short, if the couple have spent little time together, or if there is an adverse history, the review cannot remove those facts. It can make sure they are disclosed, explained and supported by the best available evidence. A review cannot replace evidence that does not exist. Where the evidence is thin, the honest advice may be to wait and build it before lodging, where the visa situation allows that.
A review is only as good as the information provided. The couple must give the lawyer a complete account of their visa and relationship history, including the parts they would prefer not to mention. Anything withheld cannot be checked.
Health and character questions in a partner visa application review
Every partner visa applicant must meet health and character requirements. A partner visa application review checks that the health and character questions in the forms have been answered accurately and completely, and that the couple understand what will follow, such as health examinations arranged through the Department and police certificates from the countries where the applicant has lived.
Where the applicant has a health condition, a criminal record, a driving offence, a court order or any other matter that might be relevant, the review advises on how to disclose it and what supporting documents to provide. Non-disclosure is a serious risk. A matter that would not have prevented grant can become a serious problem if it is left out of the forms and later discovered. A partner visa application review identifies these matters early so that the couple can obtain the right documents before lodgement rather than after a request.
Bridging visas, travel and work rights in a partner visa application review
For onshore applicants, a partner visa application review also covers the practical position after lodgement. A valid Subclass 820 application usually results in a bridging visa that keeps the applicant lawful while the application is processed. The type of bridging visa, the conditions attached to it, and the applicant's ability to travel depend on the applicant's visa position at the time of lodgement. Our guides to bridging visas in Australia, Bridging Visa A, Bridging Visa B and work rights while waiting for a Subclass 820 visa explain the main options.
A partner visa application review checks the timing of lodgement against the expiry of the current visa, so that the applicant does not become unlawful and does not unnecessarily trigger Schedule 3. Timing is one of the simplest things to get right and one of the most damaging to get wrong.
A partner visa application review for the permanent stage
The partner visa process has two stages. After the temporary visa is granted, the permanent Subclass 801 or Subclass 100 visa is assessed later, on whether the relationship is continuing. Our guide to Subclass 820 and Subclass 801 explains how the stages connect.
A partner visa application review can be carried out at the permanent stage as well. The firm checks that the further evidence shows the relationship continuing since the temporary visa, that any changes in circumstances have been notified, and that the updated Form 888 statements and documents are consistent with what was lodged before. Couples who lodged carefully at the first stage sometimes relax at the second. A short review guards against that.
If the Department raises concerns after lodgement
If the Department has concerns after lodgement, it may request more information under section 56 of the Migration Act 1958, or send a natural justice letter under section 57 inviting comment on adverse information. A partner visa application review does not end the firm's involvement if the couple want help at this point. Our guides to responding to a section 56 request and to the section 57 natural justice letter for a partner visa explain these letters. Response times are short and the response should be prepared carefully.
If the partner visa is refused
If a partner visa is refused, the refusal can usually be reviewed by the Administrative Review Tribunal. The application for review must generally be made within 28 days after the day the person is notified of the decision, and that time limit cannot be extended. The ART decides the matter afresh and can consider new evidence. Our partner visa refusals page, our guide to partner visa refused appeal options and our explanation of what to expect at ART review set out the process. For other refused visas, see our visa refusals page and our guide to finding a visa appeal lawyer.
How My Migration Lawyers carries out a partner visa application review
My Migration Lawyers carries out partner visa application review work for couples who have prepared their own application and want it checked before lodgement. The firm deals with complex partner visa cases and acts in many matters of this exact type, including self-prepared applications with validity questions, inconsistent visa histories, earlier refusals, earlier sponsorships and limited evidence. It is capable of carrying a review through to full representation where the review shows that is what the matter needs.
A partner visa application review at My Migration Lawyers is supervised by Weiwei Zhang, Principal Lawyer, and usually involves:
- Validity check. Confirming the right visa, the applicant's current visa and conditions, Schedule 3, onshore bars and the sponsor's eligibility.
- History check. Comparing the draft application with the couple's visa and relationship history, so that inconsistencies are identified and explained before lodgement.
- Evidence review. Assessing the documents against the four aspects of the relationship and identifying what to add, what to remove and what will carry little weight.
- Statement review. Reviewing the relationship statement and Form 888 statements for accuracy, completeness and consistency. The statement remains the couple's own account, which they correct and finalise.
- Form review. Going through the draft online answers, including character, health and previous visa questions, before submission.
- Written advice. Setting out the changes required and the risks that remain, and recommending full representation where the risks call for it.
Our partner visa work is available across Australia, including through our partner visa lawyers in Sydney, Melbourne, Brisbane, Perth, Adelaide, the Gold Coast, Canberra, Hobart and Parramatta. For related visa issues, our immigration lawyers in Sydney, Melbourne, Brisbane, Perth, Adelaide, the Gold Coast, Canberra, Hobart and Parramatta can assist. You can read more about My Migration Lawyers, our approach as immigration lawyers in Australia, and what to expect from an immigration lawyer consultation. Our guide to fixed-fee immigration lawyers explains what a quote for this kind of work should include.
A partner visa application review at My Migration Lawyers is practical. It is not a general lecture on partner visa law. It deals with the couple's own application, their own history and their own evidence, and it ends with clear written advice on what to change before lodgement. Where the couple decide to proceed on their own after the review, they do so knowing where the risks lie. Where they decide to instruct the firm for the full application, the work already done in the review carries straight into the application, so nothing is wasted.
If your application is ready, or nearly ready, a partner visa application review is the last chance to fix it quietly. Book a consultation with My Migration Lawyers online, or call 1300 040 300.
Frequently Asked Questions
What is a partner visa application review?
A partner visa application review is a lawyer's check of a partner visa application that the couple have prepared themselves, done before lodgement. It covers validity, the choice of visa, the sponsor, the relationship evidence, the relationship statement, Form 888 statements, identity and character documents, and consistency with earlier visa applications. The couple then receive written advice on what to change.
When should I get a partner visa application review?
Before lodgement, once the forms, statement and documents are drafted but before anything is submitted. At that point every error can be corrected without explanation. A partner visa application review is still useful after lodgement, but corrections then have to be explained to the Department and some problems, such as validity issues, cannot be undone.
How is a partner visa application review different from hiring a lawyer for the whole application?
In a partner visa application review, the couple prepare and lodge the application and the lawyer advises on what to change. In full representation, the lawyer prepares the application, organises the evidence, lodges it and deals with the Department throughout. A review suits straightforward matters. Full representation suits matters with validity questions, refusals, integrity risks or complex histories.
Can a partner visa application review guarantee my visa is granted?
No. No lawyer can guarantee a visa grant. The Department decides on the evidence and the law at the time of decision. A partner visa application review reduces avoidable risk by finding errors, gaps and inconsistencies before lodgement, and tells you which risks remain after the changes are made.
What are the most common errors found in a partner visa application review?
The most common errors are inconsistent relationship dates, addresses that do not match earlier applications, earlier refusals or relationships left out of the forms, statements that do not explain periods apart, evidence that carries little weight, and validity problems such as a visa condition or the lack of a substantive visa. Poorly organised uploads are also common.
Does a partner visa application review check my eligibility to apply onshore?
Yes. A partner visa application review starts with validity. For an onshore application, it checks the applicant's current visa and conditions, such as condition 8503, whether the applicant holds a substantive visa, whether Schedule 3 applies, and whether an earlier refusal or cancellation affects which visas can be applied for in Australia.
Will the lawyer rewrite our relationship statement?
The statement remains your own account. A partner visa application review identifies what is missing, inaccurate, unclear or inconsistent, and advises what to add or explain. You then correct and finalise the statement in your own words. A statement that reads like a template, or like someone else's account, carries less weight with a decision maker.
Does a partner visa application review check Form 888 statements?
Yes. The review checks whether each witness is eligible, whether each statement describes what the witness has personally seen, whether the statements use different wording, and whether they are consistent with the relationship statement and the documents. Identical or vague Form 888 statements carry little weight and can raise questions.
What happens if the review finds an inconsistency with an earlier visa application?
The partner visa application review identifies the inconsistency and advises how to disclose and explain it. Hiding an inconsistency is never the answer. Incorrect information can engage public interest criterion 4020, which can lead to refusal and, in some cases, a bar on further visas for a period. An honest explanation lodged with the application is the safer course.
Can I get a partner visa application review after I have already lodged?
Yes. A review after lodgement identifies problems in the application as lodged and advises whether to provide further evidence, correct any answers or prepare for a request or interview. Changes in circumstances are notified using Form 1022. The earlier the review, the more options there are.
Does a partner visa application review cover the sponsor?
Yes. The review checks that the sponsor is eligible, whether any sponsorship limitation applies, and whether the sponsor's answers in the sponsorship form match the applicant's application. The sponsor's history, including earlier sponsorships and earlier relationships, must be consistent with the relationship history given in the application.
What documents do I need to provide for a partner visa application review?
Provide the draft online forms or a record of your answers, the relationship statement, the Form 888 statements, identity documents, marriage and divorce documents, evidence of the relationship, police certificates if obtained, and a full account of both partners' visa history. A partner visa application review can only check what it is given.
Is a partner visa application review worth it for a simple case?
Often, yes. Many refusals involve couples who believed their case was simple. A partner visa application review can confirm that the application is ready, or find a validity issue, an inconsistency or a weak area before it costs time. For couples with any risk factor, such as an onshore application from a temporary visa, a review is strongly advisable.
What if the review says I need full representation?
That recommendation is made where the review finds risks that a one-off check cannot manage, such as a validity question, an integrity concern, a previous refusal or a complex history. You can then instruct the firm to take over the application. You remain free to lodge yourself, with the written advice from the partner visa application review as a guide.
Does a partner visa application review help at the permanent stage?
Yes. At the Subclass 801 or Subclass 100 stage, a review checks that the further evidence shows the relationship continuing, that changes in circumstances have been notified, and that updated statements and documents are consistent with what was lodged at the first stage.
