  2. Send us the letter from Home Affairs.
  3. Tell us the deadline shown in the letter.
  4. We review the health assessment. We tell you what the waiver needs to show.

You are not alone

Deadline almost here? You are not the only one.

Many people contact us with only days left to answer a health waiver letter. Usually it is because:
Worried woman looking down, health waiver deadline almost here
they were waiting on reports from their doctor or specialist
they did not understand what the letter was asking for
they thought their condition was not serious enough to matter
they were dealing with treatment or a family health crisis
their agent or lawyer did not tell them about it
they found it too upsetting to deal with
Whatever the reason, there is still time while your deadline has not passed. Send us your letter today.

The health requirement

What is the visa health requirement?

Most visa applicants, and family members in the application, must meet the health requirement. A Medical Officer of the Commonwealth reviews your health examinations and decides whether a condition is likely to:
result in significant health care or community service costs
limit Australians' access to health care or services in short supply
be a risk to public health or safety
If you do not meet the requirement, some visas allow a waiver and some do not. See Partner Visa Health Requirements.

What is weighed

What does Home Affairs look at in a health waiver?

A waiver is decided on your whole situation, not only your medical condition. See Partner Visa Health Waiver: Who Qualifies.
What is looked at
Evidence that can help
Your condition and how it is managed
Recent specialist reports and treatment plans
Whether your condition is stable or improving
Test results and medical history over time
Your ties to Australia
Evidence of your Australian partner, children or family
What you contribute
Work, skills, study and community involvement
The effect of a refusal on your family
Statements explaining how your family would be affected

Common problems

What makes a health waiver case harder?

These are the situations we see most often with health waivers.
0
1
2
3
4
01

The health concern is about a child or family member

Everyone in the application usually has to meet the health requirement, so a waiver may be needed for someone other than you.

02

Your medical reports are out of date

Home Affairs may rely on older information. Recent reports from your treating doctors can make a real difference.

03

You applied for a protection visa

Protection visas have their own health checks and process. See Health Requirements for Protection Visa 866.

04

Your visa has already been refused on health grounds

A health refusal can often be taken to the Tribunal, where new evidence can be given. See Partner Visa Health Refusal: Your Options.

Common questions

Health Waiver Frequently Asked Questions

My health waiver submission is due today. Can you still help?

Yes, if you contact us straight away. Send us the letter now and we will tell you what can be sent before the deadline.

Can I get an Australian visa with a medical condition?

Often yes. Many conditions do not stop a visa, and some visas allow a health waiver when the requirement is not met.

Which visas allow a health waiver?

Partner visas and some other visas allow a health waiver. Many temporary and skilled visas do not, so check your visa before you apply.

What is a Medical Officer of the Commonwealth?

A doctor who assesses your health examinations for Home Affairs and decides whether you meet the health requirement.

What does Home Affairs consider in a health waiver?

Your condition and its likely costs, your ties to Australia, what you contribute, and the effect a refusal would have on your family.

What are my options if my visa is refused on health grounds?

You may be able to apply to the Tribunal and give new medical evidence. See What Are My Options After a Partner Visa Refusal on Health Grounds?

Is there a deadline to appeal a health refusal?

Yes, and it is strict. For many refusals made in Australia, it is 28 days. See Urgent ART Visa Refusal Applications.

Which lawyer can help with a health waiver in Australia?

My Migration Lawyers prepares health waiver submissions anywhere in Australia, with consultations by video. We focus on partner visa, protection visa and refusal matters. See Visa Refusal Lawyers.
