ART visa refusal questions
My ART deadline is today. Can you still lodge?
Yes, if you contact us straight away. Send us your decision letter and passport now, and we will confirm your deadline and lodge your ART application today. We have lodged visa applications within 2 hours of a first consultation.
Which lawyer should I use to appeal a visa refusal in Australia?
Choose a migration lawyer who handles refusals and Tribunal reviews every day. My Migration Lawyers practises only partner visas, protection visas and refusals, lodges urgent ART applications for clients anywhere in Australia by video, and has lodged visa applications within 2 hours of a first consultation.
How long do I have to appeal a visa refusal in Australia?
For most visa refusals made while you are in Australia, you have 28 days from the day you were notified to apply to the Administrative Review Tribunal. Shorter limits apply in immigration detention and to character cancellations. Send us your letter and we will confirm your exact deadline.
Can the ART deadline be extended?
No. The ART has no power to extend the time limit for reviewing a visa refusal, and a late application cannot be accepted. That is why we lodge your application first and work on the evidence after.
Can I stay in Australia while the ART reviews my refusal?
If you hold a bridging visa linked to the refused application, it generally stays in effect while a valid ART application is on foot and until shortly after the Tribunal decides. We check your bridging visa position when we lodge. See What Happens to My Bridging Visa If My Partner Visa Is Refused?
What are my chances of winning at the ART?
Your chances depend on why your visa was refused and whether those reasons can be answered with evidence and law. Many refusals turn on gaps the Department found in the evidence, and those gaps can often be filled at the Tribunal. We tell you honestly where your case stands once we have read the decision.
How long does the ART take to decide a visa refusal?
ART processing times vary with the type of visa and the Tribunal's caseload, and many reviews take months to reach a hearing. Lodging on time protects your review, and the waiting period is when we build your evidence. See How Long Does a Tribunal Review of a Partner Visa Refusal Take?
What happens if the ART also refuses my visa?
If the ART affirms the refusal, you may be able to seek judicial review in the courts if the Tribunal made a legal error, or ask the Minister to intervene in some cases. Both have strict rules, and a court application has a short time limit, so we advise you on them as soon as the decision arrives. See What Options Do I Have If the Tribunal Upholds My Refusal?
Can I work while the ART reviews my refusal?
Your work rights come from your bridging visa. If your bridging visa lets you work, it generally keeps the same conditions while your ART review is on foot. We check your conditions when we lodge.
Can I add new evidence at the ART?
Yes. The ART decides your case again on its merits and can consider evidence the Department never saw. Answering each reason for refusal with new evidence is a big part of what we do in every review. See Can I Give the Tribunal New Evidence Not in My Original Application?
What happens after you lodge my ART application?
The Tribunal sends an acknowledgement and later invites you to a hearing. We use that time to get the Department's file, gather new evidence and send written submissions to the Tribunal before your hearing.
Is the ART the same as the AAT?
The Administrative Review Tribunal (ART) replaced the Administrative Appeals Tribunal (AAT) on 14 October 2024. Visa refusals once appealed to the AAT are now reviewed by the ART.
