Cancellation is not refusal. A refusal means you never held the visa. A cancellation takes away a visa you already have, and the moment it takes effect you become an unlawful non-citizen, liable to detention and removal.

In most cases the Department must give you notice first and a chance to respond, and that notice is where these matters are actually decided. A strong, evidenced response frequently stops a cancellation. No response almost always ends in one.
Which section is being used determines your deadline, your review rights and what happens to your family, so the first thing to establish is what the letter actually says.

Where to Start

Which Section Is Being Used

Short answer

Your letter names a section of the Migration Act, and that section determines everything: how long you have to respond, whether you get notice at all, whether review is available, and what happens to your family. Find the section number in the letter before you do anything else.

You Have Received a
NOICC

A Notice of Intention to Consider Cancellation. Your visa is still valid and nothing has been decided. This is the stage where cancellation is most often prevented, and the cheapest place to fight it.

Section 109,
Incorrect Information

Cancellation because information or a document given to the Department was incorrect, in this application or an earlier one. Permanent visa holders generally get 14 days to respond.

Section 116, Breach or
Changed Circumstances

The broadest ground. A breach of a visa condition, circumstances that no longer exist, or a risk to health, safety or good order. The power is discretionary, which is what makes a response worth making.

Section 501,
Character

Cancellation on character grounds. Mandatory cancellation can happen without any prior notice, and where the Minister decides personally there is no Tribunal review at all.

Your Visa Has Been
Cancelled

Once cancellation takes effect you are an unlawful non-citizen. Review deadlines are short, and shorter again if you are in immigration detention. Check the letter for your review rights.

The Tribunal Affirmed the
Cancellation

What remains is narrower. Judicial review examines whether the decision was lawfully made rather than whether it was right, and it runs on its own strict deadline.

The NOICC

What Is a NOICC and How Long Do You Have

Short answer

A Notice of Intention to Consider Cancellation tells you the Department is considering cancelling and invites you to respond. Your visa remains valid until a decision is made. The deadline is stated in the notice, it commonly runs from five working days to 28 days, and information received after it may not be considered at all.

Response periods vary by ground and by the visa you hold. A permanent visa holder responding to a section 109 notice generally has 14 days. Temporary visa holders under section 116 are frequently given five working days, and a person in immigration detention can be given as little as three. Your notice states the period that binds you and it is the only authority that counts.

Visa Cancellations Australia Explained

In this video, My Migration Lawyers explains the main legal pathways that may be available following an adverse immigration decision.

A visa refusal or cancellation does not automatically mean that every legal avenue has ended. However, review rights depend on the specific decision, and strict time limits can apply.

The Consequences

What Happens if Your Visa Is Cancelled

Short answer

You become an unlawful non-citizen the moment the cancellation takes effect. That carries an immediate liability to detention and removal, it usually cancels your family members' visas with yours, and it can bar you from further applications while you remain in Australia.

Shortest NOICC period

3

days
Working days, reported for people in immigration detention.

Common s 116 period

5

days
Working days, which excludes weekends and public holidays.

Permanent visa, s 109

14

days
The period generally given to permanent visa holders under section 107.
Passports and a boarding pass held in a woman's hands, cancellation consequences for family members
Your family members are the consequence people do not see coming. Where a visa is cancelled under section 109 or 116, the visas held by members of your family unit as secondary applicants are generally cancelled with it. Your partner and your children become unlawful at the same moment you do, without ever having done anything themselves.

A Bridging Visa E may keep you lawful while a review runs, but it is not automatic and applying for one can itself bring you to the Department's attention. Where cancellation has already occurred and you are in the community, that application needs to be made carefully and quickly rather than left.

Already cancelled? The position is urgent and the first hour matters more than the next week.

Evidence

What a NOICC Response Needs to Contain

Short answer

A letter asking the Department not to cancel your visa is not a response. What is needed is an argument on each ground raised, evidence behind it, and a case for why the discretion should not be exercised even if a ground is made out.
Full binder of documents with a pen, answering each ground in a NOICC

An Answer to Each Ground

Take the notice apart line by line. Address each allegation on its own terms, either denying it with evidence or explaining it.

Evidence, Not Assertion

Enrolment records, payslips, medical evidence, statements, correspondence. Whatever proves the ground is wrong or explains why it happened.

A Case on Discretion

Most cancellation powers are discretionary. Even where a ground exists, the delegate can decline to cancel. That argument has to be made.

Consequences to Others

Hardship to an Australian partner, to children, or to anyone dependent on you. This is relevant and it is frequently left out entirely.
A generic letter will not stop a cancellation. An argued, evidenced response frequently does.

The Process

How the Cancellation Process Works

Short answer

There are two moments where this can be stopped, and they are not equal. The NOICC response is the first and by far the best. Tribunal review is the second, and by then you are already unlawful and the position is far harder and more expensive.

01

Find the Section and the Deadline

The letter names a section of the Migration Act and states a period. Both determine everything that follows. Read it before you do anything else.

02

Keep Complying With Your Visa Conditions

A breach after receiving a notice makes the position considerably worse. Nothing about the notice suspends your obligations. Your visa remains valid until a cancellation decision is actually made. You have not lost anything yet.

03

Request an Extension if You Need One, Immediately

A short extension is sometimes granted, often five further working days. It is not guaranteed and it must be asked for promptly, in writing.

04

Gather the Evidence That Answers Each Ground

Not a character reference. Documents that address the specific allegation, and documents that show the consequences of cancellation for others.

05

File a Written Response Before the Deadline

Argued on each ground, evidenced, and putting a case on discretion. Material received after the deadline may not be considered at all.

06

If the Visa Is Cancelled, Act the Same Day

You are unlawful from that moment. Review deadlines are short, and a bridging visa application may be needed to keep you in the community.

07

Lodge the Review Within the Period

Check the letter for the period and where to apply. The Tribunal decides the matter afresh and can set the cancellation aside. For most migration decisions the Tribunal has no power to extend, and a late application is invalid rather than merely weak.

08

Prepare for the Hearing

A member hears from you directly. Written submissions, evidence and witnesses who can attend and answer questions.

Step one is the only one with a fixed clock on it. Start there, today.

What Goes Wrong

Why Do NOICC Responses Fail

Short answer

A letter asking the Department not to cancel your visa is not a response. What is needed is an argument on each ground raised in the notice, evidence behind every point, and a separate case for why the discretion should not be exercised even if a ground is made out on the facts.

Not Responding
at All

The single largest cause. A NOICC with no response almost always ends in cancellation.

Assuming the Department Is Bluffing

It is not. The notice means a delegate is actively considering cancelling and has grounds to do so.

Sending a Plea Instead of an Argument

Asking not to be cancelled, without addressing the grounds, is not a response and will not be treated as one.

Missing the
Deadline by Days

Often five working days, which excludes weekends. Material received late may not be considered at all.

Not Asking for an Extension in Time

Sometimes granted, often five further working days, but only if asked for promptly and in writing.

Ignoring the
Discretion Argument

Most cancellation powers are discretionary. Even where a ground exists the delegate can decline to cancel.

Leaving Out the Consequences to Others

Hardship to an Australian partner or children is relevant and it is frequently never mentioned.

Breaching Conditions After the Notice

Nothing about a NOICC suspends your visa conditions, and a fresh breach makes the position considerably worse.

How We Help

How My Migration Lawyers Assists With a Visa Cancellation

Short Answer
‍
We identify the section, confirm the deadline in writing on the first day, take the notice apart ground by ground, gather the evidence that answers each one, build the argument on discretion, draft and file the response, and if the visa is cancelled we deal with the bridging visa and run the Tribunal review.
1

Identifying the Section and the Deadline

The letter names a provision and states a period, and both determine everything that follows. We confirm your deadline in writing on the first day, because a response filed late may not be considered at all.
2

Urgent Same Day Advice

Where the period is five working days, or three in detention, there is no time for a callback next week. These matters are triaged on the day the notice arrives.
3

Requesting an Extension Properly

A short extension is sometimes granted, often five further working days. It has to be asked for promptly and in writing, and asking badly can be worse than not asking.
4

Taking the Notice Apart Ground by Ground

Each allegation gets its own answer. A response that addresses the notice generally, rather than each ground specifically, is the most common kind that fails.
5

Gathering the Evidence That Answers It

Enrolment and attendance records, payslips, medical evidence, correspondence with a provider or employer, statements from people with direct knowledge. Documents, not assertions.
6

Building the Discretion Argument

Most cancellation powers are discretionary. Even where a ground is made out, the delegate can decline to cancel. That argument is frequently the one that works and it is frequently never made.
7

Evidencing Consequences to Others

Hardship to an Australian partner, to children, to anyone dependent on you. This is relevant, it carries real weight, and applicants almost never raise it themselves.
8

Drafting and Filing the Response

A written submission answering each ground, with the evidence indexed to it and a case on discretion, filed before the deadline rather than on it.
9

Challenging the Underlying Report

On student visa matters, providers must follow prescribed steps before reporting a breach. Where those steps were skipped, the report itself may be open to challenge.
10

Family Members Included on Your Visa

Where a visa is cancelled under section 109 or 116, secondary visas held by your family unit generally go with it. We identify who else is exposed and act for them too.
11

Bridging Visa E Applications

Where cancellation has occurred, a Bridging Visa E may keep you lawful while a review runs. It is not automatic and the application needs care, because it brings you to the Department's attention.
12

Lodging the Tribunal Review in Time

Where the visa is cancelled, review deadlines are short and shorter again in detention. We confirm the period and lodge inside it.
13

Running the Tribunal Matter

Written submissions, evidence, and a hearing where a member decides the matter afresh and can set the cancellation aside. We prepare you and appear with you.
14

Section 501 and Character Matters

Character cancellation runs on a different regime, sometimes with no prior notice and sometimes with no Tribunal review at all. We identify that immediately and advise on what is actually open.
15

Advice on What Comes Next

Where the Tribunal affirms, judicial review examines whether the decision was lawfully made and runs on its own deadline. We assess whether that is genuinely available.
16

Planning the Next Visa

Where cancellation stands, the next question is what you can apply for and whether a bar applies. That advice is worth having before you lodge anything.

Questions

Visa Cancellation Frequently Asked Questions

Answers to the questions Indonesians applicants ask most often. See also our 30 protection visa FAQs and 30 LGBT protection visa FAQs.

What Is a NOICC

A Notice of Intention to Consider Cancellation. It tells you the Department is considering cancelling your visa and invites you to respond in writing. Your visa remains valid until a decision is actually made.

Does a NOICC Mean My Visa Is Cancelled

No. Nothing has been decided. A strong, evidenced response can and does result in the Department deciding not to cancel. A weak response or no response almost always ends in cancellation.

How Long Do I Have to Respond to a NOICC

The notice states the period. It commonly runs from five working days to 28 days. Permanent visa holders under section 109 generally get 14 days. A person in immigration detention can be given as little as three working days.

Can I Get an Extension

Sometimes, often a further five working days, but it is not guaranteed and it must be requested promptly and in writing. Do not assume you will get one and do not wait to find out before starting your response.

What Is the Difference Between a Refusal and a Cancellation

A refusal means the visa was never granted. A cancellation takes away a visa you already hold, and you become an unlawful non-citizen the moment it takes effect. See Visa Refusals.

What Happens to My Family

Where a visa is cancelled under section 109 or 116, the visas held by members of your family unit as secondary applicants are generally cancelled with it. Your partner and children become unlawful at the same moment you do.

Can I Appeal a Visa Cancellation

Usually. Cancellations under sections 109, 116 and by a delegate under section 501 generally carry Tribunal review. A section 501 decision made by the Minister personally does not. Check your letter for your review rights and the deadline.

Can I Stay in Australia After a Cancellation

Not lawfully, unless a bridging visa is granted. A Bridging Visa E may keep you in the community while a review runs, but it is not automatic and the application needs to be made carefully.

What Is a Section 116 Cancellation

The broadest ground. It covers a breach of a visa condition, circumstances that no longer exist, and risk to the health, safety or good order of the Australian community. The power is discretionary, which is what makes a response worth making.

What Is a Section 109 Cancellation

Cancellation because incorrect information or a bogus document was given to the Department. It can be triggered by something in an earlier application, not just the one that granted your current visa.

What if I Do Nothing

The delegate decides on the material in front of them, which will be the Department's case and nothing from you. That almost always results in cancellation. Doing nothing is the single most common reason these matters are lost.

My Visa Was Cancelled on Character Grounds

Section 501 runs on a different regime. Mandatory cancellation can happen without prior notice, and where the Minister decides personally there is no Tribunal review. What is available is usually a revocation request, on a strict deadline.
