The Administrative Review Tribunal replaced the Administrative Appeals Tribunal on 14 October 2024 and now handles all migration and protection review.

It conducts merits review, which means it stands in the shoes of the original decision maker and decides the case again on all the material before it, including evidence that did not exist when you applied.
An adverse finding by a delegate does not bind it. What ends a matter is not a weak case. It is a missed deadline, and the single most useful thing you can do today is work out exactly when yours falls.

Where to Start

What Kind of Decision Are You Dealing With

Short answer

A refusal and a cancellation are different decisions under different provisions, with different deadlines, and what comes after the Tribunal is different again. Start with the card that matches the wording on your letter, because the timeframe you are working to depends entirely on which one you are in.

Partner Visa
Refusal

Onshore and offshore partner visa refusals. The Tribunal decides the application again and accepts new evidence, which is why evidentiary refusals are so often reversed.

Protection Visa
Refusal

Protection and refugee claim refusals. No upfront Tribunal fee, but the wait is long and section 48A generally bars a second protection application.

Visa
Cancellation

A cancellation is a different decision from a refusal, with different provisions and often much shorter deadlines. If your letter says cancelled rather than refused, start here.

Judicial
Review

What happens if the Tribunal affirms the decision. The Court asks whether the decision was lawfully made, not whether it was right on the facts.

Sponsorship
Refusal

Where the sponsorship rather than the visa was refused. It carries its own review right and its own deadline, and in some matters two separate reviews are needed.

Missed the
Deadline

For most migration decisions the Tribunal cannot extend, and a late application is invalid rather than weak. Narrower options remain and all of them run on their own clocks.
Not sure which of these you are in? Send us the letter and we will tell you today.

How Long Do You Have to Appeal a Visa Refusal

Short answer

It depends on the decision and on where you are when it is made. The periods below are the ones we see most often across migration and protection matters. Your own letter states the period that binds your matter, and it is the only authority that counts for you.

Visa Refusals Australia Explained

In this video, My Migration Lawyers explains the main legal pathways that may be available following an adverse immigration decision.

A visa refusal or cancellation does not automatically mean that every legal avenue has ended. However, review rights depend on the specific decision, and strict time limits can apply.

The Tribunal

What Does the Administrative Review Tribunal Do

Short answer

Merits review. The Tribunal is independent of the Department, it decides the application again on all the material before it, and it accepts evidence that did not exist when you applied. Its task is to reach the correct and preferable decision, not to audit the delegate.

Team meeting over legal papers, what the Tribunal can decide on a refusal
The Tribunal can affirm the decision, vary it, set it aside and substitute its own, or remit the matter to the Department with directions. Remittal is the most common successful outcome. It is not a grant. The file goes back with a direction that a criterion is met, and the Department then completes health, character and security checks before deciding.

Success rates vary enormously by category, and that is not luck. Partner refusals are usually evidentiary, so the gap can be closed with new evidence. Protection refusals usually turn on credibility, which is much harder to reverse. Which category you are in tells you a great deal about the realistic prospects.

Whether your refusal is the fixable kind is the first thing worth knowing, and it takes one conversation.

Evidence

What Wins a Visa Appeal

Short answer

One thing above all others: a direct answer to the specific findings in the refusal. The Tribunal has already read the delegate's reasons before you walk in. An appeal that resubmits the original material in a tidier folder, without engaging with why it was rejected, will usually be decided the same way.
Couple holding travel tickets, answering the delegate's findings

The Delegate's Findings, Answered

Take the refusal apart line by line. Every concern raised needs a response and, where possible, a document behind it.

The Department File

Request the material the delegate relied on. You cannot answer reasoning you have not read in full, and the file often reveals more than the letter.

Everything Since the Refusal

Material the Department never saw is often the strongest part of an appeal, because it is contemporaneous and it answers the concern directly.

A Written Submission

The Tribunal is deciding the case again, so it needs to be told what the case is rather than left to assemble it from documents.
Lodge inside the period first. The evidence and submissions can be built afterwards.

The Process

How the Appeal Process Works

Short answer

Lodging is the urgent part and everything else follows from it. A valid application inside the period preserves your review rights and usually your bridging visa, even if none of your evidence is ready. A perfect application lodged one day late preserves nothing at all, because the Tribunal cannot extend.

01

Find the Notification Date

Not the date you opened the letter. Work from the date you are taken to have been notified, which the deeming rules fix by law.

02

Calculate the Deadline and Diarise It

Count from the notification date. Set a reminder five days before, not on the day. For most migration decisions the Tribunal has no power to extend, and a late application is invalid rather than merely weak.

03

Lodge Within the Period

Do this even if your evidence is not ready. Lodgement is the step that preserves everything.

04

Secure Your Bridging Visa

Applying within the period generally allows a further bridging visa. Confirm it is granted and check the conditions attached.

05

Obtain the Department File

The material the delegate relied on, including any interview record. You cannot answer reasoning you have not read.

06

Analyse Every Adverse Finding

Each finding needs a response and a document. This analysis determines the whole appeal strategy. An appeal that does not engage with the delegate's actual reasoning is the most common kind that fails on the merits.

07

File Submissions and Prepare for the Hearing

A written submission setting out the case, plus witnesses who can attend and answer questions.

08

The Hearing and the Decision

A member hears from you directly. Affirm, vary, set aside and substitute, or remit with directions.

What Goes Wrong

Why Do Visa Appeals Fail

Short answer

Most losing appeals lose before the merits are ever reached. Missing the period is the largest single cause and it cannot be cured. Of the appeals that are heard, the ones that fail usually repeat the original application rather than answering the reasons the Department gave.

Lodging Outside the Period

The largest single cause, and for most migration decisions it cannot be cured.

Counting From the Wrong Date

The period runs from the deeming date, not the date you opened the letter.

Resubmitting the Original Application

The Tribunal has read the delegate's reasons. A tidier folder of the same material changes nothing.

No Written Submission

Leaving a member to assemble the case from documents rather than being told what it is.

Not Obtaining the Department File

You cannot answer reasoning you have not read in full.

No New Evidence

Merits review accepts material that did not exist before. Not using that is giving away the main advantage.

Inconsistency at the Hearing

Between the written material and the oral evidence, often because earlier statements were never reread.

A Tribunal Request Answered Late

Deadlines during the review are short and a member can decide on what is in front of them.
The first two are fatal and both are avoidable with one phone call. The rest are fixable with preparation.

How We Help

How My Migration Lawyers Assists With a Visa Refusal

Short Answer
‍
We confirm the deadline, lodge inside it, obtain the Department file, take the refusal apart finding by finding, build the evidence that answers each one, file written submissions, and appear at the hearing with you. If the Tribunal affirms, we advise on what remains open and act inside whichever deadline applies.
1

Confirming the Deadline in Writing

We work out the date you are taken to have been notified and count the period from there. Getting this wrong by a day ends the matter, so we confirm it to you in writing before anything else happens.
2

Reading the Refusal Properly

Refusal letters set out the delegate's findings in detail below the decision. That detail is the specification for the appeal, and it tells us immediately whether your refusal is the fixable kind.
3

Honest Merits Advice

If review is not the right course, we say so at the first consultation rather than after you have paid. Some refusals are evidentiary and reversible. Some rest on a bar that no amount of evidence cures.
4

Lodging the Review Application

Preparing and lodging with the Tribunal within the period, dealing with the fee including any reduced fee request, and confirming lodgement in writing so you know the deadline has been met.
5

Bridging Visa Protection

Applying within the period generally allows a further bridging visa. We make sure it is applied for, granted, and that you understand the conditions, so your status and work rights continue.
6

Obtaining the Department File

The material the delegate relied on, including internal notes and any interview record. The file frequently reveals concerns the refusal letter only summarised.
7

Analysing Every Adverse Finding

We map each finding to the evidence needed to answer it. That analysis is the appeal strategy and everything else follows from it.
8

Evidence Strategy and Collection

Material from the period since the refusal is often the strongest part of an appeal, and it has to be assembled deliberately rather than gathered at the last moment.
9

Written Legal Submissions

A submission setting out each criterion, the evidence against it, the relevant law, and why the delegate's reasoning does not hold. Not a folder of documents with a covering letter.
10

Responding to Tribunal Requests

Members can request documents, issue directions and put adverse information to you for comment. We handle each within time and in the form the Tribunal expects.
11

Hearing Preparation

We take you through your own earlier statements and the areas the member is likely to probe, so that a gap of months or years does not create new inconsistencies.
12

Witness Preparation and Attendance

Identifying which witnesses genuinely help, confirming availability, and preparing them. A witness who can answer questions carries far more weight than a written declaration.
13

Appearing at the Hearing

We attend and put the case. You are not sitting in that hearing alone, and procedural problems are raised at the time rather than after the decision.
14

Carrying a Remittal Through to Grant

A remittal is not a grant. We deal with the Department afterwards, including refreshing health and police certificates that expired during the review, so the file reaches decision.
15

Advice if the Tribunal Affirms

Judicial review, ministerial intervention, or a fresh application where one is available. We assess which is genuinely open and act inside whichever deadline applies.
16

Cancellations and Character Matters

Where the decision is a cancellation rather than a refusal, or engages the character provisions, the regime and the deadlines differ. We identify that at the first call.

Questions

Visa Refusal Frequently Asked Questions

Answers to the questions Indonesians applicants ask most often. See also our 30 protection visa FAQs and 30 LGBT protection visa FAQs.

How Long Do I Have to Appeal a Visa Refusal

It depends on the decision. Partner visa refusals carry 28 calendar days. Protection refusals carry 28 days in the community and 7 working days in detention. Character matters and detention cancellations are shorter. Your letter states the period that binds you.

Can the Deadline Be Extended

No, not for most migration decisions. The Tribunal has no power to extend and a late application is invalid rather than merely weak. That is why the first thing to establish is exactly when your period expires.

What Date Does the Deadline Run From

The date you are taken to have been notified, which is fixed by law and is often not the date you opened the letter. A decision sent to your ImmiAccount is usually taken to have been received the day it was sent.

What Does the Tribunal Actually Do

Merits review. It is independent of the Department, it decides the application again on all the material before it, and it accepts evidence that did not exist when you applied. An adverse finding by a delegate does not bind it.

Can I Stay in Australia While the Appeal Runs

Usually. Applying for review within the period generally allows a further bridging visa, and work rights often continue. That is one of the strongest practical reasons to lodge inside the period rather than deciding later.

How Much Does an Appeal Cost

The standard migration review fee is in the order of $3,727, with a partial refund if the review succeeds and a reduced fee available in cases of financial hardship. There is no upfront fee for a protection visa review, and a fee of $2,293 is payable only if the review is unsuccessful.

What Are My Chances

It depends heavily on the category. Partner visa appeals were set aside at around 55% on Tribunal data for July 2024 to March 2025. Protection appeals succeed at around 10%. Evidentiary refusals reverse far more often than substantive ones.

Can I Give the Tribunal New Evidence

Yes, and you should. Merits review accepts material that did not exist when you applied. Evidence from the period since the refusal is frequently the strongest part of an appeal.

Will There Be a Hearing

In most matters, yes. A member hears from you directly, in person or by video, with an interpreter if needed. You can call witnesses and you can be represented.

Does the Tribunal Grant the Visa

No. It can affirm, vary, set aside and substitute, or remit the matter to the Department with directions. Remittal is the most common successful outcome, and the Department then completes the remaining checks.

My Visa Was Cancelled, Not Refused

That is a different decision under different provisions, often with much shorter deadlines and a risk of detention. See Visa Cancellation.

What if the Tribunal Affirms the Refusal

Judicial review examines whether the decision was lawfully made, not whether it was right on the facts, and it runs on its own deadline. See Judicial Review of Migration Decisions.
