The Administrative Review Tribunal replaced the Administrative Appeals Tribunal on 14 October 2024. It conducts merits review, which means it stands in the shoes of the original decision maker and decides the case again on all the material before it, including evidence that did not exist when you first applied.

Partner visa appeals succeed more often than most visa categories.
Published Tribunal data for July 2024 to March 2025 put the partner visa set aside rate at around 55%. The single biggest reason appeals fail is missing the deadline.

The Deadline

How Many Times Can You Sponsor a Partner

Short answer

The standard deadline for every partner visa subclass is 28 calendar days. That applies to the 820, 801, 309, 100 and 300, and to the 461 where the refusal carries review rights. The period runs from the date you are taken to have been notified, and for most migration decisions the Tribunal cannot extend it.
The periods are prescribed in regulation 4.10 of the Migration Regulations 1994. Your refusal letter states which one applies to your decision. Read it twice, then put the date in a calendar. This is not a case where a few days either way can be argued about later.

The trap is the deeming rule. You are taken to have been notified on a date fixed by law, not the date you actually opened the letter. A decision sent to your ImmiAccount is usually taken to have been received on the day it was sent. A posted decision is deemed received a set number of working days after dispatch. Count from the deeming date, always.

Where You Stand

What Happens to Your Visa Status After a Refusal

Short answer

The four questions people ask within an hour of reading the letter. Your bridging visa, whether you can lodge again, whether you have to leave, and what happens if the deadline has already passed. The answers depend on where you are and what you hold.
Passport and map laid out on a table, partner visa refusal appeal

Your Bridging Visa After a Refusal

A Bridging Visa A generally ceases 35 days after the refusal if you do not apply for review. If you do apply within time, a further bridging visa is usually available to keep you lawful while the Tribunal deals with the matter. This is one of the strongest practical reasons to apply for review within the period rather than deciding later.

The Section 48 Bar

Once a visa has been refused while you are in Australia, section 48 of the Migration Act bars most further onshore applications. The partner visa is one of the prescribed exceptions, so it can still be lodged, but many other visas cannot. Do not assume you can simply apply for something else. Check the position before you lodge anything.

If the Deadline Has Already Passed

For most migration decisions the Tribunal has no power to extend, and a late application is invalid rather than merely weak. That does not mean nothing can be done. The remaining options are a fresh application where one is available, judicial review where there is a legal error in the decision, or ministerial intervention. All three are narrower than review, so get advice quickly.

Should You Appeal or Apply Again

Sometimes. A fresh application can be stronger and faster than review where the refusal turned on a fixable gap and no bar applies. It can also be a costly mistake, because a fresh application means a second charge of AUD $11,710 and abandons the place you already hold in the queue. This should be a considered decision, not a reflex.
Every one of these turns on dates and documents specific to you. A short call establishes where you actually stand.

Visa Refusals Australia Explained

In this video, My Migration Lawyers explains the main legal pathways that may be available following an adverse immigration decision.

A visa refusal or cancellation does not automatically mean that every legal avenue has ended. However, review rights depend on the specific decision, and strict time limits can apply.

The Tribunal

What Does the Administrative Review Tribunal Do

Short answer

The ART conducts merits review. It stands in the shoes of the original decision maker and decides the case again on all the material before it. It is not confined to the evidence the Department had, and it is not limited to asking whether the Department made a legal error.
Gavel on a desk with a city office view, ART partner visa appeal

It Decides the Case Again

Merits review, not an audit of the Department's reasoning. The Tribunal reaches its own conclusion on the evidence.

New Evidence Is Allowed

Material that did not exist when you applied can be put before the Tribunal, including everything since the refusal.

You Usually Get a Hearing

Most migration matters are decided after a hearing, in person, by video or by phone. You and your witnesses give evidence.

It Can Remit With Directions

The most common successful outcome. The matter goes back to the Department with a direction that a criterion is met.

It Cannot Grant the Visa Itself

The Tribunal affirms, varies, sets aside and substitutes, or remits. The Department then implements the outcome.

Members Can Ask for Documents

Tribunal members have inquisitorial powers and can request material and hold directions hearings

The ART Replaced the AAT on 14 October 2024

The Administrative Appeals Tribunal ceased on that date and the Administrative Review Tribunal took over its migration work. The grounds and the practical process are largely unchanged. If you are reading older material referring to the AAT, the substance usually still applies but the names and the fees do not.

How Long It Stays Valid

Because it is merits review with new evidence permitted, an appeal is not a re-argument of the original application. It is a fresh case built on everything that has happened since, and that is why refusals caused by thin evidence rather than genuine ineligibility are so often reversed.

The Odds

What Are the Chances of Winning a Partner Visa Appeal

Short answer

Better than most visa categories. Published Tribunal data for July 2024 to March 2025 put the partner visa set aside rate at around 55%, ahead of temporary work visas at 56% and skilled visas at 58%, and far ahead of protection visas at 10%. These are historical figures across all applicants, not a prediction for your matter.

Why Partner Visa Appeals Do Better Than Most

The reason is structural rather than lucky. Most partner visa refusals are evidentiary, not substantive. The couple is genuine and eligible, but the application did not prove it well enough in one of the four regulatory categories. Because the Tribunal conducts merits review and accepts new evidence, that gap can be closed on appeal in a way it cannot be on judicial review.

Refusals that turn on a substantive bar work differently. Where the sponsorship limit has been reached, where health or character cannot be met, or where the Tribunal is not persuaded the relationship is genuine, the same evidentiary fix is not available.

The Four Possible Outcomes

The Tribunal can affirm the decision, leaving the refusal standing. It can vary the decision. It can set aside and substitute its own decision. Or it can remit the matter to the Department with directions, which is the most common successful outcome on partner visas.

Remittal is not a grant. It sends the file back with a direction that a particular criterion is met, and the Department then completes the remaining checks and decides.

The Tribunal Application Fee

A fee is payable to lodge, set by regulation and reviewed annually. Published figures differ between sources and have recently been quoted between roughly AUD $3,500 and $3,600 for standard migration reviews, with no fee for protection matters. A partial refund applies where the review succeeds. Confirm the current amount on the Tribunal website before lodging, because this figure changes each year.

A reduced fee may be available in cases of financial hardship. If the fee is the obstacle, raise it rather than letting the deadline pass.

Timing

How Long Does a Partner Visa Appeal Take

Short answer

Reported timeframes for migration matters at the Tribunal range widely, commonly from six months to over two years depending on the category, the complexity and the Tribunal workload. Nobody can give you a reliable number for your own matter, and any adviser who does is guessing.

What you control is readiness. A matter with the file obtained, the submissions filed and the evidence assembled moves through hearing far more smoothly than one where material arrives piecemeal. The waiting period is also not dead time. It is the window in which the evidence that was missing at refusal gets built.

For most applicants a bridging visa keeps them lawful throughout, with work rights continuing. That makes the wait uncomfortable rather than dangerous, provided the review was lodged within the period and the bridging visa is properly in place.

Use the time. Relationship evidence from the period after the refusal is often the strongest material in the whole appeal, because it is contemporaneous and it answers the concern directly.

Relationship Evidence

What Evidence Wins a Partner Visa Appeal

Short answer

The same four categories the Department assessed, under Migration Regulation 1.15A, plus one thing the original application did not have. A direct answer to the specific reasons given in the refusal letter. An appeal that simply resubmits the original evidence in a tidier folder usually fails.

Answering the Refusal Reasons Directly

Take the refusal letter apart line by line. Every concern the delegate raised needs a response and a document behind it. If the delegate said the financial evidence was thin, the appeal leads with financial evidence, not with photographs.

Everything Since the Refusal

This is the material the Department never saw and it is often decisive. Months or years of continued cohabitation, joint finances, a lease renewal, a child born, family events attended together. Contemporaneous evidence of a relationship still running answers the question better than argument.

Witnesses Who Can Attend

Most partner matters are decided after a hearing, and witnesses can give evidence in person or by video. A witness who can answer questions carries more weight than a written declaration. Identify who is willing and available early rather than the week before.

A Written Submission

The Tribunal is deciding the case again, so it needs to be told what the case is. A submission setting out the criteria, the evidence against each, and why the refusal reasoning does not hold is the difference between a folder of documents and an argument.

Documents Commonly Required

The refusal letter and the Department's full statement of reasons
A written submission addressing every criterion and every refusal reason
All relationship evidence from the period since the refusal
Updated financial evidence, particularly if that was the delegate's concern
Updated household evidence, including any lease renewal or change of address
Fresh statutory declarations from witnesses who can attend the hearing
Statements from the applicant and the sponsor addressing the refusal directly
Any document the delegate said was missing, now obtained
Medical, financial or country evidence where hardship is relevant
A chronology of the relationship and of the application, with dates

Why Do Partner Visa Appeals Fail

Short answer

Most losing appeals lose before the merits are ever reached. Missing the review period is the largest single cause, and it cannot be cured. Of the appeals that are heard, the ones that fail usually repeat the original application rather than answering the reasons the Department gave for refusing it.
Visa application form and pen on a desk, common partner visa refusal grounds

Common Refusal Grounds

The review application was lodged outside the period, which cannot be extended
The deadline was counted from the date the letter was read, not the deeming date
The appeal resubmitted the original evidence without addressing the refusal reasons
No new evidence from the period since the refusal was put before the Tribunal
No written submission, leaving the Tribunal to assemble the case from documents
Inconsistencies between the written material and the oral evidence at hearing
Witnesses who could not attend, or whose evidence did not match the application
A substantive bar the Tribunal cannot cure, such as the sponsorship limit or health
A Tribunal request for information answered late or not at all

If the Tribunal Affirms the Refusal

If the Tribunal affirms the refusal, three narrower options remain. Judicial review in the Federal Circuit and Family Court, which examines legal error rather than the merits and has its own strict time limits. Ministerial intervention, which is discretionary and rarely granted. Or a fresh application where no bar prevents one.

Refusal Grounds

What Your Refusal Letter Is Actually Saying

Short answer

Partner visa refusals fall into a small number of grounds, and which one you have determines whether an appeal is worth running. Evidentiary refusals are the most common and the most fixable. Refusals on public interest criterion 4020, character or health work very differently and carry consequences beyond this application.
Professional refusing an envelope across a desk, relationship not accepted as genuine

Not Satisfied the Relationship Is Genuine and Continuing

The most common ground by a wide margin. The delegate was not persuaded on one or more of the four regulatory categories, usually the financial aspects or the social context. This is an evidentiary finding, not a conclusion that you were lying, and it is the ground most often reversed on review because the Tribunal accepts new evidence.
Appeal outlook: generally the strongest, particularly where the relationship has continued since the refusa

Public Interest Criterion 4020

A finding that a bogus document or false or misleading information was provided. This is serious. It carries a bar of three years on most further visas, or ten years where identity is involved, and the bar attaches to the person rather than the application. It can be waived only in limited circumstances involving compelling and compassionate reasons affecting an Australian.
Appeal outlook: difficult and technical. Get advice immediately rather than lodging and hoping.

Schedule 3 Criteria Not Satisfied

You lodged without holding a substantive visa and the delegate was not satisfied there were compelling reasons to waive criteria 3001, 3003 and 3004. The Tribunal reconsiders the waiver afresh and applies the Waensila principle, so circumstances arising since lodgement count. See Schedule 3 Waivers.
Appeal outlook: often worth running, because the material has usually grown since the refusal.

Sponsorship Refused or Limits Reached

Regulation 1.20KB. Applies where the sponsor has been charged or convicted of a child sex offence or similar registrable offence and any applicant is under 18 when the sponsorship is decided.
Appeal outlook: depends entirely on which limb applies. Two separate reviews may be needed.

Health or Character Not Met

The applicant or a dependent family member did not meet the health requirement, or the character test was not satisfied. Health refusals can sometimes be met with a health waiver where one is available for the subclass. Character refusals under section 501 have a different review path and different time limits.
Appeal outlook: narrow and technical, and the route differs depending on the provision used.

The De Facto Relationship Did Not Meet the 12 Months

The delegate found the couple had not been living together for 12 months before lodgement, with no registered relationship and no compelling circumstances made out. Where the relationship has since passed 12 months, or has since been registered, the position at the Tribunal can be very different from the position at refusal.
Appeal outlook: often strong, because time has usually cured the problem.

Read Past the First Paragraph

Refusal letters open with the decision and then set out the delegate's findings in detail further down. The detail is what matters. It tells you exactly which criterion was not met, which evidence was considered, and which evidence the delegate said was absent.

That detail is the specification for the appeal. Every finding needs an answer and a document. An appeal that does not engage with the delegate's actual reasoning is the most common kind that fails on the merits.
Send us the letter and we will tell you which ground you have and whether it is the fixable kind.

After the Tribunal

What Is Judicial Review and When Does It Apply

Short answer

Three realistic alternatives exist. Wait until the five years has run, where that is the only obstacle. Look at a visa pathway that does not require partner sponsorship. Or, where the applicant cannot safely return, consider whether a protection claim arises. Each has its own timing and its own consequences.

This is the distinction that catches people out. At the Tribunal you argue the merits and you can put in new evidence. At the Court you argue law, and new evidence about your relationship is generally irrelevant. A matter that was simply decided against you on the facts usually has no judicial review path.

Errors that can found an application include a failure to consider a relevant matter, a denial of procedural fairness, a misconstruction of the criteria, or a decision made without evidence capable of supporting it.

If the Court finds an error it does not grant the visa. It sends the matter back to the Tribunal to be decided again according to law. Time limits are strict and separate from the Tribunal's, so advice needs to be immediate rather than eventual.
Tribunal affirmed the refusal? Whether a legal error exists is a question worth answering quickly.

How We Help

How My Migration Lawyers Assists With a Partner Visa Refusal

Short Answer

We run the matter end to end. Assessing the refusal, lodging the ART application inside the 28 days, obtaining the Department file, building the evidence, preparing and filing written legal submissions, preparing you and your witnesses, and appearing at the hearing with you.
Lawyer standing in an office, partner visa refusal assessment and merits advice
1

 Refusal Assessment and Merits Advice

We read the full statement of reasons, identify the exact ground relied on, and tell you honestly whether the refusal is the fixable kind. If review is not the right course, we say so and set out what is.
2

 Deadline Calculation

We work out the date you are taken to have been notified and count the 28 calendar days from there. Getting this wrong by a day ends the matter, so we confirm it in writing before anything else happens.
3

ART Application Lodgement

We prepare and lodge the review application with the Tribunal within the period, deal with the application fee including any reduced fee request, and confirm lodgement in writing so you know the deadline has been met.
4

Bridging Visa Protection

Lodging within the period generally allows a further bridging visa. We make sure it is applied for, granted, and that you understand the conditions attached, so your lawful status and your work rights continue through the review.
5

Obtaining the Department File

We request the material the delegate relied on, including internal notes and the full evidence considered. You cannot answer reasoning you have not read, and the file frequently reveals concerns the refusal letter only summarised.
6

 Evidence Strategy and Collection

We map every finding in the refusal to the evidence needed to answer it, then work through the gathering with you. Material from the period since the refusal is often the strongest part of an appeal and it has to be assembled deliberately.
7

Written Legal Submissions

A submission that sets out each criterion, the evidence against it, the relevant law, and why the delegate's reasoning does not hold. The Tribunal is deciding the case again, so it needs to be told what the case is rather than left to assemble it from a folder.
8

 Responding to Tribunal Requests

Tribunal members have inquisitorial powers and can request documents, issue directions and put adverse information to you for comment. We handle each request within time and in the form the Tribunal expects.
9

Hearing Preparation

We take you and your sponsor through the questions likely to be asked, the areas of concern in your own file, and how to give evidence clearly. Inconsistency between the written material and the oral evidence is one of the most common reasons a hearing goes badly.
10

 Witness Preparation

We identify which witnesses genuinely help, confirm their availability, and prepare them for questioning. A witness who can answer questions carries far more weight than a written declaration from someone who cannot attend.
11

 Hearing Attendance and Advocacy

We attend the hearing with you, in person, by video or by phone, and we put the case to the Tribunal member. You are not sitting in that hearing alone answering questions about your own relationship.
12

 Post-Hearing Submissions

Where the member raises a matter at hearing that needs further material, or invites submissions on a particular point, we file them within the time allowed. Matters are often decided on what is filed after the hearing rather than during it
13

Carrying a Remittal Through to Grant

A remittal is not a grant. We deal with the Department afterwards, including refreshing health examinations and police certificates that have expired during the review, so the file reaches decision rather than stalling.
14

Advice on What Comes Next if the Appeal Fails

If the Tribunal affirms the refusal we advise on judicial review, ministerial intervention and fresh applications, including whether a legal error exists and whether the Court time limits still allow it. See Schedule 3 Waivers where that ground applies.

After the Grant

What Happens if the Appeal Succeeds

Short answer

In most successful partner visa appeals the Tribunal remits the matter to the Department with a direction that a particular criterion is met. That is not a grant. The Department then completes the remaining checks, including health and character, and decides the application.

Two things follow that people do not expect. Police certificates and health examinations obtained years earlier may have expired and need redoing, which takes time. And if the visa granted is the temporary stage, the permanent stage still lies ahead and will be assessed on evidence from the period after grant. Keep building the file rather than closing it.
A remittal is the beginning of the last stretch, not the finish line. We can carry it through to grant.

Questions

Partner Visa Refusal Frequently Asked Questions

Answers to the questions Indonesians applicants ask most often. See also our 30 protection visa FAQs and 30 LGBT protection visa FAQs.

How Long Do I Have to Appeal a Partner Visa Refusal

The standard deadline for every partner visa subclass is 28 calendar days. That covers the 820, 801, 309, 100 and 300, and the 461 where the refusal carries review rights. The period runs from the date you are taken to have been notified, and for most migration decisions it cannot be extended.

What Are the Chances of Winning a Partner Visa Appeal

Published Tribunal data for July 2024 to March 2025 put the partner visa set aside rate at around 55%, well above protection visas at 10%. That reflects the fact that most partner refusals are evidentiary rather than substantive, and the Tribunal accepts new evidence.

Can I Stay in Australia While the Appeal Is Running

Usually yes. If you apply for review within the period, a further bridging visa is generally available to keep you lawful while the Tribunal deals with the matter, with work rights continuing. Confirm the bridging visa is granted and check its conditions.

What if I Missed the Deadline

For most migration decisions the Tribunal cannot extend the period, and a late application is invalid rather than weak. The remaining options are a fresh application where one is available, judicial review where there is a legal error, or ministerial intervention. Get advice quickly.

Should I Appeal or Just Apply Again

It depends on the refusal reason and whether a bar applies. A fresh application can be faster where the gap is fixable, but it means a second charge of AUD $11,710 and gives up your place in the queue. Section 48 also blocks most other onshore applications after a refusal.

Can I Give the Tribunal New Evidence

Yes. The Tribunal conducts merits review and decides the case again on all the material before it, including evidence that did not exist when you applied. Evidence from the period since the refusal is often the strongest part of an appeal.

Will There Be a Hearing

In most partner visa matters, yes. Hearings are held in person, by video or by phone. You and your witnesses give evidence and answer questions from the Tribunal member. Consistency between the written material and the oral evidence matters a great deal.

How Much Does an ART Appeal Cost

A Tribunal application fee is payable on lodgement, set by regulation and reviewed annually. Published figures have recently been quoted between roughly AUD $3,500 and $3,700+ for standard migration reviews, with a partial refund where the review succeeds. A reduced fee may be available in cases of financial hardship.

Does the Tribunal Grant the Visa

No. The Tribunal can affirm, vary, set aside and substitute, or remit the matter to the Department with directions. Remittal is the most common successful outcome on partner visas, and the Department then completes the remaining checks and decides.

What Is PIC 4020 and Why Does It Matter

Public interest criterion 4020 concerns bogus documents or false or misleading information. A refusal on this ground carries a bar of three years on most further visas, or ten years where identity is involved, and it attaches to the person rather than the application. Waiver is limited and the appeal is technical.

Can My Sponsor Appeal for Me

On an offshore refusal, only the Australian sponsor can apply for review. The deadline is the same 28 calendar days. On an onshore refusal the applicant is the review applicant. If the sponsorship itself was refused, that decision has its own review right and its own deadline.

What Is the Difference Between the ART and the AAT

The Administrative Review Tribunal replaced the Administrative Appeals Tribunal on 14 October 2024 and took over its migration work. The grounds and the practical process are largely unchanged, but the names and the fees are different, so older material should be read with care.
