Employer sponsored migration changed materially on 7 December 2024, when the Skills in Demand visa replaced the Temporary Skill Shortage framework. Three streams now operate under subclass 482, a single Core Skills Occupation List replaced the old two-list system, and income thresholds re-index annually against Average Weekly Ordinary Time Earnings.

Where an occupation, a salary or a workforce model does not fit the standard settings, a labour agreement or a Designated Area Migration Agreement can create the concessions that make the hire possible.
Getting the structure right at the outset is what separates a workforce program that scales from one that stalls at every nomination.

Where to Start

Corporate Migration Services

Short answer

Six areas, and most employers need several of them at once. A single sponsorship approval is straightforward enough. A workforce program running across multiple sites, occupations and states, with the compliance obligations that attach to every one of those visas, is a different exercise entirely.

Standard Business
Sponsorship

Approval as a sponsor is the gateway to everything else. We prepare the application, structure it around how your business actually operates, and deal with the Department directly so your HR team is not chasing it.

Skills in Demand
Nominations

Subclass 482 across all three streams. Occupation and stream selection, market salary evidence, labour market testing, and nomination drafting built to survive scrutiny rather than to be lodged quickly.

Labour
Agreements

Where the standard settings do not fit your workforce. Company-specific, industry and project agreements negotiated with the Department, including the concessions on occupation, salary, English and experience that make hiring viable.

DAMAs and Regional
Workforce

Designated Area Migration Agreements give regional employers access to occupations and concessions unavailable elsewhere. We advise on which DAMA applies, secure endorsement, and run the nominations under it.

Permanent Residence
Pathways

Retaining people is the point. Employer nomination under subclass 186 and regional pathways under 494, planned from the first temporary nomination rather than dealt with three years later.

Sponsorship
Compliance

The obligations do not end at grant. Record keeping, notifiable events, equivalent terms, market rate maintenance, monitoring visits and site inspections, and responding when the Department asks questions.
Most employers need several of these at once. A first conversation establishes which, and in what order.

The Three Streams

The Three Skills in Demand Streams Compared

Short answer

Stream selection is the first commercial decision on any nomination and it drives cost, timing and eligibility. The Specialist Skills stream is dramatically faster but capped and closed to trades. The Labour Agreement stream unlocks occupations and concessions the other two cannot reach at all.

Income thresholds re-index annually against Average Weekly Ordinary Time Earnings. The figures above applied from 1 July 2026. The nominated salary must meet the threshold or the Annual Market Salary Rate, whichever is higher, so a role paying above the threshold can still be refused if it sits below the going rate for that occupation and location.
Stream selection drives cost, timing and eligibility. It is worth getting right before the first nomination.

Labour Agreements

When Does a Labour Agreement Make Sense

Short answer

When the standard settings do not fit your workforce. The occupation is not on the Core Skills Occupation List, the market rate for the role sits below the income threshold, the English or work experience requirements exclude the people you can actually recruit, or you need volume across an extended period on terms a standard nomination cannot deliver.

Core Skills threshold

$

79,499

Or the Annual Market Salary Rate, whichever is higher. Indexed annually.

Specialist threshold

$

$146,717

No occupation list, but capped at 3,000 places nationally each year.

Sponsorship approval

5

Years
The standard term for an approved Standard Business Sponsor.
Team meeting in a city office, labour agreement sponsorship Australia
A labour agreement is a formal arrangement between your business and the Commonwealth. It can vary occupation eligibility, salary requirements, English levels, work experience and permanent residence pathways in ways no standard nomination can. Company-specific agreements are negotiated for a single business. Industry agreements operate on settled terms for a sector. Project agreements support major resource and infrastructure builds.

Negotiation takes time and it is evidence driven. The Department expects a demonstrated labour market need, genuine domestic recruitment effort, and a case that the concessions sought are necessary rather than convenient. Union and stakeholder consultation is generally required. Businesses that start this six months before they need the workers get agreements. Businesses that start when the vacancy is already unfilled usually do not.

Labour agreements take months to negotiate. If you will need one next year, the conversation is now.

Compliance

What Are Your Obligations After the Visa Is Granted

Short answer

Sponsorship obligations continue for the life of the sponsorship and in some cases beyond it. They are actively monitored by the Department, breaches attract sanctions including barring and civil penalties, and the most common failures we see are administrative and preventable rather than deliberate.
Man at a travel agency desk, sponsor record keeping obligations

Record Keeping

Records must be kept in a prescribed form for prescribed periods, and produced on request. This is where most monitoring visits find problems.

Notifiable Events

Changes to the business, the position or the worker must be notified within set periods. Missing a notification is a breach in itself.

Equivalent Terms and Market Rate

Sponsored workers must not be treated less favourably than equivalent Australian workers, and salary must remain at market rate over time, not just at nomination.

Working in the Nominated Role

The worker must perform the occupation they were nominated for. Quiet role drift after grant is one of the most common breaches we see.
An obligations audit before a monitoring visit costs a fraction of what a sanction does.

The Process

How Employer Sponsored Migration Works

Short answer

Three separate applications, often lodged in sequence and sometimes concurrently. Sponsorship approves the business. Nomination approves the position. The visa application approves the person. Each is decided on its own criteria by a different assessment, and any one of the three can fail on its own without affecting the others.

01

Workforce Assessment

Which roles, how many, where, and over what period. This determines whether standard nominations will carry your program or whether an agreement is needed.

02

Standard Business Sponsorship

Approval as a sponsor, generally for five years. Accredited status is available to eligible businesses and materially improves processing. Employers who are already approved sponsors move considerably faster on every nomination that follows.

03

Stream and Occupation Selection

Core Skills, Specialist Skills or Labour Agreement. This drives the income threshold, the occupation list, the visa period and the processing time.

04

Labour Market Testing

Where required, advertising must meet prescribed content, duration and platform requirements, and it has a limited validity period. Getting this wrong invalidates the nomination.

05

Market Salary Evidence

The nominated salary must meet the threshold or the Annual Market Salary Rate, whichever is higher. This is evidenced, not asserted.

06

Nomination Lodgement

The position, the salary, the testing and the genuine need, prepared to survive scrutiny rather than to be lodged quickly.

07

Visa Application

Lodged by the worker, with skills, English, health and character requirements depending on the stream. Family members apply concurrently or as subsequent entrants.

08

Compliance From Grant Onwards

Record keeping, notifiable events, equivalent terms, market rate maintenance, and readiness for a monitoring visit.

This is the stage employers underestimate, and it is the stage where sanctions arise.

08

Permanent Residence Planning

Retention is the commercial point. The permanent pathway should be planned at the first temporary nomination, not three years later.

Three applications, three sets of criteria. We run all three so your HR team runs none of them.

What Goes Wrong

Why Do Nominations and Sponsorships Fail

Short answer

Three separate applications, often lodged in sequence and sometimes concurrently. Sponsorship approves the business. Nomination approves the position. The visa application approves the person. Each is decided on its own criteria and any one of the three can fail on its own, which is why they are managed as one program rather than three errands.

Labour Market Testing That Does Not Comply

Wrong platform, wrong duration, wrong content, or advertising that has expired by the time the nomination is lodged.

Salary Below the Market Rate

Meeting the income threshold is not enough. A role paying above the threshold can still be refused if it sits below the going rate.

Occupation Not on the CSOL

Or an occupation chosen because it fits the list rather than because it describes the actual job.

The Position Not Genuine

A role created around a person, or a title that does not match the duties, will not survive scrutiny.

Nominating Under the Wrong Stream

Choosing Core Skills where Specialist Skills was available costs months of processing for no reason.

Sponsorship Lapsing Mid-Program

Approval runs five years. Businesses that do not diarise renewal find nominations blocked at the worst moment.

Record Keeping Found Wanting

The most common finding on a monitoring visit, and it is entirely preventable with an obligations audit.

Role Drift
After Grant

The worker is doing something other than the nominated occupation. Quiet, common, and a breach.
Every one of these is preventable, and every one of them is cheaper to prevent than to fix.

How We Help

How Our Corporate Migration Team Works With You

Short Answer
‍
We act for the business rather than the worker. That means we run the applications end to end, hold the compliance framework, deal with the Department directly, and give your HR team a single point of contact and a status report rather than a process to manage themselves.
1

Workforce Migration Strategy

Before any application, we map the roles, volumes, locations and timeframes against the pathways actually available. That analysis determines whether standard nominations will carry your program or whether an agreement is needed.
2

Standard Business Sponsorship and Renewals

Preparing the application, structuring it around how the business actually operates, and diarising renewal so approval never lapses in the middle of a hiring program.
3

Accredited Sponsor Applications

Accredited status materially improves processing for eligible businesses. We assess whether you qualify and prepare the application.
4

Stream Selection on Every Nomination

Core Skills, Specialist Skills or Labour Agreement. The choice drives cost, timing and eligibility, and the fastest stream is frequently overlooked because it is capped.
5

Labour Market Testing Compliance

Advertising content, platforms, duration and validity, checked before the nomination is drafted rather than after the Department queries it.
6

Market Salary Rate Evidence

Building the evidence that the nominated salary meets the Annual Market Salary Rate, which is where a great many otherwise sound nominations fail.
7

Nomination Drafting

Position descriptions, organisational structure, genuine need and business capacity, prepared as a case rather than a form.
8

Labour Agreement Negotiation

Company-specific, industry and project agreements negotiated with the Department, including the concessions on occupation, salary, English and experience your workforce actually needs.
9

DAMA Endorsement and Nominations

Identifying which Designated Area Migration Agreement applies, securing endorsement from the designated area representative, and running the nominations under it.
10

High Volume Nomination Management

Where you are running many nominations at once, we manage them as a program with consistent templates, tracked deadlines and reporting, rather than as separate one-off matters.
11

Sponsorship Obligation Audits

A structured review of record keeping, notifications, equivalent terms and market rate maintenance, before a monitoring visit rather than after one.
12

Monitoring Visits and Site Inspections

Preparing the business, attending where appropriate, and responding to requests for information within the periods the Department sets.
13

Sanctions and Bar Responses

Where the Department alleges a breach, responding on the facts and on the discretion, and dealing with barring and civil penalty exposure.
14

Permanent Residence Programs

Subclass 186 Direct Entry and Temporary Residence Transition, and regional pathways under subclass 494, planned as a retention program rather than handled case by case.
15

Nomination and Sponsorship Refusals

Where a nomination or a sponsorship application is refused, assessing the merits and lodging review within the period, which cannot be extended.
16

Reporting and a Single Point of Contact

Your HR team gets one lawyer, one status report and one place to ask questions, rather than a different contact for every file.

Questions

Corporate Migration Frequently Asked Questions

Answers to the questions Indonesians applicants ask most often. See also our 30 protection visa FAQs and 30 LGBT protection visa FAQs.

Do You Act for Individual Applicants

No. Our corporate migration team acts for Australian businesses only. We do not take work visa enquiries from candidates, and we do not act for individuals seeking employer sponsorship.

What Is the Skills in Demand Visa

Subclass 482, which replaced the Temporary Skill Shortage visa on 7 December 2024. It operates through three streams: Core Skills, Specialist Skills and Labour Agreement, with a single Core Skills Occupation List replacing the previous two-list system.

What Are the Current Income Thresholds

From 1 July 2026, the Core Skills Income Threshold is $79,499 and the Specialist Skills Income Threshold is $146,717. Both index annually against Average Weekly Ordinary Time Earnings. The salary must meet the threshold or the Annual Market Salary Rate, whichever is higher.

How Long Does Sponsorship Take

It depends on the stream and on whether the business is already an approved sponsor. Specialist Skills nominations are reported in days to weeks. Core Skills programs from first sponsorship to visa grant commonly run to several months. Being an approved sponsor already removes a large part of that.

What Is a Labour Agreement

A formal arrangement between a business and the Commonwealth that varies the standard settings. It can change occupation eligibility, salary requirements, English levels, work experience and permanent residence terms in ways no standard nomination can.

What Is a DAMA

A Designated Area Migration Agreement. A regional arrangement giving employers in a designated area access to occupations and concessions unavailable under standard nominations. Endorsement from the designated area representative is required before nominations can be made.

Do We Have to Advertise the Role First

Labour market testing is required in most cases, and it has prescribed content, platform and duration requirements plus a limited validity period. Non-compliant or expired advertising is one of the most common reasons a nomination is refused.

What Are Our Obligations After the Visa Is Granted

Record keeping in a prescribed form, notifying prescribed events within set periods, ensuring equivalent terms of employment, maintaining market salary rate over time, and cooperating with monitoring. Breaches attract sanctions including barring and civil penalties.

What Happens in a Monitoring Visit

The Department checks compliance with sponsorship obligations, which may include a site inspection and requests for records. Record keeping is the most common area where problems are found, and it is the most preventable.

Can Sponsored Workers Get Permanent Residence

Yes. Employer nomination under subclass 186 through the Direct Entry or Temporary Residence Transition streams, and regional pathways under subclass 494. The permanent pathway should be planned at the first temporary nomination rather than three years later.

What if a Nomination Is Refused

Nomination and sponsorship refusals generally carry review rights to the Administrative Review Tribunal, on deadlines that cannot be extended. We assess the merits and lodge within the period. See Visa Refusals.

Can You Manage High Volume Programs

Yes. Where a business is running many nominations at once, we manage them as a program with consistent templates, tracked deadlines, reporting and a single point of contact, rather than as separate one-off matters.
