Partner Visa Subclass 801

The Subclass 801 is the permanent partner visa for couples who applied in Australia. It is applied for at the same time as the Subclass 820, and is usually assessed at least 2 years after the combined application was lodged. The applicant must hold the Subclass 820 and still be in a genuine and continuing relationship with the sponsor. My Migration Lawyers prepares Subclass 801 second stage evidence and acts when the second stage becomes complicated.

Eligibility

When are you eligible for the Subclass 801 visa?

Under clause 801.221 of the Migration Regulations 1994, the standard Subclass 801 criteria are that:

the applicant holds a Subclass 820 visa
the applicant is still sponsored by the same Australian partner
the relationship is still genuine and continuing
at least 2 years have passed since the combined Subclass 820 and Subclass 801 application was made

There is no second application and no second application charge in the standard case. The Department reopens the Subclass 801 stage and asks for updated information. Second stage evidence

What evidence does the Subclass 801 second stage need?

The Subclass 801 stage needs evidence that the relationship has continued since the Subclass 820 was granted, across finances, the household, social life and commitment. It usually also needs updated Form 888 statements, police certificates and any change in circumstances, such as a new address or a child.
Evidence from the last 2 years carries more weight than evidence already lodged. See What Documents Do I Need for the 801 Second Stage? and Partner Visa Second Stage Documents.

If the relationship ends

What happens to the Subclass 801 if the relationship ends?

If the relationship ends before the Subclass 801 is decided, the standard criteria cannot be met. The Department must be told. The Subclass 801 can still be granted in these situations.

Refusal

What happens if the Subclass 801 is refused?

A Subclass 801 refusal can be reviewed by the Administrative Review Tribunal, and the applicant must be in Australia to apply for review. A refusal also affects the Subclass 820, so your right to stay in Australia must be checked straight away.
