Spouse and Marriage Visa Lawyers

There is no separate spouse visa in Australia. A married couple applies for a partner visa as spouses: the Subclass 820 and Subclass 801 in Australia, or the Subclass 309 and Subclass 100 from outside Australia. The marriage must be valid under Australian law, and the relationship must be genuine and continuing. My Migration Lawyers prepares spouse partner visa applications and acts on spouse visa refusals.

Which spouse visa

Which spouse visa do you apply for in Australia?

The spouse visa you apply for depends on where you are when you lodge. Both routes are a two-stage partner visa, applied for in one application.

A valid marriage

What makes a marriage valid for a spouse visa?

A spouse visa needs a marriage that is valid under the Marriage Act 1961. A marriage in Australia must follow Australian rules. An overseas marriage is generally recognised if it was valid where it took place. A marriage is not recognised for a spouse visa where:

either partner was still married to someone else
the partners are too closely related
either partner did not freely consent
either partner was not of marriageable age

Spouse or de facto

Is a spouse visa different from a de facto partner visa?

The visa is the same. What differs is how the relationship is proved.

Spouses

The marriage certificate proves the legal relationship. There is no 12-month living together requirement, but the relationship must still be shown to be genuine and continuing.

De facto partners

There is no certificate, so the relationship itself must be proved, usually including 12 months as a de facto couple before applying.

Evidence

Is a marriage certificate enough for a spouse visa?

No. A marriage certificate shows that you are legally married. It does not show that the relationship is genuine and continuing. A spouse visa still needs evidence across the four areas: finances, the household, social life and commitment, together with Form 888 statements from people who know you as a couple.
