Complex Partner Visa Lawyers

A complex partner visa is one where something beyond the relationship itself stands in the way, such as an expired visa, condition 8503, a previous refusal, a sponsor's earlier sponsorship, a health condition or a character issue. My Migration Lawyers acts in many complex partner visa matters. We identify the obstacle, work out the legal path around it, and build the application and evidence to meet it.

What makes a partner visa complex?

A partner visa becomes complex when a rule outside the relationship test applies to the applicant or the sponsor. The most common complications are:

the applicant's visa has expired, or they hold only a bridging visa
the applicant's visa carries condition 8503 No Further Stay
a previous visa was refused or cancelled in Australia
the sponsor has sponsored a partner before, or was sponsored themselves
the applicant, a family member or the sponsor has a health or character issue
incorrect information was given in an earlier application
the relationship is short, or the couple lives apart

The rules behind it

Which rules make a partner visa complex?

Each complication in a complex partner visa comes from a specific rule, and each rule has its own test and its own way through.
Complication
The rule
Is there a way through?

Condition 8503 No Further Stay
Section 41 and regulation 2.05(4)
Yes, if the condition is waived, or by applying outside Australia
Previous refusal or cancellation
Section 48
Yes, the onshore partner visa classes can still be applied for
Sponsor sponsored a partner before
Regulation 1.20J

Public interest criterion 4007

Visa status

Can you get a partner visa without a current visa?

Yes, in many cases. An applicant in Australia without a substantive visa can still lodge a Subclass 820 partner visa, but the Schedule 3 criteria apply. Those criteria can be set aside where there are compelling reasons, and those reasons can include circumstances that arise right up to the time of decision.

Relationship and sponsor history

What history problems complicate a partner visa?

A complex partner visa often turns on what happened before the current application.

01

A previous partner visa refusal

The reasons for the earlier refusal must be answered in the new application. See What Extra Lodgement Requirements Apply After a Previous Refusal?

02

A sponsor with an earlier sponsorship

The sponsorship limits must be checked and, where they apply, a waiver argued. See Partner Visa Sponsorship Limitations.

03

Family violence in the relationship

Family violence provisions can allow an onshore partner visa to continue after the relationship ends. See Family Violence Partner Visa Lawyers.

04

A short relationship or time apart

The 12-month rule and the evidence of the relationship need careful handling. See De Facto Partner Visa: The 12-Month Rule and Exceptions.

Prospects

Can a complex partner visa still be granted?

Often yes. A complication changes what the application has to prove, not whether a genuine relationship counts. The applications that struggle are usually those lodged without the complication being addressed at all.
The key is to deal with the complication first, in writing and with evidence, before or at the time of lodgement. See Can a Complex Partner Visa Still Be Granted? and Complex Partner Visa Lawyer: What the Work Involves.

Can I get a partner visa with condition 8503?

Only after a waiver if you apply in Australia, or by applying outside Australia. See What Is Condition 8503 and Can I Get a Partner Visa?

Can I get a partner visa after a refusal?

Yes, in many cases, by review or by a new application. See Partner Visa Refusals.

Should I lodge a complex partner visa myself?

A complex partner visa lodged without the complication addressed is at high risk of refusal. Get advice before lodging.
