Key Takeaways
- Australians can sponsor partner from Andorra through the onshore Subclass 820 and 801 pathway, the offshore Subclass 309 and 100 pathway, or the Subclass 300 Prospective Marriage visa, and the right choice depends on where the partner is when the application is lodged.
- A partner "from Andorra" may be an Andorran citizen or a resident of Andorra who holds another nationality. The passport decides visitor visa options, but every country where the partner has lived for 12 months or more in the last 10 years since turning 16 decides which police certificates are needed.
- Couples who move between Andorra, Spain, France and Australia should expect to provide police certificates from more than one country, and documents in Catalan, Spanish or French must be translated into English.
- The Australian sponsor must meet regulation 1.20J and the sponsor character rules in regulations 1.20KC and 1.20KD, and a sponsor who lived in Andorra or a neighbouring country for 12 months or more can be asked for a police check from that country.
- Long-distance periods, seasonal work and separate finances in euros and Australian dollars are common in these relationships; they do not prevent a grant, but they must be explained with evidence across the four aspects in regulation 1.15A.
Australians can sponsor partner from Andorra for an Australian partner visa if the sponsor is eligible and the couple can prove a genuine and continuing relationship. To sponsor partner from Andorra, most couples first decide where the partner will be when the application is lodged, because that decides whether the onshore or offshore pathway applies.
Andorra is a small country, and there are few Australian partner visa cases involving it. That does not make the process simpler. In practice, a sponsor partner from Andorra matter often involves more than one country: a partner who grew up in Andorra but studied in Spain or France, a resident of Andorra who holds a Spanish, French or Portuguese passport, or an Australian sponsor who worked in Andorra for a season or longer. This guide explains how the Australian sponsor deals with each of those situations, from sponsorship eligibility to documents, police certificates, evidence across distance, and review. The firm's partner visa lawyers act for sponsors on these matters, and the guide to partner visas explains every subclass.
Can you sponsor partner from Andorra to Australia?
Yes. An Australian citizen, Australian permanent resident or eligible New Zealand citizen can sponsor partner from Andorra if the sponsor is at least 18, is the partner's spouse, de facto partner or fiancé, and is not prevented by a sponsorship limitation.
The partner's nationality does not change the legal test. The same Migration Regulations 1994 apply to every sponsor partner from Andorra application as to any other partner visa. What changes is the practical work: which documents exist, which languages they are in, which police certificates are needed, and how the couple has managed a relationship across Europe and Australia.
The firm's guides to partner visa sponsor eligibility and who can sponsor a partner visa explain the basic rules. Sponsors in particular situations should also read the guides for an Australian citizen sponsor, a citizen by descent sponsor, a permanent resident sponsor and a New Zealand citizen sponsor. An Australian citizen by descent who has lived most of their life in Europe is a common sponsor profile in a sponsor partner from Andorra matter, and needs to plan for the requirement to live in Australia.
Is your partner an Andorran citizen or a resident of Andorra?
It matters, because the partner's passport and the partner's places of residence affect different parts of the application. A partner who is an Andorran citizen applies on an Andorran passport. A resident of Andorra who holds another nationality applies on that other passport, but still needs police certificates from Andorra if they lived there for 12 months or more in the relevant period.
Many people describe their partner as being "from Andorra" when the partner lives there but holds a passport from another country. For a sponsor partner from Andorra application, the Department needs a complete picture of the partner's identity and history:
- Identity. The passport, national identity card and birth certificate of the country of citizenship.
- Residence history. Every country where the partner has lived, including Andorra, with dates.
- Police certificates. One from each country where the partner has lived for 12 months or more in the last 10 years since turning 16, whatever the partner's citizenship.
- Previous names. Any name changes, including on marriage, shown in the documents.
The answer on different names and dates on documents explains how inconsistencies are handled. Getting this picture right at the start avoids the most common delay in a sponsor partner from Andorra case: a request for a police certificate from a country that was not disclosed or not planned for.
Which partner visa fits when you sponsor partner from Andorra?
The visa depends on where the partner is at the time of application and on the couple's relationship status. The table below summarises the options for a sponsor partner from Andorra application.
SituationUsual visaKey pointPartner outside Australia, married or de factoSubclass 309 then Subclass 100Partner must be outside Australia at lodgement and at grant of the Subclass 309Partner in Australia on a substantive visaSubclass 820 then Subclass 801Condition 8503 or Schedule 3 can affect eligibilityCouple engaged and intending to marrySubclass 300Partner travels to Australia, marries, then applies for the Subclass 820
The offshore Subclass 309 partner visa suits a partner who is living in Andorra or elsewhere in Europe. The onshore Subclass 820 partner visa suits a partner who is already in Australia and holds a visa that allows an onshore application. The Subclass 300 Prospective Marriage visa suits a couple who plan to marry in Australia.
The guide comparing onshore and offshore partner visas explains the trade-offs, and the answer on which partner visa to apply for gives a short summary. A couple who are unsure should decide before the partner travels, because travel can change which pathway is available.
Married, de facto or engaged?
A married couple applies as spouses. A couple who are not married usually need to show they have been in a de facto relationship for at least 12 months before the application, unless an exception applies, such as registration of the relationship in an Australian state or territory. An engaged couple can use the Subclass 300. The guide on the de facto partner visa, the answer on the 12-month de facto rule and the answer on registering a relationship while the partner is overseas explain these options.
A marriage celebrated in Andorra or in another country is generally recognised in Australia if it was valid where it took place and does not fall within an exception in the Marriage Act 1961. The guide on whether an overseas marriage is recognised in Australia explains the rule, and the answer on an overseas registered relationship explains how a registered partnership from another country is treated.
Which sponsor limits apply when you sponsor partner from Andorra?
The same sponsor limits apply as in any partner visa. To sponsor partner from Andorra, the sponsor must not be blocked by regulation 1.20J, regulation 1.20KA, regulation 1.20KB or regulations 1.20KC and 1.20KD, and the sponsorship must be approved at the time the visa is decided.
Regulation 1.20J limits a sponsor to two partner sponsorships in a lifetime. It also prevents a sponsor from sponsoring within five years of a previous partner sponsorship, or within five years of the sponsor's own grant of a partner visa, unless there are compelling circumstances. Sponsors who came to Australia themselves as a partner, and then separated, are often caught by this rule. The commercial page on partner visa sponsorship limitations and the guide on partner visa sponsorship limitations explain it. The answer on sponsoring more than one partner covers the lifetime limit.
Regulations 1.20KC and 1.20KD deal with the sponsor's character. They have applied to Subclass 300, 309 and 820 applications since 18 November 2016. A sponsor convicted of a relevant offence, especially an offence involving violence, may not be approved unless the discretion is exercised. The guide on partner visa sponsor relevant offences and the guide on a partner visa sponsor significant criminal record explain these rules.
Sponsorship approval is decided at the time of decision, and the Department's policy guidance on sponsorship assessment is VM-5930. A sponsor partner from Andorra application can therefore fail late in processing if the sponsor's situation changes. The guides on partner visa sponsorship approval and the partner visa sponsor risk assessment explain what to watch for.
Can you sponsor partner from Andorra while you live in Andorra?
Yes, but the sponsor must intend to live in Australia. An Australian citizen sponsor who lives overseas can still sponsor partner from Andorra, provided the couple can show they plan to make their home in Australia. A permanent resident sponsor who lives outside Australia faces more practical problems, including the travel facility on the sponsor's own visa.
Many sponsors in a sponsor partner from Andorra matter are Australians who moved to Europe for work or to be with their partner. When the couple decides to move to Australia, the Department looks for evidence of that intention. Useful evidence includes job applications or offers in Australia, a lease or arrangements to stay with family, the shipping of belongings, school enrolment for children, and the sponsor's own return plans. The guide on a partner visa sponsor living overseas and the guide on a partner visa sponsor returning to Australia explain how this is assessed.
A permanent resident sponsor should check that their own visa still allows return to Australia. A permanent resident whose travel facility has expired may need a Resident Return visa before returning. The guide on a sponsor with an expired travel facility and the guide on a partner visa sponsor Resident Return visa explain the issue. The answer on an Australian living overseas who sponsors a partner gives a short summary.
A sponsor living in Andorra must also keep watching the email address given in the sponsorship. Department requests, including sponsor police check requests, are sent to the sponsor directly. A missed email can lead to a sponsor partner from Andorra application being refused for a reason that had nothing to do with the relationship.
Does the sponsor need a police check from Andorra?
Yes, if the sponsor has lived in Andorra for 12 months or more in total since turning 16 in the period the Department examines. The Department can ask the sponsor for an Australian national police check and a police check from each country where the sponsor lived for 12 months or more.
This rule catches many sponsors who sponsor partner from Andorra. Australians sometimes meet their Andorran partner while working in Andorra's tourism or hospitality sector, while living there with the partner, or while living in nearby Spain or France. Seasons add up. Several winters in Andorra, each of a few months, can reach the 12-month cumulative threshold.
The request is sent to the sponsor, not to the applicant. Department policy treats 28 days as a reasonable time to respond with the checks or with evidence that they have been requested. A sponsor who does not respond risks refusal of the sponsorship, even with a clean record. The guide on the partner visa sponsor police check explains the request, and the guide on a partner visa sponsor police check not provided explains the consequences of silence.
Where a sponsor genuinely cannot obtain a foreign police check, Department policy allows the sponsor to explain the efforts made in a statutory declaration and state any convictions. That is the one place in this process where a statutory declaration, rather than a Form 888, is used. The answer on what to do when a police certificate cannot be obtained explains the approach.
Which police certificates does an Andorran partner need?
The partner needs a police certificate from each country where they have lived for 12 months or more in the last 10 years since turning 16. For a partner who has lived only in Andorra, that is an Andorran criminal record certificate. For a partner who has also lived in Spain, France, Portugal or elsewhere, it includes a certificate from each of those countries.
This is the part of a sponsor partner from Andorra application that most often causes delay. A partner who studied for three years at a university in Spain, then worked for two years in France, then returned to Andorra will usually need three certificates. Each country has its own process, its own processing time and its own language. Planning early is essential in every sponsor partner from Andorra application.
The Andorran certificate should be requested from the competent Andorran authority. The Department's country page on police certificates sets out the current process for each country, and the couple should check it before applying, because requirements change. The guide on partner visa overseas police certificates explains how foreign certificates are obtained and presented.
Police certificates are assessed against the applicant's character under section 501 of the Migration Act 1958 and the public interest criteria. The guide on partner visa character requirements explains the test. Certificates have a limited validity period for Department purposes, so the timing of requests matters. The answer on police certificate and health check validity explains when certificates may need to be renewed.
How are Andorran documents prepared for an Australian partner visa?
Andorran documents should be clear, complete colour scans of the originals, with an accurate English translation for any document in Catalan, Spanish, French or another language. The Department does not usually require certified copies for documents uploaded online, but it can ask to see originals if it has concerns.
The usual identity and civil documents in a sponsor partner from Andorra application are the partner's passport, national identity document, full birth certificate, marriage certificate if married, and evidence of the end of any previous marriage. The partner visa document checklist gives the general list, and the answer on certified copies for a partner visa explains when certification matters.
Translations
When you sponsor partner from Andorra, expect most Andorran official documents to be in Catalan. Documents from Spain or France will be in Spanish or French. Each must have an accurate English translation that is complete, including stamps and marginal notes. The guide on partner visa evidence translation explains the standard, and the answer on translating a marriage certificate deals with the most common document.
Messages between the couple in Catalan, Spanish or French only need translation if they are relied on as evidence. Couples should select representative messages rather than upload everything. The answer on translating messages for a partner visa explains how to choose.
Apostilles and legalisation
Andorra is a party to the Hague Apostille Convention, and Andorran government guidance requires foreign official documents to be apostilled or legalised for Andorran processes. That rule is for use of documents in Andorra. For an Australian partner visa uploaded online, the Department does not routinely require an apostille. An apostille may still be useful for other steps, for example registering an Australian marriage with Andorran authorities. The guide on the partner visa marriage certificate explains what the Department looks for in a marriage document.
How do you prove the relationship when you sponsor partner from Andorra?
You prove it with evidence across the four aspects in regulation 1.15A: financial aspects, the nature of the household, social aspects, and the nature of the commitment. When you sponsor partner from Andorra, the evidence needs to explain a relationship that has often been conducted across two continents and several time zones.
The firm's guide to the four pillars of a partner visa explains each aspect, and the guide on how much evidence a partner visa needs explains why quality matters more than volume. Three practical issues come up repeatedly in a sponsor partner from Andorra case.
Time apart and travel
Couples often spend months apart while one partner works in Australia and the other in Andorra or elsewhere in Europe. Time apart does not end a relationship, and it is common when couples sponsor partner from Andorra. The question is whether the couple maintained their commitment during that time. Flight bookings, boarding passes, passport stamps where available, and a clear timeline help. The guide on a long distance relationship partner visa, the guide on partner visa temporary separation and the guide on partner visa travel evidence explain how to present it. The answer on time apart and the 12-month de facto period is important for de facto couples.
Finances in two currencies
Many couples keep separate finances in euros and Australian dollars. That is not fatal. Evidence of shared costs, money transfers, contributions to travel and plans for shared finances in Australia can show financial interdependence. The guide on a partner visa with separate finances, the guide on a partner visa without a joint bank account and the answer on money transfers as relationship evidence explain what helps.
Living together in Andorra, Europe or Australia
Where the couple has lived together in Andorra or another European country, a lease, utility bills, a residence registration or correspondence to the shared address are strong household evidence. Where they have not lived together, the evidence focuses on time spent together and plans. The guide on partner visa household evidence and the answer on what counts as living together explain the approach.
The relationship statement and Form 888 statements
The couple gives one relationship statement, which is their own account of how they met, how the relationship developed, how they managed time apart, and their plans. My Migration Lawyers reviews the statement for completeness and consistency with the documents, and the clients check and correct every detail. Supporting statements from friends and family who are Australian citizens or permanent residents are given on Form 888. The guide on the partner visa relationship statement and the guide on Form 888 witness statements explain both. The answer on statements from overseas friends explains how friends in Andorra or elsewhere in Europe can support the application.
What evidence gaps weaken a sponsor partner from Andorra application?
The most common evidence gaps are an unexplained period apart, no evidence of time spent together in person, no evidence that families and friends know about the relationship, and a missing police certificate from a country the partner lived in. Each gap can be closed if it is identified before lodgement.
A sponsor partner from Andorra application is often built from evidence held in several places: Australian bank records, European bank records, airline accounts, messaging apps and photographs on two continents. Gaps usually appear because the evidence was never collected, not because it does not exist. The guide on weak partner visa evidence and the answer on explaining gaps in relationship evidence explain how to deal with them.
Specific gaps seen in sponsor partner from Andorra cases include:
- No timeline. The couple has travelled back and forth many times, but no single document shows when they were together and when they were apart. A short, dated timeline solves this. The guide on a partner visa relationship timeline explains how to prepare one.
- Little social evidence in Australia. The partner has spent little time in Australia, so few Australian friends know the couple well. Statements from people who do know them, and evidence of introductions to family in both countries, help. The guide on partner visa social evidence explains the options.
- Photos without context. Hundreds of photographs with no dates or places. A smaller selection with captions is more useful. The guide on partner visa photo evidence explains how to choose.
- Undisclosed countries. A partner who studied in Spain or France for more than a year, but did not list it in the application. The Department may find the gap later and ask for the certificate, which delays the sponsor partner from Andorra decision.
- Statements that do not match. The relationship statement and the Form 888 statements give different dates for key events. The answer on differences between relationship statements explains why consistency matters.
Closing these gaps before lodgement is far easier than responding to a section 56 request or a section 57 letter later.

Can an Andorran partner wait in Australia while the application is processed?
It depends on the pathway. An Andorran partner who applies onshore for the Subclass 820 usually receives a bridging visa and can stay in Australia while the application is processed. A partner who applies offshore for the Subclass 309 can visit Australia on a visitor visa, but must be outside Australia when the Subclass 309 is granted.
For a sponsor partner from Andorra application, the choice of pathway often turns on this point. The guide on a visitor visa during partner visa processing and the answer on visiting Australia while a Subclass 309 is processed explain the offshore option. The guide on a partner visa while on a tourist visa and the guide on moving from a tourist visa to a partner visa explain the onshore option.
Three risks matter:
- Condition 8503. A visitor visa with condition 8503 (No Further Stay) prevents most onshore applications while the partner is in Australia, unless the condition is waived. The answer on condition 8503 and partner visas explains this.
- Schedule 3. If the partner's visa expires before an onshore application is lodged, Schedule 3 criteria apply. The guide on Schedule 3 criteria for a partner visa explains these.
- Bridging visa travel. An onshore applicant on a bridging visa needs permission to travel and return. The guide on the partner visa bridging visa and the guide on a Bridging B visa for partner visa applicants explain how to travel back to Europe during processing.
A visitor visa application is assessed on its own criteria, including whether the person intends a genuine visit. The partner's eligible visitor visa type depends on the passport held. The answer on a partner visa on a tourist visa gives further detail.
What does it cost to sponsor partner from Andorra?
At the time of writing, the Partner visa application charge for the main applicant is AUD 11,710. The charge covers both the temporary and permanent stages. Translations, police certificates from each country, health examinations and travel are separate costs.
The guide on partner visa cost explains the charge and the answer on who pays the partner visa fee explains that either partner can pay it. Because a sponsor partner from Andorra application often needs certificates and translations from several countries, these separate costs can be higher than couples expect. The charge is generally not refunded on refusal, so a partner visa application review before lodgement is worthwhile.
What happens after the sponsor partner from Andorra application is lodged?
After lodgement, the Department may ask for health examinations, biometrics, further documents, and sponsor police checks. The temporary visa is decided first, and the permanent stage is usually assessed about two years after the application was lodged.
The two-stage partner visa process explains how the stages connect, and the comparison of Subclass 820 and Subclass 801 and the answer on Subclass 309 and Subclass 100 explain each pathway. In a sponsor partner from Andorra case, the common post-lodgement steps are:
- Health examinations. The partner attends a panel physician when asked. The guide on partner visa health requirements explains the standard.
- Requests for information. A section 56 request may ask for a missing police certificate or translation. The guide on a section 56 request explains the response.
- Sponsor requests. The sponsor may be asked for police checks, including from Andorra if the sponsor lived there.
- Natural justice. A section 57 letter invites comment on adverse information. The guide on the section 57 natural justice letter explains the response.
- Changes of circumstances. A move between Andorra, Europe and Australia, a new address or a new passport must be notified. The guide on a partner visa change of circumstances and the guide on a partner visa change of passport explain how.
Can a refused sponsor partner from Andorra application be reviewed?
Yes. A refusal of a Subclass 309 or Subclass 820 visa can generally be reviewed by the Administrative Review Tribunal. The review application must be made within 28 days after the decision is notified. For a Subclass 820 refusal, the applicant applies. For a Subclass 309 refusal, the visa applicant applies in their own name.
The rule for Subclass 309 applicants comes from section 338(9) of the Migration Act 1958, read with regulations 4.02(4)(saa) and 4.02(5)(raa), inserted in 2023. The answer on who applies for review of an offshore refusal explains this. The Tribunal fee for a partner visa review is AUD 3,727 at the time of writing. The guide on partner visa ART fees, the guide on the partner visa ART hearing and the answer on the review deadline for a partner visa refusal explain the process.
On review, the Tribunal considers the case afresh and can consider new evidence, such as a missing police certificate from a third country or better evidence of time spent together. The firm's partner visa refusals page explains its review work. Where the deadline is close, the urgent partner visa lodgement page explains how to make contact quickly.
What is a practical plan to sponsor partner from Andorra?
A practical plan starts with the sponsor's eligibility and the partner's residence history, then builds the documents, police certificates and relationship evidence before anything is lodged. A sponsor partner from Andorra application that is planned in this order is less likely to stall on a missing document.
A typical sequence is:
- Check the sponsor. Confirm citizenship or residence status, previous sponsorships under regulation 1.20J, and any criminal history.
- Map every country. List every country where each partner has lived for 12 months or more, with dates, including seasonal work.
- Choose the pathway. Decide on the Subclass 309, Subclass 820 or Subclass 300 based on where the partner will be.
- Order police certificates. Request certificates from Andorra and every other relevant country early, and track their validity.
- Collect civil documents. Obtain full birth certificates, marriage certificates and divorce records, and arrange English translations.
- Build the evidence. Assemble evidence across the four aspects, with a timeline that explains time apart.
- Prepare statements. Prepare the relationship statement and Form 888 statements, checked by the clients for accuracy.
- Lodge and monitor. Lodge the application and sponsorship, and respond to every request within time.
The answer on what happens after lodging a partner visa and the guide on partner visa application mistakes explain what can go wrong after lodgement.

Frequently Asked Questions
Can I sponsor partner from Andorra if they live in Spain or France?
Yes. A partner who is an Andorran citizen, or who has lived in Andorra, can be sponsored wherever they are living when the application is lodged. If the partner is outside Australia, the offshore Subclass 309 is usually used, and it can be lodged while the partner lives in Spain, France or any other country. The partner will need police certificates from each country where they have lived for 12 months or more in the last 10 years since turning 16, including Andorra and the country of current residence.
My partner lives in Andorra but has a Spanish passport. Does that change anything?
It changes some practical steps but not the legal test. The partner applies on the passport they hold, so a Spanish passport holder applies as a Spanish citizen and uses Spanish identity and civil documents. The partner still needs an Andorran police certificate if they lived in Andorra for 12 months or more in the last 10 years since turning 16. Visitor visa options also depend on the passport held. The relationship and sponsor requirements are the same whatever the partner's nationality.
Do I need a police check from Andorra as the Australian sponsor?
You may. The Department can ask a sponsor for an Australian national police check and a police check from each country where the sponsor lived for 12 months or more in total since turning 16 in the relevant period. Several winter seasons working in Andorra can add up to 12 months. The request is sent to the sponsor directly. Department policy treats 28 days as a reasonable time to respond with the checks or with evidence that they have been requested, and silence can lead to refusal of the sponsorship.
Do Catalan documents need to be translated for a partner visa?
Yes. Every document not in English, whether it is in Catalan, Spanish, French or another language, must be given to the Department with an accurate and complete English translation. The translation should include stamps, seals and marginal notes. This applies to birth certificates, marriage certificates, divorce records and police certificates. Messages between the couple only need translation if they are relied on as evidence, and it is better to select representative messages than to translate everything the couple has ever sent.
Do Andorran documents need an apostille for an Australian partner visa?
Not usually. For an online partner visa application, the Department generally accepts clear colour scans of original documents with English translations, and does not routinely require an apostille. The Department can ask to see originals or certified copies if it has concerns about a document. An apostille may still be useful for other purposes, such as registering an Australian marriage with Andorran authorities, because Andorran processes generally require foreign official documents to be apostilled or legalised.
Is a marriage in Andorra recognised in Australia?
Generally yes. A marriage celebrated in Andorra is recognised in Australia if it was valid under the law of the place where it took place and does not fall within an exception in the Marriage Act 1961, such as where one party was already married, the parties were too closely related, or one party did not freely consent. The couple should provide the official marriage certificate with an English translation. A marriage in Spain, France or any other country is assessed in the same way.
We are not married. Can I sponsor partner from Andorra as a de facto partner?
Yes. An unmarried couple can apply as de facto partners. They usually need to show a de facto relationship of at least 12 months before the application, unless an exception applies, such as registration of the relationship in an Australian state or territory. Time apart does not necessarily break the 12 months, but the couple must show the relationship continued. Evidence of living together in Andorra, elsewhere in Europe or in Australia is particularly useful. A couple planning to marry can also consider the Subclass 300.
Can my partner apply onshore after arriving in Australia as a visitor?
Sometimes. A partner in Australia on a visitor visa can apply for the Subclass 820 if the visitor visa does not carry condition 8503 (No Further Stay) or the condition has been waived, and the other criteria are met. If the visitor visa has expired, Schedule 3 criteria apply. A visitor visa must be applied for as a genuine visit, so the couple should get advice on the pathway before the partner travels rather than after arrival.
How much does it cost to sponsor partner from Andorra?
At the time of writing, the Partner visa application charge for the main applicant is AUD 11,710, covering both the temporary and permanent stages. Separate costs include translations from Catalan, Spanish or French, police certificates from Andorra and any other country where the partner lived for 12 months or more, panel physician health examinations and travel. Because several countries may be involved, these costs can be higher than expected. The charge is generally not refunded if the application is refused.
We spend months apart each year. Will that hurt the application?
Not necessarily. Time apart does not end a relationship if the couple maintains their commitment during it. The Department looks at the reasons for the time apart, the contact between the partners, visits and shared plans. Seasonal work, study or family obligations are common reasons. The couple should give a clear timeline with travel records and contact evidence, and explain the time apart in the relationship statement. Unexplained gaps are more of a risk than explained ones.
What are my obligations as the sponsor of a partner from Andorra?
The sponsor gives an undertaking to provide adequate accommodation and financial assistance to meet the applicant's reasonable living needs for the first two years of the visa. The sponsor must respond to Department requests, including any request for police checks, within the time allowed. There is no minimum income test for a standard partner visa sponsor. Sponsorship approval is decided at the time of decision, so the sponsor must continue to meet the sponsorship rules throughout processing.
Can I sponsor partner from Andorra if I sponsored someone before?
Possibly. Regulation 1.20J limits a sponsor to two partner sponsorships in a lifetime. It also prevents a new sponsorship within five years of a previous partner sponsorship, or within five years of the sponsor's own grant of a partner visa, unless there are compelling circumstances. A child of the new relationship can be a relevant factor in compelling circumstances. A sponsor who has sponsored before, or was sponsored as a partner, should get advice before paying the application charge.
Can my partner work and study in Australia while the application is processed?
It depends on the pathway and the visa held. A partner who applies onshore for the Subclass 820 usually receives a bridging visa that allows work while the application is processed. A partner who visits Australia on a visitor visa during a Subclass 309 application cannot work on that visitor visa. Once the Subclass 309 or Subclass 820 is granted, the partner can generally work and study in Australia. The conditions of each visa should be checked before the partner starts work.
Can a Subclass 309 refusal for an Andorran partner be reviewed?
Yes. A Subclass 309 refusal can generally be reviewed by the Administrative Review Tribunal. Since 2023, the visa applicant applies for review in their own name under section 338(9) of the Migration Act 1958 and regulations 4.02(4)(saa) and 4.02(5)(raa). The application must be made within 28 days after the decision is notified. The Tribunal fee for a partner visa review is AUD 3,727 at the time of writing. The Tribunal can consider new evidence, including a missing police certificate.
Do we need to have lived together before I sponsor partner from Andorra?
Not for a married couple or for the Subclass 300, although living together is strong evidence. De facto couples usually need to show they have lived together or do not live separately and apart on a permanent basis, generally for 12 months before applying, unless an exception applies. Couples who have lived together in Andorra or elsewhere should provide leases, bills or correspondence to the shared address. Couples who have not should explain why and show their plans to live together in Australia.
How does My Migration Lawyers help me sponsor partner from Andorra?
My Migration Lawyers assesses the sponsor's eligibility, maps both partners' residence histories to identify every police certificate needed, checks Andorran and other European documents and translations, advises on the right pathway and the timing of travel, and organises the relationship evidence across the four aspects. The firm prepares and lodges the application and sponsorship, responds to Department requests and section 57 letters, and acts on Administrative Review Tribunal review if needed. Consultations are by video so both partners can attend.
