Key Takeaways

  • An Australian citizen, Australian permanent resident or eligible New Zealand citizen aged 18 or over can sponsor partner from Luxembourg, and an Australian citizen can do so while still living in Luxembourg with the partner.
  • Couples who both live in Luxembourg commonly lodge a Subclass 309 application while the partner is outside Australia, then plan the sponsor's return so that the move to Australia is documented and consistent.
  • A Luxembourg residence certificate can list previous addresses registered in the National Registry of Natural Persons (RNPP), and the extended residence certificate can show a spouse or registered partner at the same address, which makes it strong household evidence.
  • Luxembourg criminal record extracts are issued in French by the Criminal Records Department of the Public Prosecutor's office, and every document in French, German or Luxembourgish needs an English translation that meets Home Affairs requirements.
  • The sponsor gives an undertaking of accommodation and financial assistance for the applicant's first two years in Australia, so a sponsor still working in Luxembourg should be ready to explain how that undertaking will be met after the move.

To sponsor partner from Luxembourg, the Australian partner must be an eligible sponsor, and the couple must prove a genuine and continuing relationship with evidence the Department of Home Affairs can verify. Many Australians who sponsor partner from Luxembourg are not in Australia at all when they start. They live in Luxembourg with their partner, often working in finance, European institutions or cross-border employment, and they are planning a joint move to Australia.

This guide is written for that sponsor. It explains whether a sponsor living abroad can sponsor, why the Subclass 309 visa is often lodged while both partners are still in Luxembourg, which Luxembourg records prove a shared household, how a Luxembourg civil partnership (PACS) or marriage is treated, how documents in French, German and Luxembourgish must be translated, how the Luxembourg criminal record extract is obtained, and what the sponsor's undertaking means for someone who has not yet moved home. The firm's partner visa lawyers advise sponsors in Luxembourg and across Europe by video.

The most important point is practical. When both partners live abroad, the Department cannot see the couple's life in Australia, because there is none yet. Everything depends on records from Luxembourg and on a credible plan for the move. Anyone who wants to sponsor partner from Luxembourg should build the application around those two things.

Can an Australian living in Luxembourg sponsor partner from Luxembourg?

Yes. An Australian citizen who lives in Luxembourg can sponsor partner from Luxembourg, and the sponsor does not need to be in Australia when the visa application is lodged. Permanent resident and eligible New Zealand citizen sponsors who live overseas face additional questions about their residence in Australia and should take advice before lodging.

The sponsor must be 18 or over, must meet the sponsorship limitation in regulation 1.20KB, and may be asked for police checks under regulation 1.20KC. Sponsorship is decided as a time of decision criterion inside the visa decision, so the sponsor's position when the case officer decides the application matters as much as the position at lodgement. The firm's guide for a partner visa sponsor living overseas explains how the Department approaches sponsors abroad, and the answer on whether an Australian living overseas can sponsor a partner gives a short summary.

A sponsor who wants to sponsor partner from Luxembourg should also read the guide to who can be a partner visa sponsor and the guide to partner visa sponsor eligibility. Those guides set out each eligibility rule in detail. The sponsor partner from Luxembourg rules are no different for a sponsor who has lived abroad for many years, but the evidence of the sponsor's own status and plans becomes more important. The answer on who can sponsor a partner visa is a useful checklist.

Australian citizens abroad

An Australian citizen remains an Australian citizen while living overseas, however long the stay. A citizen sponsor proves status with an Australian passport or citizenship evidence. The guide for an Australian citizen partner visa sponsor explains the documents. Where the sponsor holds a second citizenship, such as a Luxembourg or other European passport, the guide for a partner visa sponsor who is a dual citizen explains how to keep the identity details consistent. A citizen who wants to sponsor partner from Luxembourg after a long period abroad should check that the Australian passport is current before lodging.

Permanent residents and New Zealand citizens abroad

A permanent resident who has spent years in Luxembourg may also have a travel facility problem, because a permanent visa holder needs a valid travel facility to return to Australia as a resident. The guide for a partner visa sponsor with an expired travel facility and the guide to the partner visa sponsor resident return visa explain the issue. An eligible New Zealand citizen sponsor should read the guide to New Zealand citizen partner visa sponsors before lodging. These steps should be resolved before any attempt to sponsor partner from Luxembourg, not after the application has been lodged.

Why lodge a Subclass 309 while both partners are in Luxembourg?

Couples who both live in Luxembourg usually lodge a Subclass 309 application because the partner is outside Australia, can stay in Luxembourg while the application is processed, and can keep working until the visa is granted. For many couples who sponsor partner from Luxembourg, this is the most orderly pathway.

The Subclass 309 partner visa is the offshore temporary visa. It leads to the permanent Subclass 100, which is assessed later. The sponsor can stay in Luxembourg during processing, return to Australia first to set up work and housing, or travel between the two. The firm's guide to the offshore partner visa and the guide to offshore partner visa lodgement explain the process, and the answer on help with an offshore Subclass 309 and Subclass 100 application summarises the stages.

The alternatives are the onshore Subclass 820 partner visa, which requires the applicant to be in Australia when applying, and the Subclass 300 Prospective Marriage visa for engaged couples who will marry within the visa period. A couple who sponsor partner from Luxembourg and want to arrive together in Australia before lodging should compare the routes in the guide to onshore versus offshore partner visas, and should check any visitor visa conditions first.

The location rules at grant for Subclass 309 and Subclass 820 visas changed in November 2023. Couples should not rely on older guidance about where the applicant must be when the visa is granted. The answer on whether the applicant must be outside Australia when a Subclass 309 visa is granted explains the current position. Any couple who sponsor partner from Luxembourg and plan to travel during processing should read it before booking.

Is the partner a Luxembourg national or a resident of another nationality?

The answer matters because the partner's passport, identity documents and police certificates follow nationality and residence history, not the country where the couple happen to live. Luxembourg's official information states that foreign residents make up almost half of the population, so many people who sponsor partner from Luxembourg are in fact sponsoring a French, Portuguese, Belgian, German, Italian or other national who lives in Luxembourg.

This affects the application in three ways:

  • Passport. The applicant must hold a valid passport that meets PIC 4021. The guide on a partner visa change of passport explains what to do if the passport is renewed during processing.
  • Police certificates. Department practice is to require police certificates from each country where the applicant has lived for 12 months or more in the last 10 years since turning 16. A partner who grew up in another country and moved to Luxembourg will usually need certificates from both. The guide to partner visa overseas police certificates explains the rule.
  • Civil documents. Birth certificates come from the country of birth, not from Luxembourg. The partner visa document checklist lists what is usually needed.

The sponsor partner from Luxembourg process is the same whatever the partner's nationality. What changes is the set of countries the documents come from. That should be mapped at the start, because certificates from several countries take time to obtain. Mapping the countries early is one of the simplest ways to keep the sponsor partner from Luxembourg timetable on track.

Planning the move to Australia

The Department will want to understand when and how the couple intend to live together in Australia. For a sponsor who is still employed in Luxembourg, the plan does not need to be fixed to the day, but it should be real and documented.

Useful evidence of the plan includes a resignation or transfer letter, applications for work in Australia, correspondence about housing, shipping quotes and messages discussing the timing of the move. The firm's guide for a partner visa sponsor returning to Australia explains how sponsors show an intention to resettle, and the guide to partner visa future plans explains how plans can support the commitment aspect. A couple who sponsor partner from Luxembourg should keep this evidence as it is created, rather than reconstructing it later.

Which Luxembourg records prove a shared household?

The strongest single household record for a couple in Luxembourg is usually a residence certificate based on the National Registry of Natural Persons (RNPP), supported by leases, bank statements and correspondence at the shared address. Couples who sponsor partner from Luxembourg are fortunate that these records exist and can often be generated online.

The Department assesses the nature of the household as one of four aspects of the relationship, alongside the financial aspects, the social aspects and the couple's commitment. The guide to household evidence for a partner visa and the guide to the nature of the household explain what decision makers look for. For anyone who wants to sponsor partner from Luxembourg, the household aspect is usually the easiest to prove, because the official records are good.

The residence certificate

According to Guichet.lu, the residence certificate is an official document certifying a person's legal address as registered in the RNPP. It can include previous addresses registered in the RNPP and the period of registration at each. It is issued by the communal administration and can also be generated free of charge online through MyGuichet.lu.

For a couple who sponsor partner from Luxembourg, a residence certificate for each partner showing the same address over the same period is clear, official evidence of cohabitation. Authorities in Luxembourg generally ask for a certificate less than three months old for their own purposes, so the certificate should be generated close to lodgement and again if the Department asks for updated evidence. The certificates for both partners should be read side by side before upload, because a single unexplained gap in one partner's registered address can weaken an otherwise strong sponsor partner from Luxembourg application.

The extended residence certificate

Guichet.lu states that the extended residence certificate replaces the former household composition certificate and adds the details of the person's children, spouse or registered partner who share the usual residence. For married couples and couples in a declared civil partnership, this one document shows both partners in the same household.

Other Luxembourg household records

Other useful records include the lease or property title, utility and internet accounts, home contents insurance, commune correspondence, employer letters addressed to the shared home, and bank statements showing rent and household costs. The answer on household evidence, the answer on a lease in both names and the answer on joint bills explain how these documents are weighed.

What relationship evidence helps a couple sponsor partner from Luxembourg?

The evidence that helps most is evidence that shows the couple's real shared life in Luxembourg across all four aspects, not only the household. A couple who sponsor partner from Luxembourg often have good official records but thin social and commitment evidence, because their family and friends are spread across several countries.

The financial aspects can be shown with joint accounts, shared rent and transfers between the partners. The guide to partner visa financial evidence explains what helps. The social aspects can be shown with joint travel, invitations, photographs with friends in Luxembourg and Australia, and statements from people who know the couple. Australian citizens and permanent residents can give Form 888 statements, and friends in Luxembourg and elsewhere can give written statements. The guide to Form 888 witness statements and the answer on statements from overseas friends explain both. The commitment aspect is shown by the length of the relationship, the plan to move to Australia, and steps such as wills or insurance nominations. The guide to the four pillars of a partner visa explains how these aspects fit together in a plan to sponsor partner from Luxembourg.

Does a Luxembourg civil partnership (PACS) count for a partner visa?

A Luxembourg PACS is strong evidence of a de facto relationship and commitment, but it is not the same as a relationship registered under an Australian State or Territory law, so it does not automatically remove the 12-month de facto requirement.

Guichet.lu describes the PACS as a civil contract between partners, regardless of gender, who live together as a couple. It is declared in person before the civil registrar of the commune where both partners live, and the registrar verifies their joint residence in the RNPP. The partners receive a certificate confirming the registration. For couples who sponsor partner from Luxembourg, the PACS certificate and the joint residence check behind it are useful evidence of the household and of commitment.

The 12-month de facto requirement in regulation 2.03A(3) is a separate question. It does not apply where the relationship is registered under an Australian State or Territory law or where compelling and compassionate circumstances exist. The answer on an overseas registered relationship and a partner visa explains how a foreign registration is treated for anyone who wants to sponsor partner from Luxembourg, the answer on the legal definition of a de facto relationship sets out the test, and the answer on when the 12-month de facto period starts explains the counting.

Same-sex couples can sponsor partner from Luxembourg on the same basis as any other couple. The firm's page on the LGBTI partner visa explains how the firm acts for same-sex couples, and the answer on a same-sex de facto visa gives a summary.

Couples who married in Luxembourg

A couple who married in Luxembourg rely on the civil marriage certificate. A marriage validly celebrated overseas is generally recognised in Australia if it was valid where it took place and would not be void under Australian law.

The marriage certificate proves the legal relationship. It does not prove that the relationship is genuine and continuing, so a married couple who sponsor partner from Luxembourg still need evidence of the four aspects. The guide on whether an overseas marriage is recognised in Australia and the answer on whether a marriage certificate is enough for a spouse visa explain this. In a sponsor partner from Luxembourg application, the marriage certificate should be uploaded with the extended residence certificate, so the legal and practical relationship are shown together. If either partner was previously married, evidence that the earlier marriage ended is essential, and the guide to a partner visa after divorce explains what is needed.

French, German and Luxembourgish documents

Luxembourg's 1984 Languages Law allows French, German or Luxembourgish to be used in administrative and judicial matters, and legislation is written in French. In practice, many documents a couple who sponsor partner from Luxembourg will rely on are in French or German, and some correspondence may be in Luxembourgish.

Every document not in English must be translated. The Department of Home Affairs states that a translation made in Australia must include the translator's NAATI practitioner number, and a translation made outside Australia must include the translator's full name, address, phone number and qualifications. The guide to partner visa evidence translation and the answer on translating a marriage certificate explain the requirements.

Three practical points help when documents are in several languages:

  • Translate the official documents in full. Residence certificates, PACS certificates, marriage and birth certificates, and criminal record extracts should be fully translated.
  • Select extracts from long records. Bank statements and message histories can be translated in relevant extracts, with the selection explained. The answer on translating messages for a partner visa explains how.
  • Keep name spellings consistent. French and German records may show accents, double surnames or a married name. The answer on different names and dates in documents explains how to deal with variations.

A sponsor partner from Luxembourg application that mixes languages without a clear index is hard to assess. The guide to organising partner visa evidence explains how to present a multi-language file. A one-page index that lists each document, its language and its translation is a simple step that makes a sponsor partner from Luxembourg file far easier to assess.

How is the Luxembourg criminal record extract obtained?

The Luxembourg criminal record extract is issued free of charge by the Criminal Records Department (Service du casier judiciaire) of the Public Prosecutor's office, and Guichet.lu states that extracts are issued in French.

There are five bulletins. A natural person can request only Bulletin No. 3, No. 4 or No. 5. Bulletin No. 3 is described as the standard record. The extract can be requested remotely, including online through MyGuichet.lu, by email, post or fax. Eligibility to request is limited to people over 18 who are Luxembourg nationals or who live in Luxembourg. A couple who sponsor partner from Luxembourg should request the extract while the partner still lives there, because a person who is not a Luxembourg national may not be able to request it after leaving.

The partner may also need certificates from every other country where they lived for 12 months or more in the last 10 years. If a certificate is delayed, the answer on what to do when a police certificate cannot be obtained explains the options, and the guide to expired partner visa police checks explains when to renew. The answer on police certificates for a partner visa gives a short overview.

What does the sponsor's undertaking mean for a sponsor still in Luxembourg?

The sponsor undertakes to provide accommodation and financial assistance, as reasonably necessary, for the applicant's first two years in Australia. A sponsor who is still working in Luxembourg can give that undertaking, but should be ready to explain how it will be met once the couple arrive.

The undertaking is given in the online sponsorship, which the sponsor lodges after the visa application using its Transaction Reference Number. The guide to the partner visa sponsor undertaking, the guide to partner visa sponsor obligations and the guide to Form 40SP for a partner visa explain what the sponsor signs. The guide to partner visa sponsorship lodgement explains the steps.

There is no fixed income test for the sponsor in an ordinary partner visa. The answer on whether a sponsor needs a minimum income explains the position. Even so, a couple who sponsor partner from Luxembourg should show, in a practical way, where they will live and how they will support themselves after the move. Savings, a job offer, a property in Australia or family accommodation all help to show that the undertaking is realistic. This practical evidence matters more when you sponsor partner from Luxembourg from abroad, because the case officer cannot see an existing home in Australia.

If the sponsor returns to Australia first

Many sponsors go back to Australia first to start work and find housing, while the partner finishes a contract in Luxembourg. That is a normal arrangement. It creates a period of living apart that should be explained, with evidence of continued contact, visits and joint planning. The guide on temporary separation during a partner visa and the guide to a partner visa while living apart for work explain how this is assessed. The answer on whether the sponsor can be overseas while a Subclass 820 application is processed deals with the reverse situation. A sponsor who returns first should keep the contact details in the sponsorship up to date while the sponsor partner from Luxembourg application is processed, so that Department requests are not missed during the move.

Does the sponsor need a Luxembourg police check?

Possibly. Under regulation 1.20KC(5), the Department may ask the sponsor for police checks from Australia and from each foreign country where the sponsor has lived for 12 months or more in the relevant period. A sponsor who has lived in Luxembourg for a year or more can expect that Luxembourg may be one of those countries.

A sponsor who lives in Luxembourg is eligible to request a Luxembourg criminal record extract while resident there. A sponsor who wants to sponsor partner from Luxembourg should therefore consider obtaining the extract before leaving. The request for sponsor checks is usually sent to the sponsor, not the applicant, and may arrive long after lodgement. If the checks are not provided within a reasonable time, the Department may refuse to approve the sponsorship. The guide to the partner visa sponsor police check, the guide on a partner visa sponsor police check that is not provided and the guide to a partner visa sponsor risk assessment explain the process.

A sponsor who has sponsored a partner before, or who was granted a partner visa, should also check the sponsorship limitation. The commercial page on partner visa sponsorship limitations explains the two-sponsorship and five-year rules. A sponsor who wants to sponsor partner from Luxembourg after an earlier partner sponsorship should check those dates before lodging.

Health checks, costs and waiting times

The applicant must meet the health criteria, usually through medical examinations arranged after lodgement. The guide to the partner visa medical examination explains how examinations are arranged for applicants outside Australia, and the guide to partner visa biometrics explains when biometrics may be requested.

The visa application charge is from AUD 11,710 as at October 2026. As at October 2026, the Department's published processing times for the Subclass 309 were 21 months for 50% and 32 months for 90% of applications, and for the permanent Subclass 100 were 9 months for 50% and 21 months for 90%. A couple who sponsor partner from Luxembourg should plan the move around these figures and treat them as a guide only. The guide to partner visa cost, the guide to partner visa processing times and the answer on the Subclass 309 and Subclass 100 stages explain the detail.

While a Subclass 309 application is being processed, the partner may wish to visit Australia. The answer on visiting Australia while a Subclass 309 application is processed and the guide to a visitor visa during partner visa processing explain the options and risks. Visits made while you sponsor partner from Luxembourg can also add to the relationship evidence, so tickets and photographs should be kept.

What have Tribunal decisions said about sponsors and couples living abroad?

Tribunal decisions recorded in the firm's database show remittals on issues that often arise when a sponsor lives abroad or the sponsorship material is incomplete. Three are relevant to couples who sponsor partner from Luxembourg.

  • Singh (Migration) [2018] AATA 5925, 20 December 2018, Subclass 309. The reported issues were that the sponsor financially supported the applicant, the couple had lived in separate countries for the past 10 years, and the relationship was widely recognised. The decision under review was remitted.
  • Sathandla Halli Vijayakumar (Migration) [2022] AATA 91, 5 January 2022, Subclass 820. The reported issues were insufficient information concerning the sponsor, the sponsorship declaration, and a National Police Check. The decision under review was remitted.
  • Yasa (Migration) [2021] AATA 4402, 27 October 2021, Subclass 309. The reported issues were evidence of sponsorship and a genuine and continuing relationship. The decision under review was remitted.

These decisions are cited only for the issues they record, not as decisions about anyone who sought to sponsor partner from Luxembourg. Each depended on its own evidence. They show why the sponsor's own material deserves as much care as the applicant's. The guide to partner visa ART evidence explains what the Tribunal considers.

What happens if the Subclass 309 is refused?

The applicant can usually apply to the Administrative Review Tribunal within 28 days after being notified of the refusal, and that period cannot be extended. For a Subclass 309 refusal, the firm's position is that the visa applicant is the person who applies.

The Tribunal fee for a migration review is AUD 3,727 as at October 2026, with a 50% reduction for financial hardship, and it must be paid within the review period. The answer on who applies for review of an offshore refusal explains the position, and the commercial page on partner visa refusals explains how the firm acts. The guide to partner visa appeal versus reapplication explains when a fresh application may be better. A couple who sponsor partner from Luxembourg should read any refusal letter with care, because the reasons point to the evidence that is needed, and the guide to the partner visa refusal letter explains how to read it.

Mistakes to avoid when you sponsor partner from Luxembourg

The problems that arise most often when couples sponsor partner from Luxembourg are:

  • No plan for the move. Lodging with no evidence of when or how the couple will live in Australia.
  • Old residence certificates. Relying on a certificate that does not cover the whole period of cohabitation, or is out of date.
  • Forgetting the partner's other countries. Obtaining only a Luxembourg extract for a partner who previously lived for a year or more in France, Belgium, Germany or Portugal.
  • Leaving before requesting the extract. A partner or sponsor who is not a Luxembourg national may find it harder to obtain the extract after moving away.
  • Mixed-language files with no index. Uploading French and German documents without translations or a clear explanation.
  • Assuming a PACS removes the 12-month rule. Treating a Luxembourg civil partnership as if it were an Australian registered relationship.
  • Unexplained separation. Failing to explain the months when the sponsor had already returned to Australia.

The firm's guide to partner visa application mistakes and the guide to partner visa refusal reasons explain these risks in more depth. A partner visa application review before lodgement can catch them early.

Frequently Asked Questions

Can I sponsor my partner from Luxembourg while I still live in Luxembourg?

Yes, if you are an Australian citizen. An Australian citizen can sponsor a partner for a partner visa while living overseas, and does not need to be in Australia when the application is lodged. Permanent resident and eligible New Zealand citizen sponsors who live abroad face additional questions about their residence in Australia and should take advice first. Whatever the sponsor's status, the couple should document a genuine plan to live together in Australia, such as job applications, housing arrangements or a planned return date.

Which visa is best if we both live in Luxembourg?

Couples who both live in Luxembourg usually apply for the Subclass 309 visa, because the partner is outside Australia at lodgement and can continue living and working in Luxembourg during processing. The Subclass 309 leads to the permanent Subclass 100. The onshore Subclass 820 requires the applicant to be in Australia when applying, and the Subclass 300 suits engaged couples who will marry within the visa period. The best choice depends on the timing of the sponsor's return and the partner's work commitments.

What Luxembourg document best proves that we live together?

A residence certificate based on the National Registry of Natural Persons (RNPP) is often the strongest single record. Guichet.lu states that it can list previous registered addresses and the dates at each, and that the extended residence certificate shows a spouse or registered partner who shares the usual residence. It can be generated online through MyGuichet.lu. It should be supported by a lease, bank statements, utility accounts and correspondence addressed to both partners at the shared home.

Does a Luxembourg PACS remove the 12-month de facto requirement?

No, not usually. The exemption from the 12-month de facto requirement in regulation 2.03A(3) applies to relationships registered under an Australian State or Territory law, and a Luxembourg PACS is a foreign registration. The PACS is still strong evidence. It is declared before the civil registrar of the commune where both partners live, after the registrar checks their joint residence in the RNPP. Couples who cannot yet show 12 months of de facto relationship should take advice on timing.

Is a marriage in Luxembourg recognised for an Australian partner visa?

Generally yes. A marriage validly celebrated in Luxembourg is generally recognised in Australia if it was valid under Luxembourg law and would not be void under Australian law, for example because one partner was already married. The couple should provide the civil marriage certificate with an English translation and evidence that any earlier marriage ended. The certificate proves the marriage only. The couple must still prove the financial, household, social and commitment aspects of a genuine and continuing relationship.

My partner lives in Luxembourg but is a French national. What changes?

The visa process is the same, but the documents change. The partner applies on a French passport, provides a French birth certificate, and usually needs police certificates from France and Luxembourg if they lived in each for 12 months or more in the last 10 years since turning 16. Luxembourg records can still prove the shared household. The application should list each country of residence accurately, because inconsistent residence history can raise questions under the integrity criterion, PIC 4020.

How do I get a Luxembourg criminal record extract for a partner visa?

The extract is issued free of charge by the Criminal Records Department (Service du casier judiciaire) of the Public Prosecutor's office. Guichet.lu states that it can be requested remotely, including online through MyGuichet.lu, and that extracts are issued in French. A natural person can request Bulletin No. 3, No. 4 or No. 5. Requests are limited to people over 18 who are Luxembourg nationals or residents, so a non-national should request it before leaving Luxembourg.

Will the Australian sponsor need a Luxembourg police check?

Possibly. Under regulation 1.20KC(5), the Department may ask the sponsor for police checks from Australia and from each foreign country where the sponsor has lived for 12 months or more in the relevant period. A sponsor who has lived in Luxembourg for a year or more should expect that a Luxembourg extract may be requested. The request is usually sent to the sponsor directly. If the checks are not provided within a reasonable time, the Department may refuse to approve the sponsorship.

Do French and German documents need to be translated?

Yes. Every document that is not in English must be accompanied by an English translation. The Department of Home Affairs states that a translation made in Australia must include the translator's NAATI practitioner number, and a translation made outside Australia must include the translator's full name, address, phone number and qualifications. Residence certificates, civil partnership and marriage certificates, birth certificates and criminal record extracts should be translated in full. Long bank or message records can be translated in relevant extracts.

Can I sponsor partner from Luxembourg if I return to Australia first?

Yes. Many sponsors return to Australia first to start work and find housing while the partner finishes commitments in Luxembourg. The Subclass 309 application can continue while the couple live apart for this purpose. The period of separation should be explained with dates and reasons, and supported by evidence of regular contact, visits, joint planning and shared finances. A temporary separation for practical reasons does not by itself mean the couple live separately and apart on a permanent basis.

Does the sponsor need a minimum income to sponsor a partner from Luxembourg?

No. There is no fixed minimum income test for the sponsor of an ordinary partner visa. The sponsor does give an undertaking to provide accommodation and financial assistance, as reasonably necessary, for the applicant's first two years in Australia. A sponsor who is still employed in Luxembourg should be able to explain how that undertaking will be met after the move, for example through savings, a job offer in Australia, a property or family accommodation.

Can a permanent resident living in Luxembourg sponsor a partner?

Sometimes, but a permanent resident living abroad faces more issues than a citizen. The sponsor's residence in Australia may be examined, and a permanent resident who has been away for years may need a valid travel facility, such as a resident return visa, to return to Australia as a permanent resident. These issues should be resolved before the partner visa is lodged. A permanent resident in this position should take advice on the order of the steps.

Can my Luxembourg partner visit Australia while the Subclass 309 is processed?

Often yes, on an appropriate visitor visa, but visits need care. A visit can strengthen the relationship evidence and help with planning the move. The partner must meet the visitor visa requirements, must intend a genuine visit, and should be aware that the rules about where the applicant must be at the time of grant changed in November 2023. The couple should check the current position before booking travel, so that a visit does not affect the timing of the grant.

How long does it take to sponsor partner from Luxembourg?

As at October 2026, the Department's published processing times for the Subclass 309 were 21 months for 50% and 32 months for 90% of applications. The permanent Subclass 100 is assessed later, with published times of 9 months for 50% and 21 months for 90% of applications as at October 2026. Individual cases vary. A complete application with translated Luxembourg records and current police certificates is less likely to be delayed by requests for further information.

Who applies for review if my Luxembourg partner's Subclass 309 is refused?

The firm's position is that the visa applicant applies to the Administrative Review Tribunal for review of a Subclass 309 refusal. The application must be made within 28 days after notification of the refusal, and that period cannot be extended. The Tribunal fee must be paid within the same period, and a 50% reduction is available for financial hardship. The couple should read the refusal reasons carefully, because they show which evidence the Tribunal will need to see.

What is the biggest risk when both partners live in Luxembourg?

The biggest risk is an application that shows a strong life in Luxembourg but no credible plan to live together in Australia. The Department assesses commitment to a shared life, and for a couple abroad, evidence of the planned move is part of that picture. Other common risks are relying on an out of date residence certificate, missing police certificates from the partner's other countries of residence, and uploading French or German documents without English translations.
