Key Takeaways
- An Australian citizen, Australian permanent resident or eligible New Zealand citizen can sponsor partner from Georgia, the country in the South Caucasus with its capital in Tbilisi, on a Subclass 309 offshore partner visa, a Subclass 820 onshore partner visa or a Subclass 300 Prospective Marriage visa.
- Georgian citizens are not eligible for an ETA or an eVisitor, so a Georgian partner who wants to visit Australia first needs a Subclass 600 Visitor visa, and condition 8503 can prevent an onshore application.
- Under the Civil Code of Georgia, only a marriage registered with the civil registry gives rise to spousal rights. A church wedding alone is not a registered marriage, so the civil registration document is the one that matters for a spouse application.
- The Georgian police certificate is issued by the Service Agency of the Ministry of Internal Affairs, and United States Government guidance describes two certificates that together show a full criminal history.
- An age difference or a relationship that began online is not a reason for refusal. Detailed, consistent evidence of how the relationship developed is what answers the Department's questions.
To sponsor partner from Georgia, you must be an eligible Australian sponsor in a genuine and continuing relationship with your Georgian partner. This guide is about Georgia the country, in the South Caucasus, with its capital in Tbilisi. It is not about the United States state of Georgia. Partners who are United States citizens follow different country rules.
Australians who sponsor partner from Georgia usually met their partner in one of two ways: online, or while travelling. Both can lead to genuine relationships. Both also raise the same practical questions. How much time have you spent together? Can your partner visit Australia? Will the Department of Home Affairs look closely at an age difference? Which Georgian documents are needed, and in what form?
This guide answers those questions for the Australian sponsor. It covers the visa pathways, the visitor visa route and its limits, relationships with an age gap, evidence for couples who met online or on holiday, Georgian civil registration documents from the Public Service Development Agency, translation of Georgian script, the Georgian police certificate, and what to do if the application is refused. For the general rules, see the firm's partner visa sponsor guide and the partner visa complete guide.
Who can sponsor partner from Georgia?
An Australian citizen, an Australian permanent resident or an eligible New Zealand citizen can sponsor partner from Georgia. The sponsor must usually be at least 18, must meet the sponsorship limitations, and must provide police checks when the Department asks for them.
When you sponsor partner from Georgia, the sponsor's status is proved with documents. The firm's guides for an Australian citizen sponsor, a permanent resident sponsor and a New Zealand citizen sponsor explain what each type of sponsor provides. The FAQ on proving the sponsor is an Australian citizen lists the usual documents.
Sponsors who want to sponsor partner from Georgia and have sponsored a partner before, or who were themselves sponsored as a partner, may be affected by the limits explained on the firm's sponsorship limitations page. Sponsors with criminal history should also read about partner visa sponsor eligibility and the sponsor police check before lodging.
Which visa do you use to sponsor partner from Georgia?
Most Australians who sponsor partner from Georgia use the offshore Subclass 309 and Subclass 100 pathway, because the Georgian partner usually lives in Georgia. The onshore Subclass 820 and Subclass 801 pathway is used only when the Georgian partner is already in Australia on a visa that allows a further application. The Subclass 300 Prospective Marriage visa is for engaged couples who will marry in Australia.
- Subclass 309 then Subclass 100. The Georgian partner must be outside Australia at application and at grant. This suits married or de facto couples where the partner lives in Georgia.
- Subclass 820 then Subclass 801. The Georgian partner must be in Australia at application. This suits partners already in Australia on a suitable visa.
- Subclass 300. The Georgian partner must be outside Australia at application and at grant. This suits engaged couples who will marry in Australia within the visa period.
The firm's pages on the Subclass 309 partner visa, the Subclass 820 partner visa and the Subclass 300 Prospective Marriage visa explain each option. The onshore vs offshore partner visa guide compares them.
Married, de facto or engaged?
Couples who want to sponsor partner from Georgia can apply as spouses, as de facto partners, or as an engaged couple for the Subclass 300. A de facto relationship generally needs to have existed for 12 months before the application, unless an exception applies. The FAQ on spouse compared with de facto applications and the de facto visa requirements explain the difference.
Can a Georgian partner visit Australia first?
Yes, but a Georgian partner needs a visitor visa granted in advance. Georgian citizens are not eligible for an Electronic Travel Authority or an eVisitor, so the usual option is a Subclass 600 Visitor visa. The Department assesses a visitor visa on its own criteria, including whether the visitor intends a genuine temporary stay.
Many couples who sponsor partner from Georgia want the Georgian partner to visit Australia before lodging. A visit can help couples who sponsor partner from Georgia. It lets the partner meet the sponsor's family and friends, and it creates evidence of time spent together. It also carries risks that must be understood before any visitor visa application.
Condition 8503
A Subclass 600 Visitor visa may be granted with condition 8503, which means the holder cannot be granted most further visas while in Australia. A Georgian partner on a visitor visa with condition 8503 cannot lodge a Subclass 820 application in Australia unless the condition is first waived, and waivers are only available in limited circumstances. The guide on the condition 8503 waiver and the FAQ on condition 8503 and partner visas explain this.
Lodging onshore after arriving on a visitor visa
If the visitor visa does not have condition 8503 and you sponsor partner from Georgia onshore, the Georgian partner in Australia may be able to lodge a Subclass 820 application. The application must be made while the visitor visa is still in effect to avoid the Schedule 3 criteria. The Tribunal considered a case where the applicant was married in the home country, had a previous application refused, and arrived in Australia on a visitor visa, with the sponsor making regular visits, in Tang (Migration) [2026] ARTA 374. The Tribunal remitted the matter. The guides on moving from a tourist visa to a partner visa and on a visitor visa during partner visa processing explain the steps and risks.
Visiting while a Subclass 309 is being processed
When you sponsor partner from Georgia on a Subclass 309, the Georgian partner may still apply for a visitor visa to visit the sponsor. The Subclass 309 cannot be granted while the partner is in Australia, so the partner must leave before the decision. The FAQ on visiting Australia while a Subclass 309 is processing and the FAQ on being outside Australia when the Subclass 309 is granted explain the timing.
Couples who met online: how to sponsor partner from Georgia
A relationship that began online can support a partner visa, and the Department assesses the relationship as it is now, not how it began. Couples who sponsor partner from Georgia after meeting online should show how the relationship moved from messages to meeting in person, and from meeting in person to a shared commitment.
For couples who sponsor partner from Georgia after meeting online, the evidence that matters most is chronological. The first contact, the first video call, the first meeting in person, each visit, the decision to marry or live together, and the plans for life in Australia should all be documented. The guide on a partner visa when you met online and the FAQ on de facto visas for couples who met online explain how to present this. The guide to a partner visa evidence timeline shows how to organise it.
Communication records
Message histories and call logs are useful when they show a continuing relationship over time. A short selection showing the pattern is better than thousands of pages. The guides on partner visa chat evidence and social media evidence explain what to include.
When the couple speaks different languages
Some couples who sponsor partner from Georgia communicate in English, some in Russian or another shared language, and some through translation tools. A different first language does not suggest a relationship is not genuine. The relationship statement should explain how the couple communicates, and any key messages in Georgian or Russian should be translated. The FAQ on couples with different languages covers this point.
Couples who met while travelling in Georgia
Many Australians meet a Georgian partner while visiting Tbilisi, Batumi or other parts of Georgia, or meet a Georgian partner travelling elsewhere. When you sponsor partner from Georgia after meeting on holiday, the relationship is assessed in the same way as any other: on the evidence of the four aspects of the relationship.
Australian Government travel advice states that Australian passport holders can visit Georgia for up to 12 months without a visa. This allows an Australian sponsor to spend long periods in Georgia with the partner. Couples who sponsor partner from Georgia often find that time living together in Georgia is valuable evidence of the nature of the household and can count towards the 12 month de facto period. The FAQs on living together overseas for 12 months and time apart during the 12 month de facto period explain how this time is assessed.
A sponsor who lives in Georgia for an extended period should keep records of the shared address, such as a lease, utility accounts or a letter from the landlord, and evidence of shared daily life. The guide on sponsoring a partner while living overseas explains how the Department treats an Australian sponsor who is abroad, and the guide on partner visa travel evidence explains what records help.
Georgian partners already in Australia
Some Australians sponsor partner from Georgia while the Georgian partner is already in Australia as a student, a working holiday maker, a skilled worker or a visitor. In that situation, the onshore Subclass 820 pathway may be available, but only if the visa held allows it and the application is made at the right time.
The key questions are whether the current visa has condition 8503, 8534 or 8535 or another no further stay condition, whether the visa is still in effect, and whether any earlier visa refusal triggers the section 48 bar. If the Georgian partner's visa has ended, the Schedule 3 criteria will usually apply, and the application may need to show compelling reasons. The firm's guides on the section 48 bar, the Schedule 3 criteria and the Subclass 820 visa guide explain these rules.
When a Subclass 820 application is lodged while a substantive visa is in effect, a bridging visa is usually granted, which allows the Georgian partner to remain lawfully while the application is processed. The guide on the partner visa bridging visa explains how it works. Couples who sponsor partner from Georgia onshore should check the visa conditions on VEVO and obtain advice before the current visa ends, because the timing of lodgement can decide which criteria apply.
Age gap relationships when you sponsor partner from Georgia
An age difference between partners is not a ground for refusing a partner visa. The legal test is whether the relationship is genuine and continuing, with a mutual commitment to a shared life to the exclusion of all others. An age gap is one fact the Department may take into account, but it does not decide the application.
In practice, a significant age difference, especially combined with a short relationship or a relationship that began online, can lead a decision maker to ask more questions. Couples who sponsor partner from Georgia with an age gap should expect that, and should answer it with evidence rather than general statements.
What the Tribunal has said
The Tribunal considered a relationship with an age difference where limited evidence had been given to the Department, and detailed statements were provided on review, in Magallanes (Migration) [2025] ARTA 1331. The Tribunal remitted the matter to the Department. The reported issues show the pattern. A thin application invited doubt. Detailed and specific statements answered it.
Evidence that addresses an age difference
The most useful evidence for couples who sponsor partner from Georgia with an age difference shows how the couple actually lives and plans together:
- How the relationship started and developed. A clear history in the relationship statement, with dates, places and specific events.
- Family knowledge and acceptance. Form 888 statements from family members on both sides who know about the relationship and the age difference, and evidence that each partner has met the other's family.
- Shared plans that suit both partners. Plans about work, home, children or no children, retirement, and care for parents, discussed openly.
- Financial arrangements. Evidence of how money is shared, including transfers and joint accounts, and how the couple plans to manage finances in Australia.
- Consistency. Both partners giving the same account in forms, statements and any interview.
The firm's guides on a partner visa age gap and a partner visa refused because of an age gap explain the Department's approach. The guide on partner visa commitment evidence explains how to show long term plans.
Interviews
When you sponsor partner from Georgia, the Department may interview one or both partners. Questions often test knowledge of each other's lives, families and plans. Answers do not need to be rehearsed, but they must be honest and consistent. The guides on partner visa interview questions and inconsistencies at interview explain what decision makers look for, and the guide on conflicting statements explains how differences are dealt with.
Marrying quickly: what the Department looks at
Some couples who sponsor partner from Georgia marry within months of meeting. A quick marriage is lawful and does not, by itself, mean the relationship is not genuine. The Department looks at what happened before and after the wedding, and at the couple's plans.
The Tribunal considered a couple who married two months after meeting, and their future plans, in Wang (Migration) [2024] ARTA 822. The Tribunal remitted the matter. Speed of marriage was a fact in the case, but the assessment looked at the relationship as a whole. The FAQ on marrying soon after meeting and the guide on why a relationship was refused as not genuine explain how to approach this.
Getting married in Georgia for a spouse visa
Under the Civil Code of Georgia, only a marriage registered at the civil registry gives rise to spousal rights and obligations. This is stated in Article 1151, as quoted by the Constitutional Court of Georgia. For couples who sponsor partner from Georgia as spouses, the registered civil marriage is therefore the marriage that counts.
For couples who sponsor partner from Georgia, it helps to know that civil registration in Georgia is handled by the Public Service Development Agency of the Ministry of Justice. United States Government guidance on Georgian civil documents states that marriage certificates are issued by Public Service Development Agency offices, that certified copies are available, and that authenticity can be checked online through the agency's verification service. The same guidance states that there is no fee for marriage registration at an agency branch, with separate fees for optional special services.
A church wedding alone
Many Georgian couples also marry in the Georgian Orthodox Church. A church ceremony is an important part of family and religious life, and photographs and statements about it are good social evidence. The Constitutional Court noted that the civil registration rule in the Civil Code concerns civil marriage and does not address religious marriage. A couple who has had only a church wedding, without civil registration, should not assume they can apply as spouses. They may instead apply as de facto partners if the de facto requirements are met, or register the marriage. The FAQs on religious and cultural marriages and unregistered marriages explain the risk.
Is a Georgian marriage recognised in Australia?
Yes, in most cases. A marriage validly registered in Georgia is generally recognised in Australia under Part VA of the Marriage Act 1961, unless an exception applies, such as either party already being married to someone else. The guide on whether an overseas marriage is recognised in Australia explains the exceptions. The guide on the partner visa marriage certificate explains what to upload.
Marrying in Australia instead
Couples who sponsor partner from Georgia and want to marry in Australia can use the Subclass 300 Prospective Marriage visa. The marriage must take place in Australia during the visa period, after a Notice of Intended Marriage is given. The FAQs on Subclass 300 requirements, how to get married in Australia and the Notice of Intended Marriage explain the steps.
Same-sex couples who want to sponsor partner from Georgia
Same-sex couples can sponsor partner from Georgia under Australian law as de facto partners, or as spouses if they married in a country where same-sex marriage is lawful. Georgian law does not provide for same-sex marriage: Article 1106 of the Civil Code defines marriage as a union of a woman and a man.
For same-sex couples who sponsor partner from Georgia, Australian Government travel advice states that same-sex relationships are legal in Georgia but not widely accepted. Couples may have less public evidence of their relationship in Georgia, and that should be explained in the relationship statement. Registering the relationship in an Australian State or Territory can satisfy the exception to the 12 month de facto requirement. The firm's page on LGBTI partner visas and the FAQ on registering a de facto relationship for a partner visa explain the options.
Georgian civil documents and the Public Service Development Agency
To sponsor partner from Georgia, the Georgian partner usually provides a passport, a birth certificate, the marriage certificate if married, and divorce documents for any earlier marriage. Georgian birth, marriage and divorce certificates are issued by the Public Service Development Agency of the Ministry of Justice.
United States Government guidance states that birth certificates, marriage certificates and divorce certificates are each issued by Public Service Development Agency offices, that certified copies are available, and that authenticity can be checked online. Applications for registration and duplicate certificates are made through Public Service Hall offices. A divorce certificate is needed for every earlier marriage of the Georgian partner. The guide on a partner visa after divorce explains how earlier marriages are treated.
Do Georgian documents need an apostille?
Georgia issues apostilles, and United States Government guidance lists the Public Service Development Agency among the bodies that can apostille certified copies. An apostille is not normally needed when you sponsor partner from Georgia, because applications are lodged online with clear colour scans. The Department may ask to see originals or verify a document. The guide on the partner visa document checklist explains what is usually provided.
Children from Georgia
If you sponsor partner from Georgia and the Georgian partner has children who will migrate, their birth certificates and evidence of custody are needed. If the other parent remains in Georgia, the Department will usually ask for consent or a court order. The guides on adding children to a partner visa and child custody and consent explain the requirements.
Translating Georgian documents
Every Georgian document in Georgian script must be accompanied by an English translation. Georgian uses its own alphabet, so names on Georgian documents must be transliterated into English letters, and transliteration can vary between documents.
United States Government guidance notes that the Georgian electronic identity card contains information in both Georgian and English. Couples who sponsor partner from Georgia should use the English spelling on the passport as the reference spelling, and ask the translator to note it. Where a name is spelled differently on different documents, the difference should be explained at lodgement. The guide on partner visa evidence translation and the FAQ on different names or dates in documents explain how to deal with this.
In Australia, translations are commonly prepared by a NAATI accredited translator. Outside Australia, translators should provide their full name, address, telephone number and qualifications. The FAQ on translating a marriage certificate explains the practical steps.

The Georgian police certificate
The Georgian police certificate is issued by the Service Agency of the Ministry of Internal Affairs of Georgia. Canadian Government guidance calls the document a Certificate of Conviction. United States Government guidance describes two certificates that together show a full criminal history: a Certificate of Conviction and a Certificate of Expungement and Cancellation of Conviction.
For couples who sponsor partner from Georgia, the process matters. According to the United States guidance, the applicant applies in person at a Service Agency office with a written request and a passport or identity card, and offices are located in most cities in Georgia. According to the Canadian guidance, a person outside Georgia can write to the Ministry of Internal Affairs or authorise a relative or friend in Georgia to apply on their behalf. The certificate will be in Georgian and must be translated.
The Department of Home Affairs generally asks for a police certificate from each country where the applicant has spent 12 months or more in total in the last 10 years since turning 16. If the Georgian partner has lived in Russia, Türkiye, Germany or another country for that long, a police certificate from that country is needed too. When you sponsor partner from Georgia, police certificates should be obtained close to the time the Department asks for them, because they have a limited validity period. The guides on overseas police certificates, expired police checks and the partner visa character requirements explain timing and character issues.
Where visa services are handled for Georgian applicants
There is no Australian embassy or consulate in Georgia. Australian Government travel advice states that consular assistance for Australians in Georgia is provided by the Australian Embassy in Türkiye, in Ankara. This does not prevent anyone from applying, because partner visas and sponsorships are lodged online.
For couples who sponsor partner from Georgia, the practical effects are about biometrics and health examinations. If the Department asks the Georgian partner for biometrics, the request names the collection location, which may be outside Georgia. Health examinations are done with a panel physician approved by the Department. The guides on partner visa biometrics, partner visa health requirements and the partner visa online application explain each step.
Relationship evidence to sponsor partner from Georgia
The Department assesses four aspects of every relationship: financial aspects, the nature of the household, social aspects and the nature of the commitment. Couples who sponsor partner from Georgia should address each aspect with evidence, and should explain in the relationship statement any aspect where evidence is limited because they have lived in different countries.
Financial aspects
Money transfers, shared payment of travel and accommodation, joint bank accounts and plans for shared finances are relevant. The Tribunal considered joint bank statements, evidence of communication and periods of living together in Feng (Migration) [2025] ARTA 2425, and remitted the matter. The guides on partner visa financial aspects and joint bank account evidence explain what helps.
Nature of the household
When you sponsor partner from Georgia, periods of living together in Georgia or Australia, shared leases, utility accounts and how household tasks are shared are relevant. The guide on partner visa household evidence explains this aspect.
Social aspects
Georgian family life is close, and family involvement in a relationship is common. Evidence that the sponsor has met the Georgian partner's family, celebrations attended together and Form 888 statements from friends and relatives are all relevant. The guides on partner visa social evidence, Form 888 statements and who can sign Form 888 explain how to gather this evidence. The FAQ on statements from overseas friends explains whether Georgian friends can give statements.
Nature of the commitment
For couples who sponsor partner from Georgia across two countries, visits, ongoing communication, knowledge of each other's circumstances and long term plans show commitment. The guides on long distance relationships, photo evidence and how much evidence is needed explain what to provide.
The relationship statement
There is one relationship statement when you sponsor partner from Georgia. It should be written in the couple's own words, in English or translated, and should tell the story of the relationship from first contact to now, including how the couple met, any age difference, visits, the wedding or decision to live together, and plans for Australia. The guide on the partner visa relationship statement explains its structure, and the guide on organising partner visa evidence explains how to present the supporting documents.
English language and the Georgian partner
There is no English language test when you sponsor partner from Georgia on a partner visa. A Georgian partner who does not speak English can still be granted the visa. The FAQ on the English requirement for a partner visa and the guide on partner visa English requirements explain the position.
Government charges to sponsor partner from Georgia
At the time of writing, the Department of Home Affairs visa application charge for the main applicant for a partner visa is AUD 11,710 for the 2026 to 2027 financial year. This applies to the Subclass 309 and 100 pathway and the Subclass 820 and 801 pathway. Additional charges apply for any children included in the application.
Couples who sponsor partner from Georgia also pay for the Georgian police certificates, translations from Georgian, health examinations and any biometrics travel. If a refusal is reviewed, the Administrative Review Tribunal application fee for a partner visa review is AUD 3,727 at the time of writing. The guides on partner visa cost and Subclass 820 visa cost explain how the charges apply.
Review rights if a Georgian partner visa is refused
Most partner visa refusals can be reviewed by the Administrative Review Tribunal, but the time limits are short and strictly applied. If you sponsor partner from Georgia and a Subclass 309 is refused, the Georgian partner applies for review as the visa applicant, in their own name, and can do so from outside Australia. The time limit runs from when the refusal is taken to have been received. For an onshore Subclass 820 refusal, the review application must be made within 28 days.
On review, the Tribunal considers the evidence afresh, including new evidence. Detailed statements and further documents can therefore matter on review, as the reported issues in Magallanes illustrate. The FAQ on who applies for review of an offshore refusal, the guides on the ART review process and ART evidence, and the firm's page on partner visa refusals explain the next steps. Where a new application is a better option than review, the guide on reapplying after a refusal explains the considerations.
A practical checklist to sponsor partner from Georgia
Couples who sponsor partner from Georgia can avoid most delays by working in this order:
- Confirm the sponsor's eligibility, including any earlier sponsorships and police check issues.
- Choose the pathway before any visitor visa application, so that condition 8503 does not close off an onshore option the couple needs.
- Decide the basis of the application: registered marriage, de facto relationship or engagement.
- Obtain Georgian civil documents from the Public Service Development Agency, with certified copies where useful.
- Arrange translations from Georgian, with the passport spelling of names used throughout.
- Gather evidence of all four aspects, with a clear timeline of the relationship.
- Prepare one relationship statement and Form 888 statements from people in Australia and Georgia.
- Time the police certificates so that they are current when the Department asks for them.
The partner visa document checklist and the weak partner visa evidence guide help with the last steps.

Frequently Asked Questions
Is this guide about Georgia the country or the US state?
This guide is about Georgia the country, in the South Caucasus, with its capital in Tbilisi. It explains how an Australian citizen, permanent resident or eligible New Zealand citizen can sponsor a Georgian citizen for an Australian partner visa. A partner from the United States state of Georgia is a United States citizen, and different document, police certificate and visitor visa rules apply, including eligibility for an Electronic Travel Authority. The partner visa criteria themselves are the same.
Can my Georgian partner visit Australia on an ETA or eVisitor?
No. Georgian citizens are not eligible for an Electronic Travel Authority or an eVisitor. A Georgian partner who wants to visit Australia must apply in advance for a Subclass 600 Visitor visa, which is assessed on its own criteria, including whether the stay is genuinely temporary. If the visitor visa is granted with condition 8503, the partner cannot lodge an onshore Subclass 820 application unless the condition is waived, so the pathway should be decided first.
Can I sponsor partner from Georgia if there is a big age gap between us?
Yes. An age difference is not a ground for refusal, and the legal test is whether the relationship is genuine and continuing. An age gap may lead the Department to ask more questions, especially if the relationship is short or began online. Detailed evidence of how the relationship developed, family knowledge and acceptance, shared plans and shared finances, together with consistent statements from both partners, is the best answer to those questions.
We met online. Can I still sponsor partner from Georgia?
Yes. A relationship that began online can support a partner visa, because the Department assesses the relationship as it is now, not how it started. The evidence should show how the relationship moved from online contact to meeting in person and to a shared commitment. A clear timeline, a selection of communication records, evidence of visits, and Form 888 statements from people who know you both are usually the core of the evidence.
Is a Georgian church wedding enough for a spouse visa?
No. Under Article 1151 of the Civil Code of Georgia, only a marriage registered at the civil registry gives rise to spousal rights and obligations. A Georgian Orthodox Church ceremony is important social evidence, but a couple who has not registered the marriage should not apply as spouses on the strength of the church wedding alone. They may register the marriage, apply as de facto partners if eligible, or consider a Subclass 300 visa.
Where do Georgian marriage and birth certificates come from?
Georgian birth, marriage and divorce certificates are issued by the Public Service Development Agency of the Ministry of Justice, with applications made through Public Service Hall offices. United States Government guidance states that certified copies are available and that authenticity can be checked online through the agency's verification service. Each document in Georgian script needs an English translation, and names should match the English spelling on the passport.
What police certificate does my Georgian partner need?
The Georgian police certificate is issued by the Service Agency of the Ministry of Internal Affairs. United States Government guidance describes two certificates that together show a full criminal history: a Certificate of Conviction and a Certificate of Expungement and Cancellation of Conviction. Applications can be made in person in Georgia, and a person abroad can write to the Ministry or authorise someone in Georgia. The certificate is in Georgian and must be translated.
Is there an Australian embassy in Georgia?
No. Australia has no embassy or consulate in Georgia. Australian Government travel advice states that consular assistance for Australians in Georgia comes from the Australian Embassy in Türkiye, in Ankara. This does not affect lodgement, because partner visa applications and sponsorships are lodged online. It can affect biometrics, because a collection location named by the Department may be outside Georgia, so couples should allow time for travel.
Do Georgian documents need an apostille for an Australian partner visa?
Not usually. Partner visa applications are lodged online with clear colour scans of documents, and an apostille is not a standard requirement. Georgia does issue apostilles, and United States Government guidance lists the Public Service Development Agency among the bodies that can apostille certified copies. The Department may ask to see originals or may verify a document, so the originals should be kept safe and available throughout processing.
How should Georgian names be spelled in the application?
Use the English spelling on the Georgian partner's passport as the reference spelling throughout the application. Georgian has its own alphabet, so names are transliterated into English letters, and transliteration can vary between documents. Translators should be asked to use the passport spelling or note it. Where any document shows a different spelling, the difference should be explained at lodgement so that the Department does not treat it as an identity concern.
Can time living together in Georgia count as de facto time?
Yes. Time the couple lives together in Georgia can count towards the 12 month de facto relationship requirement, provided they have a mutual commitment to a shared life and the relationship is genuine and continuing. Australian passport holders can visit Georgia for up to 12 months without a visa, according to Australian Government travel advice. Keep records of the shared address, such as a lease or utility accounts, and evidence of daily life together.
My Georgian partner is in Australia on a student visa. Can we apply onshore?
Possibly. A Georgian partner on a student visa may be able to lodge a Subclass 820 application in Australia if the visa does not carry a no further stay condition, the application is made while the visa is in effect, and the section 48 bar does not apply. If the student visa has ended, the Schedule 3 criteria will usually apply. The visa conditions should be checked and advice obtained before the current visa ends.
Does my Georgian partner need to speak English?
No. There is no English language requirement for the grant of a partner visa, so a Georgian partner who does not speak English can still be granted the visa. The relationship statement should explain how the couple communicates, whether in English, Russian, Georgian or through translation. Any important messages or documents in Georgian or Russian that are relied on as evidence should be translated into English.
Can the Department interview us when I sponsor partner from Georgia?
Yes. The Department may interview the sponsor, the Georgian partner or both, usually by telephone or video. Questions often test knowledge of each other's lives, families, history and plans. Answers should be honest and consistent with the forms and the relationship statement. An interpreter can usually be requested if the Georgian partner is not comfortable in English, and the request should be made before the interview.
Who applies for review if my Georgian partner's Subclass 309 is refused?
The Georgian partner applies for review to the Administrative Review Tribunal as the visa applicant, in their own name, and can do so from outside Australia. The time limit is short and strictly applied, and it runs from when the refusal is taken to have been received. For an onshore Subclass 820 refusal, the review application must be made within 28 days. On review, the Tribunal considers the evidence afresh, including new evidence.
How much does it cost to sponsor partner from Georgia?
