Key Takeaways
- Yes. An Australian citizen, permanent resident or eligible New Zealand citizen can sponsor partner from Belize as a spouse, a de facto partner or a fiancé(e), provided the sponsorship is approved and the relationship is genuine and continuing.
- De facto couples usually need 12 months of de facto relationship immediately before applying. Time spent dating or in an online relationship might not count, but an Australian State or Territory relationship registration, or compelling and compassionate circumstances, can remove the requirement.
- Belizean citizens are not eligible for the eVisitor or the ETA, so a partner who wants to visit Australia usually needs a Visitor (Subclass 600) visa. The usual partner visa is the offshore Subclass 309.
- Home Affairs lists the Belize Police Department for police checks. Home Affairs lists no approved panel clinic in Belize, so the health examination must be done with a panel physician in another country.
- A first-time sponsor gives a legal undertaking about accommodation and financial support, consents to disclosure of relevant convictions, and uses one of only two lifetime partner sponsorships.
Australians who want to sponsor partner from Belize often meet the same first question: are we a de facto couple yet? A sponsor partner from Belize application can be made as spouses, as de facto partners or as an engaged couple, and for many couples the de facto pathway and its 12-month requirement decide when, and how, they can apply.
This guide is written for sponsors who are doing this for the first time. It explains the 12-month de facto requirement and each exception, how Belizean documents are treated, how the Belize police certificate is obtained, which visitor visa a Belizean partner needs, and why the health examination has to happen outside Belize. It then explains, in plain terms, what a sponsor partner from Belize undertaking means for the sponsor personally.
The complete guide to partner visas in Australia explains every subclass and stage. The commercial page on partner visa lawyers explains how My Migration Lawyers manages partner visa matters, and the page on the Subclass 309 partner visa explains the offshore visa most Belizean partners apply for.
Can an Australian sponsor partner from Belize as a de facto partner?
Yes. An Australian citizen, permanent resident or eligible New Zealand citizen can sponsor partner from Belize as a de facto partner, provided the couple meet the definition of a de facto relationship and, usually, have been in that relationship for at least 12 months immediately before applying.
A de facto relationship under the Migration Act 1958 is not simply a long relationship. The couple must have a mutual commitment to a shared life to the exclusion of all others, the relationship must be genuine and continuing, and they must live together or not live separately and apart on a permanent basis. They must not be related by family. The FAQ on the legal definition of a de facto relationship and the guide to the de facto partner visa in Australia explain each element.
Couples who sponsor partner from Belize are often in a long-distance relationship, because one partner lives in Australia and the other in Belize. A de facto relationship can exist during periods apart, but the couple must show that they have lived together and that any separation is temporary. The FAQ on boyfriend or girlfriend versus de facto partner explains where the line usually falls.
What does the 12-month requirement mean for a sponsor partner from Belize couple?
It means that de facto partners usually need to have been in a de facto relationship for at least 12 months immediately before the partner visa application is lodged. Home Affairs states that time spent dating or in an online relationship might not count.
For a sponsor partner from Belize couple, the important word is "de facto". The 12 months are counted from when the couple began a de facto relationship, not from when they first met, matched online or started dating. The FAQ on when the 12-month de facto period starts explains how the start date is identified, and the article on the Subclass 820 de facto 12 months rule explains how the Department checks it.
Living together is the usual starting point
In practice, a sponsor partner from Belize couple usually show the start of the de facto relationship through a period of living together, such as the sponsor spending months in Belize or the couple living together in a third country.
The Department looks at the whole relationship, not only the dates on a lease. Shared accommodation, shared expenses, the couple's own statements and statements from people who know them all help fix the start date. The FAQ on what counts as living together and the FAQ on living together overseas for 12 months explain what the Department accepts.
Time apart during the 12 months
Time apart does not automatically break the 12 months. A couple who lived together, then spent periods apart because of work, visas or family, can still be in a de facto relationship throughout, if the commitment continued and the separation was temporary.
The FAQ on time apart and the 12-month de facto period and the guide to partner visas without living together explain how those periods are treated. The guide to the partner visa long-distance relationship explains what evidence shows the relationship continued while the couple were apart.
Lodging too early
Lodging before the 12 months are complete, without an exception, is one of the most common reasons a de facto partner visa is refused. The criterion is assessed at the time of application, so later time together does not repair an early lodgement.
The FAQ on a de facto visa refused under the 12-month rule and the FAQ on applying before 12 months as de facto partners explain the consequences and the options. The article on the partner visa minimum relationship length explains why there is no minimum for married couples.
Couples who met online
Many couples who sponsor partner from Belize met online. Meeting online is not a problem in itself. The issue is that the online stage of the relationship usually does not count towards the 12 months.
For a sponsor partner from Belize couple who met online, the de facto relationship usually starts once the couple met in person and began living together, or otherwise committed to a shared life in a way that the evidence can show. The FAQ on a de facto visa where the couple met online and the guide to partner visas for couples who met online explain how these relationships are assessed.
What are the exceptions to the 12-month requirement?
There are four. The 12-month requirement does not apply if the relationship is registered with an Australian State or Territory authority, if compelling and compassionate circumstances exist, or in two situations involving permanent humanitarian visas.
Home Affairs describes the exceptions in these terms:
- Australian relationship registration. The couple have registered their relationship with an Australian State or Territory authority, such as a registry of births, deaths and marriages.
- Compelling and compassionate circumstances. The applicant can show compelling and compassionate circumstances for the grant of the visa.
- Sponsor with a permanent humanitarian visa. The de facto partner holds or held a permanent humanitarian visa and told the Department about the relationship before that visa was granted.
- Partner applying for a permanent humanitarian visa. The applicant is in a de facto relationship with a partner who is an applicant for a permanent humanitarian visa.
For most couples who sponsor partner from Belize, only the first two are relevant.
Registering the relationship in Australia
A sponsor partner from Belize couple may be able to register their relationship in an Australian State or Territory, even while the partner lives overseas, depending on the register's rules. Relationship registers exist in New South Wales, Victoria, Queensland, South Australia, Tasmania and the Australian Capital Territory. Western Australia and the Northern Territory do not have one.
Registers generally require at least one partner to live in that State or Territory, and both partners usually sign. Some registers require signatures to be witnessed in a particular way, which can be harder to arrange from Belize. Registration generally needs to be in place before the visa application is lodged. The FAQ on registering a relationship when the partner is overseas, the FAQ on registering a de facto relationship for a partner visa and the FAQ on where to register a relationship in Australia explain the practical steps.
A registration made outside Australia does not count. The FAQ on overseas registered relationships explains why. An Australian registration also does not prove the relationship is genuine. It removes the 12-month requirement and nothing more.
Compelling and compassionate circumstances
Compelling and compassionate circumstances are assessed case by case. A couple who rely on this exception should expect to explain, with evidence, why it would be unreasonable to require them to wait until they have 12 months of de facto relationship.
Circumstances that couples commonly raise include having a child together. Each case is assessed on its own facts, and there is no list that guarantees the exception will apply. The guide to partner visa compelling and compassionate circumstances and the FAQ on compelling and compassionate circumstances for a partner visa explain how the exception is argued. The FAQ on having a child together explains how a child affects the application.
Spouse, de facto partner or fiancé(e): which basis fits?
The right basis depends on the couple's situation today. Married couples apply as spouses and do not need 12 months of de facto relationship. Unmarried couples apply as de facto partners. Engaged couples who intend to marry in Australia can consider the Subclass 300.
Some couples who sponsor partner from Belize choose to marry rather than wait for 12 months of de facto relationship. A marriage is recognised in Australia if it was valid where it took place and is not a marriage Australian law refuses to recognise. The guide to whether an overseas marriage is recognised in Australia explains the test. Marriage should never be entered into only to obtain a visa, and the relationship must still be genuine. The FAQ on spouse versus de facto visas explains the choice.
Engaged couples can consider the Subclass 300 prospective marriage visa. The couple must have met in person and intend to marry within the visa period. The FAQ on the fiancé visa versus the partner visa compares the two.
A simple timeline for a sponsor partner from Belize de facto couple
A typical sponsor partner from Belize de facto application follows a predictable order. Planning it in advance avoids lodging too early and avoids documents expiring before the decision.
- Fix the start date. Identify when the de facto relationship began, using the evidence of living together, and work out when 12 months will be complete.
- Decide on an exception. If waiting is not practical, check whether an Australian registration or compelling and compassionate circumstances are available.
- Prepare the sponsor. Confirm the sponsor's status, past sponsorships and police check position.
- Collect documents. Passport, birth certificate, any previous marriage records and the Belize police record.
- Build the evidence. Shared accommodation, finances, travel, communication and social recognition across the whole relationship.
- Lodge, then plan the health examination. Arrange the examination outside Belize when the timing is right.
The guide to which partner visa pathway fits and the partner visa document checklist help couples who sponsor partner from Belize keep each step in order.
Which visitor visa does a partner from Belize need to visit Australia?
A Belizean partner usually needs a Visitor (Subclass 600) visa to visit Australia, and this is the first visa question in most sponsor partner from Belize matters. Belize is not on the eligible passport lists for the eVisitor (Subclass 651) or the Electronic Travel Authority (Subclass 601).
The Visitor visa is assessed on its own merits. A partner visa application does not entitle the partner to a visitor visa, and a visitor visa is granted for a genuine visit. The FAQ on visitor visas for spouses and the guide to visitor visas during partner visa processing explain how the Department approaches these applications.
For a sponsor partner from Belize couple, the visitor visa matters for two reasons. Time together in Australia builds the relationship evidence and can help with the 12-month requirement. The visitor visa can also be the visa held if the couple later decide to lodge an onshore Subclass 820.
Condition 8503 and onshore applications
If a Visitor visa is granted with condition 8503 "No Further Stay", the partner generally cannot apply for a Subclass 820 in Australia unless a waiver is first approved. Home Affairs states that a waiver must be approved before the application can be made.
Every grant notice should be read carefully. The FAQ on condition 8503 and partner visas and the guide to requesting an 8503 waiver explain the rules. The FAQ on a partner visa on a tourist visa explains when an onshore application may be possible.
Subclass 309 or Subclass 820 for a sponsor partner from Belize application?
The usual pathway for a sponsor partner from Belize application is the offshore Subclass 309, which leads to the permanent Subclass 100. The onshore Subclass 820 is possible only if the partner is in Australia on a visa that allows a further application.
Home Affairs states that the Subclass 309 applicant must be outside Australia when applying, and may be in or outside Australia when the temporary visa is decided. The Subclass 820 applicant must be in Australia when applying. The visa application charge is AUD 11,710 from 1 July 2026 for either combined application.
The comparison of onshore and offshore partner visas, the FAQ on Subclass 820 versus Subclass 309 and the page on the Subclass 820 partner visa explain the trade-offs. The guide to the offshore partner visa explains the Subclass 309 process from lodgement to grant.
When an onshore application can work
An onshore sponsor partner from Belize application can work where the partner is already in Australia on a substantive visa without condition 8503, the couple meet the relationship requirements on the day of lodgement, and the application is lodged before that visa expires.
Home Affairs states that an onshore applicant who held a valid substantive visa when applying is granted a Bridging visa A, which starts if the current visa expires. That allows the partner to remain lawfully in Australia during processing. Couples who sponsor partner from Belize should not assume this is available without checking the visa grant first. The guide to moving from a tourist visa to a partner visa and the guide to the partner visa bridging visa explain the steps and the risks.
Australia's mission for Belize
The Department of Foreign Affairs and Trade states that the Australian High Commission in Trinidad and Tobago is responsible for Belize. That is a diplomatic and consular arrangement, not a visa office.
Home Affairs states that applicants do not need to attend an Australian embassy, high commission or consulate to apply for a visa. A sponsor partner from Belize application is lodged online through ImmiAccount. The guide to creating an ImmiAccount and the article on the partner visa online application explain the process.
How does a partner in Belize get a police certificate?
A partner in Belize obtains a police record from the Belize Police Department. Home Affairs lists the Belize Police Department for police checks, and the Department's website offers a police record form and an online application.
Every partner visa applicant aged 16 or over must meet the character requirement. In a sponsor partner from Belize application, the partner usually needs a police certificate from Belize and from every other country where the partner has spent a total of 12 months or more in the last 10 years. The guide to overseas police certificates for partner visas and the FAQ on police checks for partner visas explain the rule.
Police certificates are generally treated as valid for 12 months, and Home Affairs advises checking processing times before obtaining them. The FAQ on how long police certificates and health checks remain valid explains why timing matters. Where a certificate cannot be obtained despite genuine efforts, the FAQ on what to do if a police certificate cannot be obtained explains the options.
Convictions and character
A conviction does not automatically end a sponsor partner from Belize application, but it must be declared and is assessed against the character requirement in section 501 of the Migration Act 1958. Home Affairs requires applicants to declare all criminal conduct they have been convicted of, or charged with and awaiting legal action, in any country.
The guides on partner visa character requirements and overseas convictions explain the assessment. The Department may also ask for Form 80, which the guide to Form 80 for a partner visa explains.
Visits to Belize by the sponsor
Many sponsors spend extended periods in Belize with their partner. Those visits are often the core of a sponsor partner from Belize application, because they show the couple living together.
Sponsors should keep boarding passes, passport stamps, accommodation records and any shared rental documents from each visit. Sponsors should also read the current Smartraveller advice for Belize before travelling. The FAQ on travel together as evidence explains what to keep.
Do Belizean documents need to be translated?
Usually not. English is the official language of Belize, so most Belizean civil documents and the Belize police record are issued in English and can be provided as they are. Any document that is not in English must be provided with an English translation.
That is a practical advantage for a sponsor partner from Belize couple. It removes a cost and a delay that couples from many other countries face. Some evidence may still be in Spanish or Kriol, such as messages, social media posts or statements from relatives. Where that evidence is relied on, a translation should be provided.
Home Affairs states that translators in Australia must be accredited by the National Accreditation Authority for Translators and Interpreters (NAATI). Translators outside Australia do not have to be accredited, but each translation must include the translator's full name, address, telephone number and qualifications and experience in the language, in English. The guide to partner visa evidence translation and the FAQ on translating messages for a partner visa explain the rules.
Scanning and uploading
Home Affairs states that documents do not need to be certified for a partner visa application. They must be scanned or photographed in colour, clear enough to read, and a document with more than one page should be saved as one file.
For a sponsor partner from Belize application, that means the partner can usually scan birth certificates, any marriage or divorce records and the police record directly. The FAQ on certified copies for a partner visa and the guide to ImmiAccount uploads explain how to organise the files.
Identity and civil documents from Belize
A sponsor partner from Belize application needs the partner's passport, birth certificate and evidence that any previous marriage or relationship has ended. Names and dates of birth should match across every document.
Where a name differs between documents, for example after a marriage or because of a spelling difference, the difference should be explained. The FAQ on different names and dates across documents explains how the Department treats inconsistencies. Where a partner was previously married, divorce records should be included. The guide to partner visas after divorce and the FAQ on what to do if a birth or marriage certificate cannot be obtained explain what to provide.
Why does a partner from Belize need a health examination in another country?
Because Home Affairs lists no approved panel clinic in Belize. Home Affairs states that where there is no approved panel clinic in a country, an applicant who needs an immigration medical examination must see an approved panel physician located in another country.
This is a practical step that a sponsor partner from Belize couple should plan early. The partner will need to travel, arrange accommodation and allow time for any further tests. Health examinations must be done by a Home Affairs approved panel physician, and a general doctor's report is not accepted. The guides on the partner visa medical examination and partner visa health requirements explain what is tested.
Home Affairs advises checking visa processing times before completing health examinations, because the results are valid for a limited period. A trip arranged too early may need to be repeated. The FAQ on medical examinations for a partner visa explains how the examination is booked.
Biometrics
Belize is not on the Home Affairs list of countries with an Australian Biometrics Collection Centre. If the Department asks for biometrics, its letter will say whether the partner must attend a centre in person or can use the Australian Immi App. Home Affairs states that applicants may need to travel to another country to attend a centre. The Home Affairs list includes centres in Mexico.
Where both a health examination and biometrics are needed, a sponsor partner from Belize couple may be able to plan one trip that covers both, depending on the timing of the Department's requests. The article on partner visa biometrics explains the process.

What does a first-time sponsor agree to when they sponsor partner from Belize?
A first-time sponsor who decides to sponsor partner from Belize agrees to support the partner, consents to the disclosure of certain convictions, and uses one of a limited number of lifetime partner sponsorships. Each of these has legal consequences that should be understood before the sponsorship is lodged.
The sponsorship is lodged online as a separate application and linked to the partner's visa application. The article on partner visa sponsorship lodgement explains how the two fit together, and the guide to partner visa sponsor requirements lists every requirement.
The sponsorship undertaking
The sponsor undertakes to make sure adequate accommodation is available to the partner and to provide financial assistance for the partner's reasonable living needs, if the partner cannot meet them from their own resources. The undertaking runs for the initial period stated in it.
For anyone who wants to sponsor partner from Belize, this is a real commitment, but it is not a duty to pay for everything, and there is no fixed minimum income for sponsors. The guides on partner visa sponsor obligations and the sponsor undertaking explain the terms, and the FAQ on a minimum income for sponsors explains why there is no income threshold. The FAQ on sponsors receiving Centrelink payments deals with sponsors on income support.
Consent to disclosure and police checks
Every sponsor partner from Belize sponsorship requires the sponsor to consent to the Department disclosing any relevant conviction to the partner. Under regulation 1.20KC of the Migration Regulations 1994, the Department may also ask the sponsor for Australian and overseas police checks.
Relevant offences include offences involving violence, harassment, stalking, the breach of an apprehended violence order or similar order, and certain other serious offences. A sponsor with a significant criminal record for a relevant offence faces refusal of the sponsorship unless approval is reasonable. The guides on the partner visa sponsor police check and partner visa sponsor relevant offences explain the rules. Where the partner has a child under 18 who is included in the application, regulation 1.20KB adds further checks.
What sponsoring now means for future sponsorship
A person can have no more than two approved partner sponsorships in a lifetime, and generally cannot be approved for a new sponsorship within five years of the first visa application they sponsored. A waiver is possible in compelling circumstances.
For a first-time sponsor, that means the sponsor partner from Belize application uses one of those two sponsorships, and starts a five-year period during which a further partner sponsorship would generally not be approved. The page on partner visa sponsorship limitations and the guide to when a sponsor cannot sponsor a partner visa explain the limits.
If the relationship ends
A sponsor can withdraw the sponsorship before the permanent visa is decided, and can notify the Department if the relationship ends. Once the permanent visa is granted, the sponsor cannot cancel it.
Withdrawal does not automatically end the partner's application in every case. The partner may have a pathway to permanent residence where there was family violence by the sponsor, where there is a child of the relationship with formal arrangements, or where the sponsor has died. The FAQ on a sponsor withdrawing sponsorship and the page on family violence and partner visas explain those situations.
What evidence proves a de facto relationship with a partner in Belize?
The Department looks at four areas: financial aspects, the nature of the household, social aspects and the nature of the commitment. For a de facto sponsor partner from Belize couple, household evidence from the period of living together usually carries the most weight.
Useful evidence often includes:
- Shared accommodation. Leases, rental agreements, letters from landlords or hosts, and bills or correspondence showing both partners at the same address. The guide to household evidence explains what helps.
- Financial links. Money transfers, shared expenses and any joint accounts. The FAQ on money transfers as relationship evidence and the guide to partner visas without a joint bank account explain how the Department views finances.
- Travel. Boarding passes, passport stamps and accommodation for each visit. The article on partner visa travel evidence explains how visits are presented.
- Communication. A representative sample across the whole relationship. The guide to partner visa chat evidence explains what to include.
- Social recognition. Form 888 statements from Australian citizens or permanent residents who know the couple, and statements from family and friends in Belize. The article on Form 888 for a partner visa explains who can sign.
In a sponsor partner from Belize application, each partner also writes a relationship statement. The guide to relationship statements for a partner visa explains what the statements should cover, including the date the couple consider their de facto relationship began. The guide to the partner visa relationship timeline explains how a timeline supports that date.
Refusals and review for a sponsor partner from Belize application
A sponsor partner from Belize application is usually refused because the Department is not satisfied the relationship is genuine and continuing, because the 12-month de facto requirement is not met, or because the sponsorship is not approved.
A Subclass 309 or Subclass 300 refusal can be reviewed by the Administrative Review Tribunal (ART). For a Subclass 309 refusal, the visa applicant applies for review in their own name under regulation 4.02(5)(raa) of the Migration Regulations 1994, not the Australian sponsor. For a Subclass 300 refusal, the Australian sponsor applies. The deadline is 28 days after the applicant is notified of the decision. The ART fee is AUD 3,727 from 1 July 2026, and half is refunded if the Tribunal sets aside, varies or remits the decision. The FAQ on who applies for review of an offshore refusal, the guide to the partner visa ART review process and the commercial page on partner visa refusals explain the next steps.
Tribunal decisions on relationship evidence
Published Tribunal decisions show how relationship evidence is weighed. Each case turns on its own facts. None of the following decisions is connected with Belize, and each is described only by the issues recorded for it.
- Nasser (Migration) [2025] ARTA 346. A Subclass 309 refusal where the parties were validly married and the sponsor had transferred significant amounts of money to the visa applicant over five years. The matter was remitted, which means it was sent back to the Department for reconsideration.
- Belevski (Migration) [2025] ARTA 394. A Subclass 309 refusal where an application with a previous partner had been refused and that relationship had ceased, involving the genuine and continuing relationship, a valid marriage, and the review applicant's family commitments and fear of flying. The matter was remitted to the Department.
- Ahmed (Migration) [2024] AATA 2096. A Subclass 309 refusal involving a traditional marriage arranged by parents and registered in the home country, delay in processing and a long separation. The matter was remitted to the Department.
Together, these decisions are a reminder that the Tribunal looks at the whole of the evidence, including financial support over time, family commitments and periods of separation, rather than any single factor. The guide to partner visa ART evidence explains how new evidence is presented on review.
Mistakes first-time sponsors make
Most mistakes in a first sponsor partner from Belize application come from not knowing the rules, not from a weak relationship. Australians who sponsor partner from Belize for the first time can avoid most of them by checking each point below before lodging.
- Counting the 12 months from the first date. The period runs from the start of the de facto relationship, not from when the couple met.
- Assuming an overseas registration counts. Only an Australian State or Territory registration removes the 12-month requirement.
- Booking the health examination too early. Results expire, and the trip outside Belize may need to be repeated.
- Not reading the visitor visa grant. Condition 8503 can rule out an onshore application.
- Signing the undertaking without reading it. The sponsor's commitment and the effect on future sponsorship should be understood first.
- Lodging without evidence. An application lodged with little or no supporting evidence is exposed to refusal.
The article on partner visa application mistakes and the guide to why partner visas get refused explain other common errors. The FAQ on having a lawyer check a partner visa before lodging explains what a pre-lodgement review covers.
Can children be included when you sponsor partner from Belize?
Yes. A partner's dependent children can usually be included in the same application, provided they meet the definition of a dependent child and the health and character requirements.
Each child needs a birth certificate and identity documents. Children aged 16 or over need their own police certificates. Where a child will move to Australia without the other parent, the other parent's consent or a court order is usually needed. Children will also need health examinations, which in a sponsor partner from Belize application means travel to a panel physician outside Belize. The guide to adding children to a partner visa and the FAQ on the other parent's consent explain the requirements.
What happens after the Subclass 309 is granted?
After the Subclass 309 is granted, the partner can travel to Australia and live, work and study here while the permanent Subclass 100 is assessed. The sponsor partner from Belize process then moves to its second stage.
The permanent stage is generally assessed about two years after the combined application was lodged. The couple provide updated evidence that the relationship continues, and the sponsor's undertaking continues for its stated period. The article on the partner visa two-stage process and the article on arriving in Australia on a partner visa explain what to expect, including the first entry date on the visa.
How My Migration Lawyers helps first-time sponsors who sponsor partner from Belize
When Australians sponsor partner from Belize, they are often doing something new. My Migration Lawyers acts for many Australian sponsors whose partners live overseas, including partners from Central America and the Caribbean, and regularly advises first-time sponsors who have never dealt with the partner visa system. The firm deals with complex partner visa cases and is capable of handling de facto applications where the 12-month requirement, an exception or a long-distance relationship is in issue.
On a sponsor partner from Belize matter, the firm's work usually includes:
- Assessing the relationship basis. Advising whether the couple apply as spouses, de facto partners or under the Subclass 300, and when the 12-month de facto period is likely to be met.
- Testing the exceptions. Checking whether an Australian relationship registration is available and practical, or whether compelling and compassionate circumstances can be shown.
- Explaining the undertaking. Taking the first-time sponsor through the undertaking, consent to disclosure, police checks and the effect on any future sponsorship before anything is signed.
- Planning the documents. Arranging the Belize police record, any other police certificates, and the timing of the health examination and biometrics outside Belize.
- Presenting the evidence. Organising the couple's own account and documents across the four areas the Department assesses. The couple review and correct their statements before anything is lodged.
- Responding and reviewing. Answering requests for information and acting on Tribunal review if the application is refused.
The firm's Principal Lawyer, Weiwei Zhang, oversees partner visa matters. Frequently Asked Questions
Can I sponsor partner from Belize if we are not married?
Yes. An Australian citizen, permanent resident or eligible New Zealand citizen can sponsor partner from Belize as a de facto partner. The couple must have a mutual commitment to a shared life to the exclusion of all others, a genuine and continuing relationship, and must live together or not live separately and apart permanently. De facto partners usually also need to have been in a de facto relationship for at least 12 months immediately before applying, unless an exception applies.
When does the 12-month de facto period start?
It starts when the couple began a de facto relationship, not when they first met or started dating. Home Affairs states that time spent dating or in an online relationship might not count. For many couples, the start is shown by a period of living together, supported by leases, bills, travel records and the couple's own statements. The requirement is assessed at the time the application is lodged, so later time together does not fix an application lodged too early.
Can we apply before we have been de facto for 12 months?
Only if an exception applies. The 12-month requirement does not apply if the relationship is registered with an Australian State or Territory authority, if compelling and compassionate circumstances exist, or in two situations involving permanent humanitarian visas. Otherwise, a de facto application lodged before the 12 months are complete is likely to be refused. Married couples are not subject to the 12-month requirement, and engaged couples may consider the Subclass 300 prospective marriage visa.
Can we register our relationship in Australia while my partner is in Belize?
Sometimes. Relationship registers exist in New South Wales, Victoria, Queensland, South Australia, Tasmania and the Australian Capital Territory, but not in Western Australia or the Northern Territory. Registers generally require at least one partner to live in that State or Territory, and both partners usually sign. Some require witnessed signatures, which can be harder to arrange from Belize. The registration generally needs to be in place before lodging, and it removes only the 12-month requirement.
Does a registration made in Belize remove the 12-month requirement?
No. The exception applies only to a relationship registered with an Australian State or Territory authority. A registration, civil union or similar status made outside Australia does not remove the 12-month de facto requirement, although it can still be useful evidence of commitment. A couple who cannot rely on an Australian registration must show 12 months of de facto relationship, show compelling and compassionate circumstances, or apply on another basis, such as marriage.
Which visitor visa does my Belizean partner need?
Usually a Visitor (Subclass 600) visa. Belize is not on the eligible passport lists for the eVisitor (Subclass 651) or the Electronic Travel Authority (Subclass 601). A Visitor visa is assessed on its own merits and is granted for a genuine visit. If it is granted with condition 8503 "No Further Stay", the partner generally cannot apply for an onshore Subclass 820 without first obtaining a waiver, so the grant notice should be read carefully.
How does my partner get a police certificate in Belize?
Through the Belize Police Department. Home Affairs lists the Belize Police Department for police checks, and the Department's website offers a police record form and an online application. The partner needs a police certificate from Belize and from every other country where the partner has spent a total of 12 months or more in the last 10 years. Certificates are generally treated as valid for 12 months, so the timing should be planned against processing times.
Do Belizean documents need to be translated?
Usually not. English is the official language of Belize, so most civil documents and the police record are issued in English and can be provided as they are. Any document or evidence that is not in English, such as messages or statements in Spanish or Kriol, needs an English translation. Translators in Australia must be NAATI accredited. Translators outside Australia must include their name, contact details and language qualifications on each translation.
Where does a partner in Belize do the health examination?
In another country. Home Affairs lists no approved panel clinic in Belize, and states that an applicant who needs an immigration medical examination must see an approved panel physician located in another country. The partner should plan travel and accommodation, and allow time for any further tests. Home Affairs suggests checking processing times before completing health examinations, because the results are valid only for a limited period.
What am I promising when I sponsor partner from Belize?
The sponsor undertakes to make sure adequate accommodation is available to the partner and to provide financial assistance for the partner's reasonable living needs, if the partner cannot meet them from their own resources, for the initial period stated in the undertaking. The sponsor also consents to the disclosure of any relevant conviction to the partner. It is not a duty to pay for everything, and there is no fixed minimum income for sponsors.
Will sponsoring my partner affect whether I can sponsor again later?
Yes. A person can have no more than two approved partner sponsorships in a lifetime. A new partner sponsorship generally cannot be approved within five years of the first visa application the person sponsored. A waiver is possible in compelling circumstances. A first-time sponsor should understand that the current sponsorship uses one of the two, and starts a five-year period during which a further sponsorship would generally not be approved.
Do I need a police check as the sponsor?
Often, yes. Under regulation 1.20KC the Department may ask the sponsor for Australian and overseas police checks, and sponsors are commonly asked to provide them with the sponsorship. A sponsor who has spent 12 months or more in another country, including Belize, in the last 10 years since turning 16 may need that country's certificate too. Where the partner's child under 18 is included in the application, further checks under regulation 1.20KB apply.
Is there an Australian embassy in Belize?
No. The Department of Foreign Affairs and Trade states that the Australian High Commission in Trinidad and Tobago is responsible for Belize. That is a diplomatic and consular arrangement. It does not decide partner visas. Partner visa applications are lodged online through ImmiAccount and decided by the Department of Home Affairs, which states that applicants do not need to attend an embassy, high commission or consulate to apply.
What evidence proves our de facto relationship?
Evidence across four areas: finances, the household, social recognition and commitment. For couples who lived together in Belize or elsewhere, leases, bills and letters from landlords or hosts often carry the most weight for the household. Money transfers, travel records, a representative sample of messages, Form 888 statements from Australian citizens or permanent residents, and statements from family in Belize add to it. Each partner also writes a relationship statement.
Can I withdraw the sponsorship if we separate?
Yes, before the permanent visa is decided. A sponsor can withdraw the sponsorship and can notify the Department that the relationship has ended. Once the permanent visa is granted, the sponsor cannot cancel it. Withdrawal does not always end the partner's application, because the partner may still have a pathway where there was family violence by the sponsor, a child of the relationship with formal arrangements, or where the sponsor has died. Statements to the Department must be true.
What happens if the Subclass 309 is refused?
The refusal can usually be reviewed by the Administrative Review Tribunal. For a Subclass 309 refusal, the visa applicant applies for review in their own name, not the Australian sponsor, within 28 days after being notified of the decision. The ART fee is AUD 3,727 from 1 July 2026, and half is refunded if the Tribunal sets aside, varies or remits the decision. The Tribunal considers the matter afresh, so further evidence, including evidence of the de facto relationship, can be provided.
