Key Takeaways

  • Lodging a Subclass 866 Protection visa application does not cancel or suspend your Subclass 500 Student visa, and every condition on the student visa continues to apply until that visa ceases.
  • Breaching a student visa condition, such as the course requirements in condition 8202, can lead to cancellation of the student visa, and cancellation also ends the bridging visa granted with the protection visa application.
  • The Bridging visa A granted with the protection visa application comes into effect when the student visa ceases, and a Bridging visa A held by a protection visa applicant whose application is undecided cannot carry the no work condition.
  • A partner or dependent child on your student visa can be included in the protection visa application if they are in Australia, and can be added after lodgement on Form 1436 before a decision is made.
  • The practical risk for students is not the protection application itself but the gap between lodging and the student visa ceasing, when student visa conditions still apply.

Protection Visa 866 for International Students: What Changes When You Lodge

Protection Visa 866 for international students works differently from most people expect. When a student lodges a Subclass 866 Protection visa application, the student visa does not end. It continues, with all of its conditions, until it ceases in the ordinary way. For a period, you hold two visas: the Subclass 500 Student visa, which is in effect, and a Bridging visa A, which is granted but not yet in effect.

That overlap is where most problems arise. Students often assume that the protection application replaces the student visa, stop attending classes or work beyond their limit, and then face cancellation of the student visa. Cancellation has consequences for the protection application as well, because the bridging visa attached to it ceases.

This article explains what Protection Visa 866 for international students means in practice while the student visa is still running: the conditions that continue, the obligations to your education provider, the position of family members on your visa, and the risk of cancellation. The question of whether a student can apply at all, and the legal tests for protection, are covered in our article on whether international students can apply for a Subclass 866 Protection visa. For the visa itself, see our page on the Subclass 866 Protection visa.

Why Protection Visa 866 for International Students Is a Timing Question

Protection Visa 866 for international students is, above all, a question of timing. The same claims, lodged at different points in the life of a student visa, can leave a student in very different positions while the application is decided.

A student who lodges while the student visa is still in effect is generally granted a Bridging visa A. That bridging visa comes into effect when the student visa ceases and, for a protection visa applicant whose application is undecided, cannot carry the no work condition. A student who waits until the student visa has expired is already unlawful when they apply, and will generally be granted a Bridging visa E. For a protection visa applicant, a Bridging visa E must initially carry the no work condition unless the person falls within a specified class.

The difference can last for the whole period the application takes to decide. Lodging while lawful is therefore the safest course for a student with genuine protection claims. Lodging early does not mean lodging a thin application. Section 48A of the Migration Act 1958 generally prevents a further protection visa application after a refusal, so the first application must be complete. The balance between speed and completeness is one of the main reasons students seek advice on Protection Visa 866 for international students before they lodge. Our article on delaying a Subclass 866 application explains how delay affects both the claim and the bridging visa.

Your Student Visa Stays in Effect After You Lodge

The first rule of Protection Visa 866 for international students is that lodging a protection application changes nothing about the student visa on the day you lodge. It is not cancelled, suspended or varied.

A person who applies for a protection visa while holding a substantive visa is generally granted a Bridging visa A. Because the student visa is still in effect, the bridging visa does not come into effect until the student visa ceases. That usually happens when the student visa reaches its expiry date. It can also happen earlier if the student visa is cancelled.

The practical effect is simple. While the student visa is in effect, you are a student visa holder for every purpose. Your rights and obligations come from the student visa. The protection application sits alongside it, being assessed, but it does not give you any new permissions until the bridging visa comes into effect. Our guide to Bridging visa A explains how a bridging visa that is granted but not in effect operates.

This is the part of Protection Visa 866 for international students that deserves the most attention, because it is the period in which mistakes are most costly.

Protection Visa 866 for International Students and the Course Requirements

The most important student visa condition during the overlap is condition 8202, which deals with course requirements. In broad terms, it requires a student to remain enrolled in a registered course, and to maintain satisfactory attendance and satisfactory course progress. The precise obligations depend on the course and the provider.

Lodging a protection application does not suspend condition 8202. If you stop attending, fail to make satisfactory progress or withdraw from your course while the student visa is in effect, you risk breaching the condition. Education providers report enrolment changes and certain attendance and progress issues to the Department. A breach can then lead to a notice of intention to consider cancellation of the student visa under section 116 of the Migration Act 1958.

For a student with a pending protection application, that sequence is serious. As explained below, cancellation of the student visa also ends the Bridging visa A granted with the protection application. The student then becomes an unlawful non-citizen with an undecided protection application.

Protection Visa 866 for international students therefore requires planning around the course. If you cannot continue studying, for financial, health or safety reasons, obtain advice before you withdraw, stop attending or let your enrolment lapse. There may be options, such as a formal deferral or leave of absence approved by the provider, that avoid a breach. The right option depends on the provider's policies and your circumstances.

Work Limits While the Student Visa Continues

Condition 8105 limits the work a student visa holder can do. The limit continues while the student visa is in effect, even after a protection application is lodged. The number of hours and the periods to which the limit applies are set by the Department and can change, so check the current position on the Department's website or in VEVO.

Two points about work under Protection Visa 866 for international students are often misunderstood.

First, lodging a protection application does not give you unrestricted work rights while the student visa remains in effect. The Bridging visa A that would carry unrestricted work rights is not yet in effect. Working beyond the student visa limit is a breach of the student visa condition, and a breach can lead to cancellation.

Second, once the student visa ceases and the Bridging visa A comes into effect, the student visa work limitation ceases with the visa that carried it. Under clause 010.611 of the Migration Regulations 1994, a Bridging visa A held by a protection visa applicant whose application has not been finally determined cannot carry condition 8101, the no work condition. Our guide to bridging visas in Australia explains how work conditions differ between bridging visas.

Health Insurance, Address and Other Student Visa Conditions

Several other student visa conditions continue while the student visa is in effect. Each can lead to cancellation if it is breached, so each needs to be managed during the overlap.

  • Health insurance. Student visas generally carry condition 8501, which requires adequate arrangements for health insurance to be maintained while you are in Australia. Do not let Overseas Student Health Cover lapse on the assumption that the protection application replaces it.
  • Address and provider notifications. Student visas generally carry a condition requiring you to tell your education provider of your residential address, and of any change of provider, within a set period. Keep your address up to date with both the provider and the Department.
  • Continuing to meet the requirements of the visa. Some student visas carry condition 8516, which requires the holder to continue to satisfy the primary or secondary criteria that were satisfied when the visa was granted.
  • School-age dependants and welfare arrangements. Where a student visa holder has school-age dependants in Australia, or is under 18, further conditions about schooling and welfare arrangements may apply.

The conditions on your particular visa are listed in your grant notice and in VEVO. Any plan for Protection Visa 866 for international students should start with a check of those conditions, so that you know exactly which obligations continue during the overlap.

Should You Tell Your Education Provider About the Protection Application?

There is no general requirement for a student to tell an education provider that a protection visa application has been lodged. Your protection claims are personal information, and many students have good reasons for keeping them private, including fear that information may reach family members, sponsors or authorities at home.

The Department's guidelines reflect the sensitivity of protection information. When officers make enquiries of organisations in Australia to verify claims, the guidelines state that the enquiries should remain general in nature, must not breach the applicant's privacy, and that applicants' names must not be given to those organisations.

There are situations where some disclosure may help you. If you need to defer your studies or take leave because of events connected to your claims, the provider may ask for reasons. You can often explain those reasons in general terms, such as serious personal or family circumstances, without disclosing the protection application. If a scholarship or government sponsor is involved, obtain advice before speaking to the sponsor, because some sponsored students hold visas with particular conditions. Protection Visa 866 for international students is easier to manage when disclosure decisions are made deliberately rather than in a moment of pressure.

Protection Visa 866 for International Students With a Scholarship or Sponsor

Sponsored students need particular care. Students supported by a foreign government or by the Commonwealth may hold visas with conditions that differ from those of other students, and they may have contractual obligations to the sponsor.

Some sponsored student visas carry condition 8535, a no further stay condition. That condition includes an express exception for protection visas, so it does not prevent a Subclass 866 application. The sponsorship arrangement is a separate matter. A sponsor may require regular reporting, may withdraw support if studies stop, and in some cases may have connections to the government of the country from which the student is seeking protection.

For these students, Protection Visa 866 for international students involves decisions about what to tell the sponsor, when, and what happens to funding and enrolment if support is withdrawn. Those decisions should be made with advice, because the loss of sponsorship can affect enrolment, and enrolment affects compliance with the student visa conditions while that visa remains in effect. Our article on Indonesian students applying for a Subclass 866 Protection visa discusses sponsorship and disclosure issues in one country context.

When the Student Visa Ceases

When the student visa ceases, the Bridging visa A granted with the protection application comes into effect. From that moment, the conditions of the student visa no longer apply.

This is the point at which Protection Visa 866 for international students changes most. You no longer hold a student visa. The course requirements, the student work limitation and the student health insurance condition cease with the visa that carried them. Whether you continue studying becomes a practical and financial decision, and a matter for your provider's enrolment rules, rather than a visa obligation.

Other practical matters also change. The Department's Subclass 866 page advises applicants who have made a valid application to take their acknowledgement letter to a Medicare service centre to enrol, and states that applicants might be able to receive financial or other assistance through Status Resolution Support Services. Eligibility for each depends on your circumstances. The Department also states that you must tell it about changes such as a change of address or relationship status while the application is pending. Our guide to Form 1022 explains how changes are notified.

Travel is a serious risk throughout Protection Visa 866 for international students. Clause 866.411 of the Migration Regulations 1994 requires you to be in Australia when the protection visa is granted, and most bridging visas do not allow travel. Obtain advice before any travel plan, including travel you might have made as a student.

Family Members on Your Student Visa

If your partner or children are in Australia as secondary applicants on your student visa, they can be included in your protection visa application as members of your family unit. The Department states that members of the same family unit may apply together, provided they are in Australia at the time of application and eligible to apply. They do not need their own protection claims, but they must meet health, character and security requirements.

A partner or dependent child who was not included at lodgement can be added later, but only while the application is undecided and only if they are in Australia and eligible to apply. The Department states that the addition is made on Form 1436, with evidence of the relationship. A child born after lodgement and before the decision is taken to be included in the application, and the birth must be notified.

Under Protection Visa 866 for international students, family members also hold their own student visas while those visas remain in effect. Each family member's visa has its own conditions, including any work limitation, and those conditions continue until that visa ceases. A breach by a family member can put that family member's visa at risk. Protection Visa 866 for international students should therefore be planned for the whole family, not only for the student.

If a family member has claims of their own, they should be set out in the application. Every claim for the family should be made at the start, because section 48A of the Act generally prevents a further protection visa application after a refusal.

Cancellation Risk: The Issue That Matters Most

Cancellation of the student visa is the single largest risk in Protection Visa 866 for international students. If the student visa is cancelled while the protection application is pending, the Bridging visa A granted with the protection application ceases on that cancellation, whether or not it had come into effect.

The student then becomes an unlawful non-citizen with an undecided protection application. A Bridging visa E may then be granted. For a protection visa applicant, the Bridging visa E must initially carry condition 8101, the no work condition, unless the person falls within a specified class. The Department's guidance states that to obtain a further Bridging visa E without that condition, the applicant must show a compelling need to work and either an acceptable reason for the delay in applying for the protection visa or that they held a Bridging visa A or C with the protection application that has since ceased.

The cancellation process usually begins with a notice of intention to consider cancellation. That notice sets a short time to respond. If you have lodged a protection application and receive such a notice, treat it as urgent. A well-prepared response may prevent cancellation. If the visa is cancelled, review by the Administrative Review Tribunal may be available, subject to a short and strictly applied time limit. Our page on visa cancellations explains the process.

The Department's guidance also records that some applicants seek to have their own substantive visa cancelled, which cancels any associated bridging visa and leaves them unlawful with a Bridging visa E carrying a no work condition. Students should not ask for their student visa to be cancelled in the belief that it will produce work rights sooner. It generally produces the opposite result.

A Practical Checklist for the Overlap Period

Protection Visa 866 for international students is easiest to manage with a short checklist:

  • Confirm the conditions on your student visa and its expiry date in VEVO.
  • Keep attending classes and meeting course requirements until the student visa ceases, unless you have obtained advice and an approved deferral or leave.
  • Stay within the student visa work limit until the student visa ceases.
  • Keep health insurance and your address details current.
  • Include your partner and dependent children in the application if they are in Australia.
  • Respond immediately to any notice about your student visa.
  • Do not travel without advice.

Our guides to the protection visa documents checklist and the protection visa statement of claims cover what the application itself should contain. If the application is refused, our page on protection visa refusals explains review by the Administrative Review Tribunal.

Common Mistakes in Protection Visa 866 for International Students

Most problems in Protection Visa 866 for international students come from a small number of avoidable mistakes:

  • Treating the protection application as a replacement visa. The student visa and its conditions continue until the student visa ceases.
  • Withdrawing from the course without advice. A withdrawal reported by the provider can lead to cancellation of the student visa and the loss of the Bridging visa A.
  • Working beyond the student visa limit. Unrestricted work rights begin only when the Bridging visa A comes into effect.
  • Forgetting family members. A partner or child who is not included, and whose own student visa then expires, may be left without a pathway if they are not added in time.
  • Ignoring correspondence. A cancellation notice, a request for information or an interview invitation sent to an email address that is no longer checked can have permanent consequences.

Each of these mistakes can be avoided when Protection Visa 866 for international students is planned from the start. Our guides to protection visa interview preparation and evidence in a protection visa application cover the later stages.

Frequently Asked Questions

Can I stop studying once I have applied for a protection visa?

Not while your student visa is in effect. Lodging a protection visa application does not suspend the student visa conditions, including the course requirements in condition 8202. Stopping attendance or withdrawing from your course can lead to cancellation of the student visa, and cancellation also ends the bridging visa attached to your protection application. Once the student visa has ceased and the Bridging visa A is in effect, the student visa conditions no longer apply. Obtain advice before changing your enrolment.

Can I work full time after applying for a protection visa as a student?

Not until your student visa ceases. While the student visa is in effect, its work limitation continues to apply. The Bridging visa A granted with the protection application comes into effect when the student visa ceases. Under clause 010.611 of the Migration Regulations 1994, a Bridging visa A held by a protection visa applicant whose application is undecided cannot carry the no work condition. Check your current visa and its conditions in VEVO before changing your hours.

Will my university find out that I have applied for protection?

Not from the application itself in the ordinary course. There is no general requirement to tell your education provider, and the Department's guidelines state that enquiries officers make of organisations in Australia must remain general and must not disclose applicants' names. You may choose to explain personal circumstances to your provider if you need a deferral or leave, and you can often do so in general terms. Obtain advice first if you have a scholarship or government sponsor.

Can I include my partner who is on my student visa?

Yes. A partner or dependent child who is in Australia can be included as a member of your family unit in the protection visa application. They do not need their own claims, but they must meet health, character and security requirements. If they were not included when you lodged, the Department states that a spouse, de facto partner or dependent child can be added on Form 1436 while the application is undecided, provided they are in Australia and eligible to apply.

What should I do if I receive a notice about cancelling my student visa?

Treat it as urgent and obtain advice immediately. A notice of intention to consider cancellation sets a short time to respond. If your student visa is cancelled while your protection application is pending, the Bridging visa A attached to that application also ceases, and you may be left with a Bridging visa E that carries a no work condition. A prompt, well-prepared response is the best opportunity to prevent cancellation.
