Key Takeaways

  • Partner Visa Lawyers Adelaide are lawyers who take carriage of a Subclass 820, 801, 309, 100 or 300 partner visa matter for a couple living in Adelaide or regional South Australia, and My Migration Lawyers acts as Partner Visa Lawyers Adelaide for those couples by Zoom from its Sydney office.
  • Partner visa law is federal, the application is lodged online and the Department of Home Affairs decides it centrally, so a couple in Salisbury, Glenelg or Mount Gambier engages Partner Visa Lawyers Adelaide in exactly the same way as a couple in Sydney, and receives the same written advice, the same document checklist and the same lawyer.
  • The South Australian Relationships Register matters to Adelaide de facto couples because registration under the Relationships Register Act 2016 (SA) is one of the two exceptions to the twelve month de facto requirement in regulation 2.03A, and Partner Visa Lawyers Adelaide advise on registration before the application date is chosen.
  • Partner Visa Lawyers Adelaide earn their fee on the matters that carry a legal problem: an applicant on a bridging visa who must answer Schedule 3, a visitor visa with condition 8503, a sponsor who has sponsored before, a previous refusal or a relationship that has ended through family violence.
  • Weiwei Zhang, Principal Lawyer of My Migration Lawyers, is responsible for the firm's partner visa matters and for the advice, statements and submissions on each of them.

Partner Visa Lawyers Adelaide are lawyers who take carriage of a partner visa matter for a couple in Adelaide or regional South Australia and remain responsible for it until the Department of Home Affairs makes a decision. My Migration Lawyers acts as Partner Visa Lawyers Adelaide for married and de facto couples across the city and the State, on Subclass 820 and 801 applications made in Australia, Subclass 309 and 100 applications made from overseas and Subclass 300 Prospective Marriage visa applications.

The firm's office is in Sydney, at Level 1, 60 Martin Place, and it has no office in Adelaide. That fact is stated at the outset because a couple searching for Partner Visa Lawyers Adelaide deserve a straight answer about where the lawyer sits and why it does not affect the matter. The rest of this article explains what the firm does for an Adelaide couple at each stage, which local situations it sees most often, how the South Australian Relationships Register changes the timing of a de facto application, and how Weiwei Zhang, Principal Lawyer, leads the work.

The article is about the running of a matter. It is not a summary of partner visa law. The subclasses and criteria are described on the firm's partner visa service page, and a couple choosing between practitioners may also find the firm's article on choosing a partner visa lawyer in Adelaide useful.

Does a couple in Adelaide need Partner Visa Lawyers Adelaide to be in Adelaide?

No. A couple in Adelaide does not need Partner Visa Lawyers Adelaide to have an office in Adelaide, because nothing in a partner visa matter happens locally. The criteria are in the Migration Act 1958 and the Migration Regulations 1994, which are Commonwealth law and apply in South Australia exactly as they apply in New South Wales. The application is lodged through ImmiAccount. The Department processes partner visa applications through national processing arrangements, and no case officer is allocated by reference to the couple's postcode.

My Migration Lawyers conducts every consultation by Zoom, for every client, wherever the client lives. An applicant in Prospect and a sponsor working a shift at Port Adelaide can join the same consultation from different places. Documents move through the firm's secure client portal rather than across a reception desk. The letter of advice and the document checklist that follow the consultation are sent electronically. When the Department writes, the correspondence arrives at the firm and is dealt with the same day, whether the couple live in Norwood or in Newcastle. In practice, Partner Visa Lawyers Adelaide who work in this way are no further from the couple than a lawyer in Rundle Mall would be.

What an Adelaide couple should actually look for in Partner Visa Lawyers Adelaide is the volume and type of partner visa work the lawyer runs, whether the lawyer has handled the particular complication the couple face, and whether a named lawyer, rather than an unnamed team, will assess the matter and sign the advice. Those questions matter far more than the address. My Migration Lawyers answers them plainly: the firm acts as Partner Visa Lawyers Adelaide for couples in Salisbury, Mawson Lakes, Prospect, Norwood, Glenelg, Mount Barker, Murray Bridge and Mount Gambier, and Weiwei Zhang, Principal Lawyer, is the lawyer responsible.

Which Adelaide couples engage Partner Visa Lawyers Adelaide?

Adelaide couples engage Partner Visa Lawyers Adelaide when the applicant's visa history, the sponsor's history or the shape of the relationship raises a criterion that a careful couple cannot answer by themselves. The situations below are general descriptions of the kinds of matters the firm sees from South Australia. None of them is a client story.

The first is the international student. Adelaide has a large student population across its universities and vocational colleges, and many students form a relationship with an Australian citizen or permanent resident during their course. When the course ends and the student visa is close to expiry, the couple ask Partner Visa Lawyers Adelaide whether a Subclass 820 application can be lodged before the student visa ceases, what happens to work rights on the Bridging Visa A that follows, and whether a de facto relationship that began mid-course satisfies regulation 2.03A. The firm's guide to the Subclass 820 visa explains the onshore pathway that most of these couples follow.

The second is the visitor. A partner who has entered Australia on a visitor visa to be with a sponsor in Glenelg or Mount Barker often wants to stay and apply onshore. Partner Visa Lawyers Adelaide check the visa for condition 8503, because a no further stay condition prevents an onshore application unless it is waived under section 41(2A) of the Migration Act, and check whether the visitor's stated purpose at entry creates any risk under public interest criterion 4020. The firm's article on moving from a tourist visa to a partner visa in Australia sets out the sequence.

The third is the regional worker. The Riverland, Murray Bridge, the Limestone Coast around Mount Gambier and the Barossa all draw seasonal and skilled workers on temporary visas, and many of those workers form relationships with Australians in the towns where they work. Their matters raise questions about periods spent apart during harvest or contract work, about accommodation supplied by an employer rather than shared with the partner, and about how the nature of the household is evidenced when the couple have lived in more than one town. Partner Visa Lawyers Adelaide explain those facts honestly rather than forcing them into a suburban template.

The fourth is the couple separated by distance. One partner lives in Mawson Lakes, the other is overseas and cannot obtain a visitor visa or does not want to risk a condition 8503 entry. The couple ask Partner Visa Lawyers Adelaide whether a Subclass 309 application from overseas, or a Subclass 300 Prospective Marriage visa, is the better course. The firm runs both, and the sponsor in Adelaide and the applicant abroad attend the same Zoom consultation.

The fifth is the applicant with a history. A refusal, a cancellation, a period as an unlawful non-citizen or a sponsor who has sponsored a partner before turns an ordinary matter into a legal one. These are the matters in which Partner Visa Lawyers Adelaide do most of their real work, and they are addressed in detail later in this article.

How does the South Australian Relationships Register affect the timing advice given by Partner Visa Lawyers Adelaide?

The South Australian Relationships Register affects timing advice because registration under the Relationships Register Act 2016 (SA) is one of the two exceptions to the twelve month de facto requirement, and Partner Visa Lawyers Adelaide raise it at the first consultation with every de facto couple. Regulation 2.03A of the Migration Regulations 1994 requires a de facto applicant to have been in the de facto relationship for at least twelve months at the time of application. The requirement does not apply where the relationship is registered under a law of a State or Territory prescribed for the purpose, or where compelling and compassionate circumstances exist.

For an Adelaide couple this is a practical decision, not an academic one. A de facto couple who have lived together in Salisbury for eight or nine months, with a student visa about to expire, would otherwise have to choose between waiting past the visa expiry or arguing compelling and compassionate circumstances. Registration under the South Australian Act, where the couple are eligible for it, removes the twelve month question altogether and lets Partner Visa Lawyers Adelaide plan the application around the visa expiry instead of around the anniversary of the relationship. The firm advises on eligibility for registration, on the timing of the registration relative to the application date, and on what the certificate does and does not prove.

Registration is not a substitute for evidence. A registered relationship still has to be a genuine and continuing de facto relationship within section 5CB of the Migration Act, assessed across the four aspects in regulation 1.09A. Partner Visa Lawyers Adelaide are careful to say this, because some couples assume that the certificate does the work of the file. It does not. It answers the twelve month question only. The firm's article on the de facto partner visa in Australia explains how the twelve month rule and its exceptions operate together.

Married couples are in a different position. A spouse within section 5F does not have to meet the twelve month requirement at all, and Partner Visa Lawyers Adelaide sometimes find that a couple who intend to marry anyway are better served by marrying before lodgement than by registering. That is a decision for the couple. The firm's role is to set out the legal consequence of each course, including the effect on the evidence, so that the couple decide with the law in front of them.

What do Partner Visa Lawyers Adelaide do before any application is started?

Partner Visa Lawyers Adelaide assess the applicant, the sponsor and the relationship in writing before any application work begins, and at My Migration Lawyers that assessment is delivered as a letter of advice and a document checklist after the first consultation. The couple are not asked to pay for lodgement work until they have read what the firm thinks the problems are and how it proposes to deal with them.

The applicant's position comes first. The firm runs its own check through the Department's Visa Entitlement Verification Online system rather than relying on what the applicant remembers, confirms the current visa, its expiry and its conditions, and obtains the applicant's immigration history. Partner Visa Lawyers Adelaide need to know whether the applicant has ever been refused a visa, in Australia or elsewhere, ever had a visa cancelled, ever overstayed and ever given information to any immigration authority that could later be characterised as false or misleading under public interest criterion 4020. Concealed history is the one thing the firm cannot fix after lodgement.

The sponsor is assessed on the same footing. Partner Visa Lawyers Adelaide confirm the sponsor's status as an Australian citizen, Australian permanent resident or eligible New Zealand citizen, ask about every earlier partner sponsorship because regulation 1.20J limits a person to two partner sponsorships in a lifetime at least five years apart, and ask about criminal history because Division 1.4B of the Regulations permits refusal of a sponsorship where the sponsor has a conviction for a registrable offence. A sponsor in Norwood who sponsored a former spouse some years ago may be caught by the limitation without knowing it, and the firm's guide to partner visa sponsorship limitations explains when a waiver is available.

The relationship is assessed last, and in detail. The firm takes the history from the couple: when they met, when the relationship became exclusive, when they began living together, any period apart, and the date of any marriage or registration. Partner Visa Lawyers Adelaide then test that history against section 5F or section 5CB and against the four aspects, and identify where the documents are strong, where they are thin and where the couple's account will have to carry the weight. The firm also considers whether the applicant is better placed on a Subclass 820 application now, a Subclass 300 application after a return overseas, or a Subclass 309 application, because subclass selection cannot be undone once the application is lodged.

The letter of advice records all of this. It names the subclass, the criteria the firm expects to be in issue, the evidence to be gathered under each aspect, the submissions the firm will draft, the notifications that will be required and the risks that remain. A couple who have engaged Partner Visa Lawyers Adelaide should be able to read that letter and understand exactly what will be lodged and why.

How do Partner Visa Lawyers Adelaide organise the relationship evidence and the statements?

Partner Visa Lawyers Adelaide organise relationship evidence by mapping every document to one of the four aspects the Department must consider under regulation 1.15A for married applicants and regulation 1.09A for de facto applicants: the financial aspects of the relationship, the nature of the household, the social aspects and the nature of the couple's commitment to each other. A document that does not speak to one of those aspects is not evidence of the relationship, however much effort went into obtaining it.

The financial aspect is often the weakest for Adelaide couples who are young, who are students or who work seasonally. Partner Visa Lawyers Adelaide look for the joint account, the shared lease or mortgage, the utility bills in both names and the transfers between the couple, and where those do not exist the firm asks how the couple actually manage money and makes sure the statements say so. Separate finances are not fatal. Unexplained separate finances invite doubt.

The household aspect is evidenced by where and how the couple live. For a couple in a shared house in Mawson Lakes with other tenants, or a couple who have lived in three towns in two years following work, the file has to show the shared life rather than the shared address. Partner Visa Lawyers Adelaide ask for the tenancy documents, the mail, the evidence of shared responsibility for children or pets, and the account of who does what at home, and the firm's partner visa document checklist sets out what is typically gathered.

The social aspect rests heavily on Form 888 statements. Partner Visa Lawyers Adelaide ask the couple to choose witnesses who have actually seen the relationship over time, brief those witnesses on what a useful statement contains, and review each Form 888 before it is signed. A witness who writes that the couple are "clearly in love" has said nothing the Department can weigh. A witness who describes attending the couple's housewarming in Prospect, staying with them in Mount Barker and watching them care for a sick parent has given evidence. The firm's guide to Form 888 statements for a partner visa explains who may make one.

The commitment aspect is evidenced by the length of the relationship, the couple's plans, wills, superannuation nominations, insurance beneficiaries and the way the couple describe their future. Partner Visa Lawyers Adelaide give it equal attention because decision makers do.

The statements themselves belong to the applicant and the sponsor. My Migration Lawyers does not write them. The couple write their own accounts, and the firm reviews each statement against the forms, the documents and the other statement, corrects dates and places, removes anything the evidence does not support, and returns both statements to the couple so that each can confirm that every sentence is true. The firm's guide to the partner visa relationship statement shows the structure that works. The client decides what is said. Partner Visa Lawyers Adelaide make sure that what is said is complete, consistent and supported.

How do Partner Visa Lawyers Adelaide deal with Schedule 3, condition 8503 and a sponsor who has sponsored before?

Partner Visa Lawyers Adelaide deal with each of these complications by identifying the exact provision engaged, gathering the evidence that provision calls for and drafting a submission directed to it. A submission that argues in general terms that the couple are genuine and deserving does not answer a criterion. A submission that addresses the criterion does.

Schedule 3 arises where the applicant does not hold a substantive visa at the time of application. An applicant in Adelaide on a bridging visa, or with no visa at all, must satisfy criteria 3001, 3003 and 3004 of Schedule 3 to the Migration Regulations 1994 unless the Minister is satisfied that there are compelling reasons for not applying them. Partner Visa Lawyers Adelaide take detailed instructions on how the applicant came to be without a substantive visa, on the length and depth of the relationship, on any Australian citizen children and on the hardship the sponsor would suffer if the applicant had to leave, and present those facts with evidence in a written submission. The firm's page on Schedule 3 waivers and its article on the Schedule 3 partner visa waiver set out the framework the submission must meet.

Condition 8503 is a separate problem with a separate sequence. Where the applicant's visitor visa carries a no further stay condition, Partner Visa Lawyers Adelaide first prepare a request for waiver under section 41(2A) of the Migration Act, based on compelling and compassionate circumstances that arose after the visa was granted and that were beyond the applicant's control. The partner visa application is lodged only once the waiver is granted. A couple who lodge first and ask later have made an invalid application.

The sponsorship limitation in regulation 1.20J is dealt with before the sponsor signs anything. Where the sponsor has sponsored two partners already, or sponsored one partner less than five years ago, Partner Visa Lawyers Adelaide prepare a submission on compelling circumstances affecting the sponsor, which Departmental policy recognises may include the death of a former partner, a former relationship that ended through no fault of the sponsor, or a child of the current relationship. The submission is built from the sponsor's actual circumstances and evidenced in full.

Where the relationship has ended because of family violence by the sponsor, Division 1.5 of the Regulations allows the applicant to be considered for the permanent visa alone. Partner Visa Lawyers Adelaide assemble either the judicially determined evidence or the non-judicial evidence the Regulations prescribe, and manage the notification to the Department with care, because the wording and the timing of that notification have consequences. The firm's family violence provisions page describes both routes.

What do Partner Visa Lawyers Adelaide handle after lodgement?

Partner Visa Lawyers Adelaide handle the bridging visa, health and character, every Department request, every change of circumstances and the second stage after lodgement, because the matter continues until the permanent visa is granted and most of the risk sits in that period. Lodgement is a milestone. It is not the end of the firm's work.

The bridging visa is confirmed first. An applicant who lodges a Subclass 820 application while holding a substantive visa receives a Bridging Visa A that takes effect when the substantive visa ends. Partner Visa Lawyers Adelaide check the grant, read the conditions and advise on work and study rights, and where the applicant needs to travel, for a family event overseas or for work, the firm applies for a Bridging Visa B before departure so that the applicant can return. Leaving Australia on a Bridging Visa A ends it.

Health and character are dealt with early. The firm arranges the health examination with the Department's panel provider, obtains the Australian Federal Police check and any overseas police certificates, and lodges them before the case officer asks. A request the firm could have anticipated is a delay the couple did not need.

Department correspondence is handled as legal work. A request for further information under section 56 of the Migration Act carries a short deadline that is strictly applied, and Partner Visa Lawyers Adelaide prepare the response with the same care as the original file. A natural justice letter under section 57 means that the Department holds information adverse to the couple and intends to rely on it, and the response is the most important document in the matter after the application itself. The firm's guide to the section 56 request for more information explains what the Department is entitled to ask for.

Changes of circumstances are notified promptly. A new address in Glenelg, a new child, a new passport, a change of employment or any change in the relationship is reported to the Department on Form 1022, and Partner Visa Lawyers Adelaide advise the couple on which changes must be reported and how. The firm's article on Form 1022 change of circumstances explains the obligation.

The second stage is calendared at lodgement. The Subclass 801 permanent visa is assessed two years from the date of the Subclass 820 application, and the Department asks for fresh evidence that the relationship is continuing. Partner Visa Lawyers Adelaide diarise the date, prepare the updated evidence across the four aspects and manage the second stage as part of the same matter, so that the couple are not left to work it out alone two years on.

What do Partner Visa Lawyers Adelaide do if the Department refuses the visa?

Partner Visa Lawyers Adelaide read the decision record on the day it arrives, advise the couple whether the decision is reviewable at the Administrative Review Tribunal, and lodge the application for review within the deadline stated in the refusal notice. That deadline is short, it is strictly applied and it cannot be extended. My Migration Lawyers treats every refusal notice as urgent for that reason.

The decision record is the starting point. It sets out which criterion the delegate found was not met and why, and Partner Visa Lawyers Adelaide read it against the file to identify whether the delegate misunderstood the evidence, whether the evidence was in fact thin on that point, or whether the couple's account changed between the forms and the statements. That analysis determines what the review application must add. The firm's guide to Subclass 820 visa refusals explains the grounds on which onshore applications are most commonly refused.

Review at the Administrative Review Tribunal is a fresh consideration of the application. The Tribunal can consider evidence that was not before the delegate, and Partner Visa Lawyers Adelaide use that opportunity to fill the gaps the decision record exposed, to obtain further Form 888 statements, to update the financial and household evidence and to prepare the couple for a hearing at which both will be questioned about the relationship. The firm's article on the options after a partner visa refusal sets out the steps.

Not every refusal calls for review. Where the applicant can lawfully make a new application and the defect in the first was one of evidence or timing, Partner Visa Lawyers Adelaide may advise a new application instead. That advice depends on the applicant's visa status, on whether a bridging visa will be available and on the reasons for the refusal, and it is given in writing before the review deadline passes so that neither course is lost by default.

How does an Adelaide couple engage Partner Visa Lawyers Adelaide and what happens next?

An Adelaide couple engages Partner Visa Lawyers Adelaide by requesting a consultation through the firm's online form, attending that consultation by Zoom, and then deciding, with the written letter of advice in hand, whether to proceed under a fixed fee costs agreement. Nothing is lodged and nothing is drafted until the couple have read the advice and signed the agreement.

At the consultation, Weiwei Zhang takes the history of the relationship and the immigration history of both parties, asks the questions set out earlier in this article, and tells the couple what she sees. Where the matter is straightforward, the couple are told so. Where it carries a Schedule 3 problem, a condition 8503 problem, a sponsorship limitation or a previous refusal, the couple are told that too, along with what the firm proposes to do about it. Couples who want to understand what a first consultation involves can read the firm's article on the immigration lawyer consultation.

After the consultation, the letter of advice and document checklist arrive through the client portal. The costs agreement sets out the fixed fee for the matter and the scope of work it covers: the subclass, the stages, the statements and submissions to be drafted and the Department correspondence included. The firm's article on fixed fee immigration lawyers explains why the scope matters as much as the fee.

The couple then gather the documents on the checklist and write their own statements, uploading each item to the portal as it is ready. Partner Visa Lawyers Adelaide review the material as it arrives, ask for what is missing, correct what is inconsistent and draft whatever submission the matter requires. The whole file is read together before lodgement. The couple see and approve everything that is lodged in their names.

How My Migration Lawyers acts as Partner Visa Lawyers Adelaide

My Migration Lawyers acts as Partner Visa Lawyers Adelaide for couples across Adelaide and South Australia, from Salisbury and Mawson Lakes in the north to Glenelg on the coast, Norwood and Prospect near the city, Mount Barker in the Hills, and Murray Bridge and Mount Gambier in the regions. The firm's partner visa work is led by Weiwei Zhang, Principal Lawyer, who is responsible for the assessment, the letter of advice and the submissions on every partner visa matter the firm accepts.

The firm acts in many matters of exactly this type: Subclass 820 and 801 applications by students, visitors and temporary workers already in South Australia, Subclass 309 and 100 applications for partners overseas, Subclass 300 Prospective Marriage visa applications, second stage Subclass 801 assessments, and matters complicated by Schedule 3, condition 8503, regulation 1.20J, public interest criterion 4020, a de facto relationship shorter than twelve months or a relationship that has ended through family violence. Complex matters are the firm's ordinary work, and My Migration Lawyers is equipped to run them.

On each matter the firm provides a written letter of advice and document checklist after the consultation, runs the Visa Entitlement Verification Online check and obtains the immigration history itself, advises on registration under the South Australian Relationships Register where it is relevant, maps the evidence to the four aspects of the relationship, reviews and corrects the couple's own statements and Form 888 statements, drafts the legal submissions the matter requires, lodges the application, answers every Department request and calendars the second stage. Every consultation is by Zoom and every document passes through the secure client portal, so a couple in Mount Gambier is served exactly as a couple in Sydney is.

A couple who want Partner Visa Lawyers Adelaide to assess their matter can request a consultation with My Migration Lawyers through the online form. The firm's partner visa service page describes each subclass, and Weiwei Zhang's profile sets out her role at the firm.

Frequently Asked Questions

Can Partner Visa Lawyers Adelaide act for a couple who live in Mount Gambier or the Riverland?

Yes. Partner Visa Lawyers Adelaide act for couples anywhere in South Australia because the matter does not depend on location. The consultation is held by Zoom, the documents are exchanged through a secure client portal, the application is lodged online through ImmiAccount and the Department of Home Affairs decides it centrally. A couple in Mount Gambier, Murray Bridge or the Riverland follows exactly the same process as a couple in the Adelaide suburbs, and receives the same written advice and document checklist after the consultation.

Does registering a relationship in South Australia remove the twelve month de facto requirement?

Yes. Registration under the Relationships Register Act 2016 (SA) is a registration under a prescribed State law for the purpose of regulation 2.03A of the Migration Regulations 1994, and a de facto applicant whose relationship is registered does not have to show twelve months in the relationship at the time of application. Registration does not replace evidence of a genuine and continuing relationship across the financial, household, social and commitment aspects. It answers the twelve month question only, and the rest of the file must still be prepared in full.

Does a couple have to attend the Sydney office of Partner Visa Lawyers Adelaide?

No. My Migration Lawyers conducts every consultation by Zoom and never requires a client to attend its Sydney office. An Adelaide couple attends the consultation from home or work, and a sponsor in Adelaide and an applicant overseas can attend the same consultation from different countries. Documents are uploaded to and returned through the secure client portal, and the letter of advice, document checklist and costs agreement are all delivered electronically. The office at Martin Place is available by appointment but is not part of the ordinary process.

What should a couple bring to a first consultation with Partner Visa Lawyers Adelaide?

A couple should bring the applicant's passport and current visa details, any earlier visa refusal or cancellation decision, the sponsor's evidence of citizenship or permanent residence, details of any earlier partner sponsorship by the sponsor, and a short timeline of the relationship with the dates the couple met, became exclusive and began living together. My Migration Lawyers runs its own Visa Entitlement Verification Online check and obtains the immigration history itself, so the couple do not need to have everything perfect. Honesty about the history matters far more than completeness at the first meeting.

Can an international student in Adelaide apply for a partner visa before the student visa ends?

Yes. A student who holds a valid student visa can lodge a Subclass 820 application in Australia before that visa ceases, provided the visa carries no condition preventing a further application and the couple meet the spouse or de facto criteria at the date of application. A Bridging Visa A is granted on lodgement and takes effect when the student visa ends. A de facto student couple who have been together for less than twelve months must either register the relationship under the South Australian Relationships Register or rely on compelling and compassionate circumstances, so timing should be assessed before the course finishes.
