Key Takeaways

  • Immigration Lawyers Brisbane are lawyers who act on a partner visa, an onshore Subclass 866 protection visa, a visa refusal or a visa cancellation from the first consultation to the decision, and My Migration Lawyers acts as Immigration Lawyers Brisbane for clients throughout Brisbane and south east Queensland.
  • A refusal notice under section 65 and a notice of intention to consider cancellation under section 109, section 116 or section 501 each carry a response period that is short and strictly applied, and Immigration Lawyers Brisbane are engaged most often on the day one of those notices arrives.
  • On a partner visa or a protection visa, Immigration Lawyers Brisbane do the legal work the forms conceal: identifying the criterion that will be applied against the applicant, planning the evidence that criterion requires, and reviewing the applicant's own statements so that they are complete, consistent and true.
  • A Queensland couple in a de facto relationship shorter than twelve months can register a civil partnership under the Civil Partnerships Act 2011 (Qld), a prescribed law for the purposes of regulation 2.03A, and Immigration Lawyers Brisbane advise on whether registration or waiting is the better course.
  • My Migration Lawyers has no Brisbane office and does not need one. Migration law is federal, applications are lodged online, the Department decides them centrally and every consultation is by Zoom, so a client in Sunnybank, Logan or Toowoomba is served exactly as a client in Sydney is.
  • Weiwei Zhang, Principal Lawyer of My Migration Lawyers, is the lawyer responsible for every matter the firm accepts as Immigration Lawyers Brisbane.

Immigration Lawyers Brisbane are lawyers who act on a migration matter from the first consultation to the decision, and My Migration Lawyers acts as Immigration Lawyers Brisbane for clients throughout Brisbane, Ipswich, Logan, the Sunshine Coast and the Darling Downs on partner visas, onshore Subclass 866 protection visas, visa refusals and visa cancellations. Those four matter types are the whole of the firm's practice. The firm does not act on skilled, student, employer sponsored, parent or citizenship matters.

The reason for that narrow practice is that the four matter types share a single character. Each turns on a contested legal criterion applied to the client's own account and evidence, and each carries a stage at which a short, strictly applied deadline decides whether the client keeps a right or loses it. Immigration Lawyers Brisbane are engaged to do the legal work at each of those stages, and this article sets out what that work is.

The article follows the order in which matters actually arrive. It begins with the situations that bring a Brisbane client to the firm, then the assessment, then the two matter types that arrive with a deadline already running, refusals and cancellations, then partner visas and protection visas, then Department correspondence under section 56 and section 57 of the Migration Act 1958, then review at the Administrative Review Tribunal. It closes with how My Migration Lawyers, led by Weiwei Zhang, Principal Lawyer, acts as Immigration Lawyers Brisbane from an office in Sydney. The firm's visa refusals page and visa cancellations page set out the law that this article treats only as the reason a task exists.

When does a client in Brisbane need Immigration Lawyers Brisbane?

A client needs Immigration Lawyers Brisbane when the matter carries a legal question that the client cannot answer by completing a form correctly, or when a deadline is running that the client cannot afford to miss. Most of the matters the firm accepts fall into one of those two descriptions, and many fall into both.

The deadline matters arrive first. A refusal notice under section 65 of the Migration Act 1958 states a period within which review at the Administrative Review Tribunal must be sought. A notice of intention to consider cancellation states a period within which the visa holder must respond. A section 57 natural justice letter states a period within which comment must be made. Each of those periods is short and strictly applied, and the first two cannot be extended. Immigration Lawyers Brisbane are most valuable on the day the notice arrives and least valuable the day after the period ends. The firm's article on what a visa appeal lawyer does describes the work that follows a refusal notice.

The legal question matters arrive in a different way. A de facto couple in Moorooka who have lived together for less than twelve months want to know whether they can apply. A visitor visa holder staying with family in Inala has formed a relationship and holds condition 8503. A student in St Lucia has stopped attending, expects the enrolment to be cancelled, and has never told anyone that returning home is unsafe. A sponsor in Chermside sponsored a former partner some years ago and is unsure whether regulation 1.20J applies. None of these clients faces a deadline yet, but each faces a criterion, and Immigration Lawyers Brisbane are engaged to identify the criterion and answer it before the Department asks.

There is also a third group. Clients who have already lodged an application themselves, or through another representative, and want it reviewed before the Department decides it. Immigration Lawyers Brisbane take over a lodged matter by obtaining the application as lodged, reading it as the delegate will read it, and advising in writing on what should be supplemented, corrected or notified. The firm's article on changing immigration lawyer in Australia explains how the appointment is changed with the Department on Form 956.

How do Immigration Lawyers Brisbane assess a matter at the first consultation?

Immigration Lawyers Brisbane assess a matter by establishing the client's visa status, immigration history, the criterion in issue and the deadlines on the file, and then setting the assessment out in a letter of advice and a document checklist before any application or response is drafted. At My Migration Lawyers that letter follows the Zoom consultation on every matter the firm accepts, and the client sees it before paying for anything other than the consultation.

Visa status comes first because it changes the answer to every other question. Immigration Lawyers Brisbane run the Visa Entitlement Verification Online check during or immediately after the consultation, confirm the visa held, its conditions and its cease date, and identify any bridging visa. Whether an applicant holds a substantive visa at the time of a partner visa application decides whether Schedule 3 applies. Whether an applicant is lawful at the time of a protection visa application decides whether a Bridging Visa A or a Bridging Visa E follows. Whether a visa holder still holds the visa at all decides whether a cancellation matter is a response or a review.

Immigration history comes second. Immigration Lawyers Brisbane ask for every visa applied for, every refusal and every cancellation, in Australia and in any other country, and obtain the decision records from the Department where the client does not have them. A client who omits an earlier refusal from a new application risks a finding under public interest criterion 4020 that false or misleading information was given, and a client who has been refused or cancelled in Australia may be barred by section 48 from applying for most visas onshore. Both problems can be managed if they are known. Neither can be managed if they are discovered by the delegate.

The criterion in issue comes third. Immigration Lawyers Brisbane state in the letter of advice which criterion the delegate will apply against the client and what evidence that criterion requires. On a partner visa it may be regulation 2.03A, Schedule 3 criterion 3001 or regulation 1.20J. On a protection visa it may be section 5J(1)(c) relocation or section 36(3) third country protection. On a cancellation it may be the discretion under section 116 or the considerations in the Ministerial Direction under section 499. Naming the criterion at the outset is what separates a legal assessment from a checklist.

The deadlines come last and are stated in the letter with the date. Immigration Lawyers Brisbane calendar every date on the file and treat the earliest one as the matter's priority. A letter of advice that does not state the deadlines has not assessed the matter.

How do Immigration Lawyers Brisbane respond to a section 65 refusal notice?

Immigration Lawyers Brisbane respond to a refusal notice by reading the decision record for its adverse findings, confirming that the decision is reviewable and identifying the review period, advising in writing on review or a fresh application, and lodging the review application at the Administrative Review Tribunal within time. The review period is short, strictly applied and cannot be extended.

The decision record is the whole of the work at this stage. A delegate refusing a partner visa under section 65 will have found that a criterion was not met: that the relationship was not genuine and continuing on one or more of the four aspects, that Schedule 3 was not satisfied and compelling reasons were not shown, that the sponsor was barred by regulation 1.20J, or that public interest criterion 4020 was engaged. A delegate refusing a protection visa will have found that the account was not credible, that the harm feared did not reach the threshold in section 36(2A), or that the applicant could relocate or obtain effective protection under section 5J. Immigration Lawyers Brisbane list each finding, because the Tribunal will decide the matter afresh and the new evidence must be directed at the findings. The firm's article on partner visa refusal and appeal options sets out the choice on a partner matter.

The advice on review or a fresh application is given in writing before the client decides. A fresh partner visa application may be available where the applicant holds a substantive visa and section 48 does not bite, and may be preferable where the refusal was for evidence that can now be supplied. A fresh protection visa application is almost never available, because section 48A bars a second protection visa application in Australia once one has been refused unless the Minister lifts the bar. Immigration Lawyers Brisbane say which course is open and why, with the deadline in the same paragraph.

Where the refused application was lodged by the client or by another representative, Immigration Lawyers Brisbane obtain the Department's file and read the original application alongside the decision. That reading is done before the review is lodged, not after, because the review will be conducted on that record and the client should know what the record contains before committing to the Tribunal.

How do Immigration Lawyers Brisbane respond to a visa cancellation notice?

Immigration Lawyers Brisbane respond to a notice of intention to consider cancellation by identifying the section relied on, obtaining every document the Department holds and refers to, taking the client's instructions on each particular, and lodging a response with evidence within the period stated in the notice. That period is short and strictly applied. A visa holder who lets it pass is cancelled on the material in the notice, and the review that follows is conducted with the visa already gone.

The section relied on determines everything that follows. Under section 109, the Department may cancel a visa where the holder gave incorrect information or a bogus document in the application or on entry, and the notice under section 107 sets out the particulars. Immigration Lawyers Brisbane test whether the information was in fact incorrect, whether the holder was aware of it, and how the prescribed circumstances in regulation 2.41 bear on the discretion. Under section 116, the Department may cancel on general grounds, including non-compliance with a condition, a change in the circumstances that permitted the grant, or a risk to the community. A working holiday maker on the Sunshine Coast who has worked for one employer longer than condition 8547 allows, or a student in Nathan whose enrolment has ceased, is a section 116 matter, and the response addresses both the ground and the discretion.

Section 501 is a different matter in kind and in consequence. Cancellation on character grounds turns on the character test in section 501(6), and where the cancellation was mandatory under section 501(3A) the response is a request for revocation under section 501CA. Immigration Lawyers Brisbane organise that response around the considerations in the Ministerial Direction under section 499 that applies at the time: the protection of the Australian community, the strength, nature and duration of ties to Australia, the interests of minor children, the expectations of the community, and the extent of impediments if removed. Each consideration is addressed with documents and with statements from the people who know the client, and the client's own account is the client's own evidence, reviewed for accuracy rather than composed by the firm. The firm's visa cancellations page describes the three sections and the review that follows.

The client's status is addressed in the same response. Where the visa is cancelled despite the response, the former holder becomes unlawful unless a bridging visa is granted, and Immigration Lawyers Brisbane advise on the application for a bridging visa and on review at the Administrative Review Tribunal within the review period.

How do Immigration Lawyers Brisbane run a partner visa matter for a Queensland couple?

Immigration Lawyers Brisbane run a partner visa matter by assessing the applicant against section 5F or section 5CB of the Migration Act 1958 and the sponsor against regulation 1.20J and Division 1.4B, selecting between the Subclass 820 and 801, the Subclass 309 and 100 and the Subclass 300 pathways, planning the evidence against the four aspects in regulation 1.15A and regulation 1.09A, reviewing the couple's statements and their Form 888 statements, drafting any waiver submission, and lodging through ImmiAccount. The firm's partner visa lawyers service page describes the subclasses.

The Queensland legal fact that Immigration Lawyers Brisbane apply on a de facto matter is civil partnership registration. Regulation 2.03A requires that a de facto relationship has existed for at least twelve months at the time of application unless the relationship is registered under a prescribed State or Territory law or there are compelling and compassionate circumstances. Registration of a civil partnership under the Civil Partnerships Act 2011 (Qld), through the Queensland Registry of Births, Deaths and Marriages, is registration under a prescribed law. A couple in Logan or Redcliffe who have lived together for a shorter period can therefore register and apply without waiting, provided both are free to register. Immigration Lawyers Brisbane check eligibility to register, the time registration takes, and whether waiting for twelve months would produce a stronger file, and advise the couple which course to take. Registration removes the twelve month requirement; it does not prove that the relationship is genuine, and the four aspects must still be evidenced.

The applicant's visa status is the next fork. An applicant in Australia without a substantive visa must meet Schedule 3 criteria 3001, 3003 and 3004 or show compelling reasons not to apply them, and the firm's guide to the Schedule 3 partner visa waiver explains what a compelling reasons submission contains. An applicant on a visitor visa carrying condition 8503 must first obtain a waiver under section 41(2A), and the firm's article on the Subclass 820 and the no further stay condition explains the order in which the two applications are made. An applicant overseas is a Subclass 309 matter, and the Brisbane sponsor and the overseas applicant attend the same Zoom consultation from where they are.

The evidence is planned rather than collected. Immigration Lawyers Brisbane take each of the four aspects in turn, list the documents that exist under each, identify what is missing and why, and have the couple explain the gaps in their own statements. Couples who live with parents in Sunnybank, who keep separate finances for cultural or practical reasons, or who spend long periods apart because one partner works in a regional or mining town have genuine relationships that produce thin files, and the firm's guide to partner visa relationship evidence explains how such a relationship is evidenced honestly. The Form 888 statements are sought from people who have observed the relationship and can describe specific occasions, not from people who will sign a template.

After lodgement the matter continues. The Bridging Visa A is confirmed, the health examination and police certificates are lodged before they are requested, changes of circumstances are notified on Form 1022, and the Subclass 801 second stage, which is assessed two years from the date of the Subclass 820 application, is calendared and prepared as part of the same matter. Where the relationship ends through family violence, Immigration Lawyers Brisbane prepare the claim under Division 1.5 with judicial or non-judicial evidence.

How do Immigration Lawyers Brisbane run an onshore Subclass 866 protection visa matter?

Immigration Lawyers Brisbane run a Subclass 866 matter for applicants who are already in Australia by identifying the legal ground the applicant's account engages, reviewing the applicant's statement of claims, planning the identity and country evidence, preparing the applicant for any interview with a delegate, and answering the Department until the decision. The firm acts for onshore applicants only: visitor visa holders, students, working holiday makers and people whose visas have ceased. The firm's protection visa lawyers service page describes the practice, and its articles on international students and the Subclass 866 and visitor visa holders and the Subclass 866 address the two groups the firm sees most often from Brisbane.

The legal ground comes first. The refugee criterion in section 36(2)(a) requires a well-founded fear of persecution under section 5J for one of five reasons: race, religion, nationality, membership of a particular social group or political opinion. The complementary protection criterion in section 36(2)(aa) requires a real risk of significant harm as defined in section 36(2A). Immigration Lawyers Brisbane hear the account, identify which ground the facts engage, and advise the applicant. The applicant decides which claims are advanced. The firm does not add claims the applicant has not made, and it says plainly when an account does not engage either criterion.

The statement of claims is the applicant's own evidence and is treated as such. Section 5AAA places on the applicant the responsibility to specify the particulars of the claim and to provide evidence, and section 423A allows the Administrative Review Tribunal to draw an adverse inference from a claim first raised at review. Immigration Lawyers Brisbane therefore have the applicant write the full account before Form 866 is lodged, review it for chronology, completeness and consistency with the Form 866 answers, correct errors, and return it for confirmation. The firm's guide to the Form 866 protection visa application explains how the form and the statement fit together.

The evidence is planned against the questions the delegate must answer. Identity is established under section 91W, and the applicant is warned that a bogus document under section 91WA is fatal. The relocation and effective protection questions under section 5J(1)(c) and section 5J(2), and the third country question under section 36(3), are addressed with country information in the submission, because an accepted account of harm can still be refused on any one of them.

Not every applicant is interviewed by a delegate. Where an interview is scheduled, Immigration Lawyers Brisbane prepare the applicant to give the account in the applicant's own words, attend the interview, and lodge any post-interview submission. Throughout, the applicant's status is managed: a Bridging Visa A for an applicant who was lawful at lodgement, a Bridging Visa E for one who was not, with advice on the conditions of each, and a clear explanation of the section 48A bar so that the applicant understands why the first application must be complete.

What do Immigration Lawyers Brisbane do when the Department writes under section 56 or section 57?

Immigration Lawyers Brisbane treat every Department letter as a decision point, identify the concern that prompted it, and answer that concern with evidence and a submission within the period the letter states. The two letters that matter most are the request for further information under section 56 and the invitation to comment on adverse information under section 57 of the Migration Act 1958.

A section 56 request may be routine or may be a warning. A request for a police certificate is routine. A request on a partner visa for further evidence that the couple live together, or on a protection visa for further evidence of identity, tells the applicant what the delegate doubts. Immigration Lawyers Brisbane answer the doubt as well as the request, because supplying the document without addressing the reason for the request leaves the doubt where it was. The firm's guide to the section 56 request for more information explains how the request is read.

A section 57 letter means that the Department holds information adverse to the applicant that the applicant has not seen and that the delegate proposes to rely on. On a partner visa it is commonly a statement from a former partner, an anonymous report, or an inconsistency with an earlier application. On a protection visa it is commonly country information, a discrepancy with an earlier visa application or arrival interview, or information about travel. Immigration Lawyers Brisbane obtain the full particulars, take instructions on each item separately, and respond to each item directly. A response that argues generally about the merits does not answer a section 57 letter.

The client's own notifications are handled in the same discipline. A change of address, passport, employment, family composition or relationship status is notified on Form 1022, and the firm lodges the notification and advises on its effect. An unnotified change discovered by the Department is treated as an integrity issue.

What do Immigration Lawyers Brisbane do at the Administrative Review Tribunal?

Immigration Lawyers Brisbane conduct a review at the Administrative Review Tribunal by lodging within the strict period, obtaining the Department's documents, listing the findings in the decision record that must be displaced, gathering the new evidence directed at each finding, preparing the client to give evidence, lodging a written submission and appearing at the hearing. The Tribunal considers the criteria afresh, so evidence that was not before the delegate can be put before the Tribunal.

On a partner visa review the new evidence is usually the period since the refusal: updated evidence on each of the four aspects and further Form 888 statements describing what witnesses have observed since. On a protection visa review it is usually updated country information, evidence on relocation and effective protection, and any corroboration of the account that has become available. On a cancellation review it is evidence directed at the ground and at each consideration in the discretion. The firm's guide to the Administrative Review Tribunal review process after a refusal describes the stages.

The hearing is where the client's own evidence is tested. Immigration Lawyers Brisbane prepare the client by working through the decision record, the statements and the documents, so that the client answers the Tribunal from memory of events rather than from a script. Where the Tribunal writes before the hearing inviting comment on information that would be the reason for affirming the decision, the response is prepared with the same care as a section 57 response. Brisbane matters are heard through the Tribunal's Brisbane registry and by video, and the firm appears as the matter requires.

The client's status during review is managed alongside the review. An applicant who held a bridging visa at refusal is generally able to hold a bridging visa during review, and a client who must travel needs a Bridging Visa B before leaving. A client whose visa was cancelled is in a different position and the bridging application is made at once.

Which parts of Brisbane and south east Queensland do Immigration Lawyers Brisbane serve?

Immigration Lawyers Brisbane serve the whole of Brisbane and south east Queensland from wherever the lawyer sits, because the work is federal and online. My Migration Lawyers has one office, at Level 1, 60 Martin Place, Sydney NSW 2000, used by appointment, and no office in Brisbane. The Migration Act 1958 and the Migration Regulations 1994 apply in Queensland exactly as they apply in New South Wales. Applications are lodged through ImmiAccount. The Department of Home Affairs decides them through national processing arrangements and not through an office near the client. Every consultation with My Migration Lawyers is conducted by Zoom, and documents move through a secure client portal.

The firm acts as Immigration Lawyers Brisbane for clients in Sunnybank, Logan, Ipswich, Inala, Moorooka, Chermside and Redcliffe, for clients on the Sunshine Coast, and for clients in Toowoomba and across the Darling Downs. Each receives the same Zoom consultation, letter of advice, document checklist, fixed fee costs agreement and responsible lawyer. The firm's guides to choosing a partner visa lawyer for Brisbane and choosing a protection visa lawyer for Brisbane set out what a Brisbane client should ask of anyone before engaging them.

The matters that come from south east Queensland have their own shape. Students at the universities in St Lucia, Nathan, Kelvin Grove and the Sunshine Coast whose enrolment has ended or who hold a protection claim they have never raised. Working holiday makers and regional workers on farms in the Lockyer Valley and the Scenic Rim, and in the mining towns west of Toowoomba, whose partner is an Australian citizen or who have exceeded a condition. Visitor visa holders staying with family in Sunnybank, Inala or Logan who hold condition 8503 and have formed a relationship. Couples in Ipswich or Chermside with a partner still overseas who need a Subclass 309 application run from both ends. Former visa holders in Moorooka or Redcliffe who received a refusal or a cancellation notice and are near the end of the period. Each is described here as a situation, not a statistic, and each is ordinary work for Immigration Lawyers Brisbane without a Brisbane address.

How My Migration Lawyers acts as Immigration Lawyers Brisbane

My Migration Lawyers acts as Immigration Lawyers Brisbane for clients throughout Brisbane and south east Queensland on partner visas, onshore Subclass 866 protection visas, visa refusals and visa cancellations. Weiwei Zhang, Principal Lawyer, leads the firm and is responsible for the assessment, the letter of advice and the submissions on each matter.

The firm acts in many matters of exactly this type: Subclass 820 and 801 applications by applicants in Brisbane, Subclass 309 and 100 applications by applicants overseas with a Queensland sponsor, Subclass 300 Prospective Marriage visa applications, Subclass 866 applications by students and visitor visa holders, responses to section 56 requests and section 57 letters, responses to notices of intention to consider cancellation under section 109, section 116 and section 501, and review at the Administrative Review Tribunal. Matters complicated by Schedule 3, condition 8503, regulation 1.20J, public interest criterion 4020, the section 48A bar or family violence are accepted as ordinary work, and the firm is equipped to run them.

On every matter My Migration Lawyers provides a letter of advice and document checklist after the consultation, runs the Visa Entitlement Verification Online check and obtains the immigration history itself, names the criterion in issue, plans the evidence against it, reviews and corrects the client's own statements, drafts the submissions the matter requires, lodges, answers every Department letter within its period, calendars every date and appears at the Tribunal where the matter goes there. Every consultation is by Zoom. Every fee is a fixed fee stated in the costs agreement before work starts.

Clients in Brisbane and south east Queensland who want Immigration Lawyers Brisbane to assess their matter can request a consultation with My Migration Lawyers through the firm's online form.

Frequently Asked Questions

Can a Queensland de facto couple apply for a partner visa before twelve months together?

Yes, if the relationship is registered or if compelling and compassionate circumstances exist. Regulation 2.03A requires twelve months of de facto relationship at the time of application unless the relationship is registered under a prescribed State or Territory law. Registration of a civil partnership under the Civil Partnerships Act 2011 (Qld) is registration under a prescribed law, so a Brisbane couple who register before applying are not subject to the twelve month requirement. Immigration Lawyers Brisbane check that both parties are free to register and advise whether registering or waiting will produce the stronger application. The relationship must still be shown to be genuine and continuing.

Does a client in Brisbane have to travel to Sydney to engage Immigration Lawyers Brisbane?

No. My Migration Lawyers conducts every consultation by Zoom and exchanges every document through a secure client portal, so no client travels to the Sydney office for any part of the matter. Migration law is federal, applications are lodged online through ImmiAccount and the Department of Home Affairs decides them centrally, so the lawyer's location has no bearing on the matter. A client in Logan, Ipswich or Toowoomba receives the same letter of advice, the same fixed fee costs agreement and the same responsible lawyer as a client in Sydney.

How much time does a visa holder have to respond to a notice of intention to consider cancellation?

The response period is stated in the notice itself, and it is short and strictly applied. The visa holder should read the notice on the day it arrives, identify whether section 109, section 116 or section 501 is relied on, and engage Immigration Lawyers Brisbane immediately, because the response must be lodged with evidence within that period and a visa holder who does not respond is usually cancelled on the material in the notice. The response addresses whether the ground is made out and, if it is, why the discretion should not be exercised against the visa holder.

Will Immigration Lawyers Brisbane add protection claims that the applicant has not made?

No. The protection visa claims are the applicant's own, and section 5AAA places the responsibility for specifying them on the applicant. Immigration Lawyers Brisbane identify which legal ground the applicant's account engages, advise on what the evidence can carry, review the applicant's statement of claims for chronology and consistency, and return it to the applicant to confirm that every sentence is true. The applicant decides which claims are advanced. A claim first raised at the Administrative Review Tribunal may attract an adverse inference under section 423A, which is why the statement lodged with Form 866 must be complete.

Can a client in Brisbane lodge a new partner visa application instead of seeking review after a refusal?

Yes, in some cases, and Immigration Lawyers Brisbane advise in writing on which course is open before the client decides. A fresh application may be available where the applicant holds a substantive visa and section 48 does not prevent an onshore application, and it may be preferable where the refusal was for evidence that can now be supplied. Where the applicant holds only a bridging visa, or where the refusal engaged public interest criterion 4020, review at the Administrative Review Tribunal is usually the only course. The review period stated in the refusal notice is short and cannot be extended, so the decision must be made within it.
