Key Takeaways

  • Yes. A person from Myanmar who is in Australia on a Visitor visa (Subclass 600) can apply for a Subclass 866 protection visa, provided they remain in Australia and no bar applies, such as a previous protection visa refusal in Australia.
  • Condition 8503 (No Further Stay) does not prevent a protection visa application. The condition expressly excludes protection visas.
  • Condition 8101 prevents work while the visitor visa is in effect. Under the Department's current guidelines, the Bridging Visa A granted to a protection visa applicant is generally granted without a work condition once it comes into effect.
  • Applying while the visitor visa is still in effect usually keeps the applicant lawful. Applying after it expires means unlawful status, a risk of detention and a Bridging Visa E that starts without permission to work.
  • The Department can compare the protection claims with the visitor visa application and with how the person left Myanmar, including departure through Yangon airport at a time when travel by people of conscription age was restricted.

Can Myanmar tourists apply for a Subclass 866 protection visa? Yes. A person from Myanmar who entered Australia on a visitor visa can apply for protection from inside Australia, even where the visitor visa carries a No Further Stay condition.

This guide answers the question, can Myanmar tourists apply for a Subclass 866 protection visa, for a person who is in Australia as a visitor today. It explains the visitor visa Myanmar nationals usually hold, what conditions 8503 and 8101 mean, how to stay lawful, what happens to work, and how the Department uses the visitor visa application and the circumstances of departure from Myanmar. The definitive guide to the Subclass 866 protection visa explains the visa more generally.

Can Myanmar tourists apply for a Subclass 866 protection visa?

Yes. A Myanmar tourist can apply for a Subclass 866 protection visa if they are in Australia, they lodge a valid application through ImmiAccount, and no bar applies to them, such as section 48A after an earlier protection visa refusal in Australia.

A visitor has the same right to seek protection as anyone else in Australia. The Migration Act applies the same refugee test in section 36(2)(a) and the same complementary protection test in section 36(2)(aa) whatever visa the person holds. The Subclass 866 protection visa page explains the visa, and the guide on protection visa eligibility explains the threshold questions.

So the real issues behind the question "can Myanmar tourists apply for a Subclass 866 protection visa" are practical ones. How long is left on the visitor visa? What conditions does it carry? What did the person tell the Department when they applied to visit? And how did they leave Myanmar? Each of those questions affects how the application should be prepared.

The application is lodged online using Form 866. The guide on how to create an ImmiAccount explains the first step, and the guide to Form 866 explains the form.

Which visitor visa do Myanmar nationals usually hold?

Myanmar nationals usually visit Australia on a Visitor visa (Subclass 600). Myanmar passport holders are not eligible for the Electronic Travel Authority (Subclass 601) or the eVisitor (Subclass 651), which are available only to passport holders from listed countries.

The stream decides which conditions are on the visa, but it does not change the answer to the question, can Myanmar tourists apply for a Subclass 866 protection visa. The streams Myanmar visitors most often hold are:

  • Tourist stream. For holidays and for visiting relatives or friends. Many Myanmar visitors are parents, siblings or other family of Myanmar students, workers and permanent residents already in Australia.
  • Sponsored Family stream. For a visitor sponsored by an eligible relative in Australia. Condition 8503 is mandatory in this stream.
  • Business Visitor stream. For short business trips, meetings and conferences.

The application is made online and decided by the Department. It asks about the person's work, finances, family in Myanmar and reasons for visiting. Those answers stay on the file, and they matter again once the person asks, can Myanmar tourists apply for a Subclass 866 protection visa, and lodges. The general guide to applying for a Subclass 866 on a tourist visa explains issues that apply to visitors of every nationality.

Does condition 8503 stop a Myanmar visitor from applying?

No. Condition 8503 provides that the holder will not, after entering Australia, be entitled to be granted a substantive visa, other than a protection visa, while the holder remains in Australia. Protection visas are excluded in the words of the condition.

The Department's procedural instructions state that condition 8503 does not prevent the holder from applying for a protection visa. A Myanmar visitor with this condition does not need a waiver before lodging Form 866. Can Myanmar tourists apply for a Subclass 866 protection visa if their visa says No Further Stay? Yes.

The condition does prevent most other applications in Australia. Without a waiver, which is available only in limited prescribed circumstances, a Myanmar visitor with condition 8503 generally cannot apply onshore for a student, partner or work visa. After the military takeover in February 2021, the Australian Government announced in May 2021 that Myanmar nationals in Australia on temporary visas could apply to extend their stay until it was safe to return, and that a range of visa options might be available. Whether any option other than a protection visa is open to a particular visitor today depends on current policy and on the visa they hold. That should be checked before a protection visa is lodged, because a protection visa should be lodged only by a person who genuinely fears harm.

Can Myanmar visitors work after applying?

Not while the visitor visa remains in effect. Visitor visas in the Tourist and Sponsored Family streams carry condition 8101, which means the holder must not engage in work in Australia.

Lodging a protection visa application does not remove condition 8101. Can Myanmar tourists apply for a Subclass 866 protection visa and start work the next day? No. Working in breach of condition 8101 can lead to cancellation of the visitor visa, and it can be raised against the applicant's credibility.

A Myanmar visitor who applies while the visitor visa is in effect is usually granted a Bridging Visa A. It comes into effect when the visitor visa ceases. Under the Department's current guidelines, a Bridging Visa A granted to a person whose protection visa application has not been finally determined is generally granted without a work condition. The applicant should read the grant notice and confirm the conditions in writing before taking any job.

What should a Myanmar visitor check before lodging?

A Myanmar visitor who fears return should check four things before lodging: the visa expiry date, the visa conditions, their passport, and the dates of the events they fear. Those four facts decide how urgently the application must be made and what it needs to explain.

  • Expiry date and conditions. The visa grant notice, or the online visa record, shows when the visitor visa ends and whether conditions 8101 and 8503 apply.
  • Passport. The passport's expiry date matters for identity evidence. A person who fears the military authorities should get advice before approaching the Myanmar Embassy for a renewal.
  • Timeline. The dates of the feared events, of the visitor visa application, of departure from Yangon and of arrival in Australia should be written down accurately.
  • Existing evidence. Messages, call-up papers, letters, photographs and medical records that the person already holds should be kept safely. Family in Myanmar should not be asked to take risks to obtain more.

Can Myanmar tourists apply for a Subclass 866 protection visa without every document in hand? Yes. The application can be lodged with the evidence available, and more can be provided later. What is hard to repair is an application lodged after the visa has expired, or a first account that later has to be corrected.

What happens if you apply before your visitor visa expires?

A Myanmar visitor who lodges before the visitor visa expires will usually remain lawful for the whole time the protection application is being decided. That is the most important practical decision a visitor makes. Can Myanmar tourists apply for a Subclass 866 protection visa and stay in Australia while it is decided? Yes, and the bridging visa is what allows it.

The Bridging Visa A sits behind the visitor visa until the visitor visa ends, and then it takes over. The person does not have to leave Australia while the Department assesses the claim. The overview of bridging visas in Australia explains the different bridging visas.

Can Myanmar tourists apply for a Subclass 866 protection visa just before the visitor visa runs out? Yes, if the application is valid when lodged. But lodging at the last minute leaves no room for a technical problem or a mistake in the form. It also tends to produce a rushed account, and the first account is the one against which every later statement is measured.

Can Myanmar tourists apply for a Subclass 866 protection visa after the visa expires?

Yes, but from the day after the visitor visa ends, the person is an unlawful non-citizen and may be detained.

A person from Myanmar without a visa who then applies for protection will not usually receive a Bridging Visa A. They may apply for a Bridging Visa E. The Department's guidelines provide that a Bridging Visa E granted to a protection visa applicant starts with condition 8101. A further Bridging Visa E with permission to work requires a compelling need to work and an acceptable reason for the delay in applying for protection. The applicant must explain why they did not apply while they still held the visitor visa. So can Myanmar tourists apply for a Subclass 866 protection visa and still get work rights after becoming unlawful? Sometimes, but only by meeting those extra requirements.

A person in this position should act without delay. An unlawful non-citizen found before applying can be detained and may face removal action. A valid protection visa application generally prevents removal while it is being decided, but it does not erase the period of unlawful status. The guide on urgent immigration lawyer advice explains when a matter needs immediate attention.

Will what you said in your visitor visa application be used?

Yes. The decision maker can read the visitor visa application, and differences between it and the protection claims are commonly tested at interview.

To be granted a Subclass 600 visa, a Myanmar applicant has to satisfy the Department that they are a genuine visitor. They commonly provide:

  • a stated purpose, such as visiting a son or daughter who studies or works in Australia, attending a family event, or tourism;
  • an employer's letter or business documents from Myanmar;
  • bank statements and property documents showing ties to Myanmar;
  • a travel itinerary or return ticket; and
  • an invitation letter from a relative in Australia.

None of this automatically defeats a claim. Many people with genuine fears still have work, property and family in Myanmar, and a visitor visa is often the only lawful way out. Can Myanmar tourists apply for a Subclass 866 protection visa after telling the Department they would return? Yes. But the decision maker may ask why, and the answer must be honest and specific. If the fear arose after arrival, the applicant should give dates and explain what changed. If the fear existed before departure, the applicant should explain why they told the Department they would go back. The guide to the protection visa statement of claims explains what the account should contain.

If a document in the visitor visa application was false, that is a separate and serious problem. It should be disclosed and explained, not repeated.

Does leaving Myanmar through the airport count against you?

It can be raised. A Myanmar visitor who flew out of Yangon on their own passport, without trouble at the exit, may be asked why the authorities let them leave if they were of interest to the military authorities.

The question has a particular edge for Myanmar. The military authorities began enforcing the People's Military Service Law in February 2024. Rules made in January 2025 ban overseas travel for people ordered to serve, and reports from August 2024 describe young adults of conscription age being stopped from flying out of Yangon. A visitor of conscription age who left by air after those measures may be asked how they were able to do so.

There may be a good answer. The person may have left before the restrictions took effect, may not yet have received a call-up, or may have held the permissions then required. Or the feared harm may come from a source other than the state. The explanation must be true and consistent with the rest of the evidence. A person should not guess at how they got through the airport, and should say so if they do not know why they were not stopped. Can Myanmar tourists apply for a Subclass 866 protection visa if they left Yangon without difficulty? Yes. The departure is one piece of evidence, not the answer.

Why did you not claim protection when you arrived?

Decision makers sometimes ask why a Myanmar visitor did not raise their fear at the airport in Australia. The honest answer is usually that the person held a valid visa, passed through immigration clearance normally, and did not know that protection could be sought, or how.

No rule requires a protection claim to be made on arrival. A person who enters on a valid visa can apply later from inside Australia. The issue is credibility, and a clear account of when the person learned about protection, and why they applied when they did, deals with it. Can Myanmar tourists apply for a Subclass 866 protection visa weeks or months after arriving? Yes.

Does it matter how soon after arrival you apply?

Yes. An application made soon after arrival usually sits more comfortably with a genuine fear than one made after a long delay. Delay does not bar an application, but it is examined.

Delay can have good reasons. Conditions in Myanmar have changed repeatedly since February 2021. A visitor who arrived before conscription enforcement began in February 2024, for example, may have developed a real fear only when the call-ups started or when relatives at home were questioned about them. That is a legitimate explanation if it is true and supported by evidence. Can Myanmar tourists apply for a Subclass 866 protection visa on the basis of events that happened after they arrived? Yes. The guide on whether delaying a Subclass 866 application affects a claim explains how delay is weighed.

Can a visitor visa be cancelled before you apply?

Yes. The Department can cancel a visitor visa in some circumstances, for example where it considers the holder has worked in breach of condition 8101 or is not a genuine visitor.

A Myanmar visitor whose visa is cancelled while in Australia may become unlawful at once. Can Myanmar tourists apply for a Subclass 866 protection visa after cancellation? Generally yes, if no bar applies, but they will then face the weaker position described above. A person who has received a notice of intention to consider cancellation should get advice immediately. For a visitor who is still deciding, the cancellation risk is another reason to settle the question, can Myanmar tourists apply for a Subclass 866 protection visa, early.

Can family members who came as visitors be included?

Yes. A spouse and dependent children who are in Australia can be included in the application as members of the family unit, whichever visitor visa stream they used.

Can Myanmar tourists apply for a Subclass 866 protection visa together as a family? Yes, in one application. Each adult family member may also have claims of their own, and those should be set out in their own words. A parent who came to visit an adult child in Australia is in a different position from that child, who is not usually a dependant and whose own visa must be considered separately.

Can Myanmar tourists apply for a Subclass 866 protection visa that includes relatives who stayed behind? No. Relatives who are still in Myanmar cannot be included, because the visa can only be granted to people in Australia. The protection visa documents checklist lists the identity and relationship documents usually provided. Where a Myanmar passport has expired or cannot safely be renewed, the applicant can still apply using the identity evidence they have, with a reasonable explanation for anything missing.

Warning: promises of work through a protection visa

Some Myanmar visitors are told by relatives, employers or unlicensed advisers that a protection visa is simply a way to stay and work in Australia. That advice leads to refusal and lasting damage.

The Department states that protection visas are for genuine asylum seekers and are not for people who just want to stay in Australia to work. Applications without genuine claims are refused. For a visitor, the question, can Myanmar tourists apply for a Subclass 866 protection visa, should always be asked together with a second question: does the person genuinely fear harm? After a refusal in Australia, section 48A generally prevents a further protection visa application without the Minister's personal intervention. Giving false or misleading information, or false documents, to the Department is a serious matter and can be an offence under section 234 of the Migration Act.

It is illegal for a person to charge for migration advice unless they are a registered migration agent or an Australian legal practitioner. Can Myanmar tourists apply for a Subclass 866 protection visa only to keep working? No. Anyone who offers a job in return for lodging a claim, or offers to write a story, should be avoided. The applicant's statement must be their own true account.

What happens if the protection visa is refused?

A refused Myanmar applicant can usually apply to the Administrative Review Tribunal for merits review, but the time limit is short, runs from notification, and is strictly applied.

A person with a valid review application usually remains on a bridging visa while the review is decided. The visitor visa will normally have ended long before, so it provides no fallback. Can Myanmar tourists apply for a Subclass 866 protection visa again after a refusal? Generally no. Section 48A prevents a further protection visa application in Australia unless the Minister personally decides under section 48B to allow one, and the Minister does not have to consider a request. The page on protection visa refusals and the Subclass 866 refusal and ART guide explain the review process.

What claims do Myanmar visitors usually raise?

Myanmar visitors raise the same claims as other applicants from Myanmar. These commonly include opposition to the military authorities, conscription, ethnic and religious minority claims such as those of Rohingya, Kachin, Karen and Chin people, and sexual orientation or gender identity. How the Department assesses these, including DFAT country information, generalised violence and risk on return, is covered in a separate guide to protection visas for Myanmar nationals. The answer to "can Myanmar tourists apply for a Subclass 866 protection visa" is only the start. The claim must then be proved, as the guide to protection visa evidence explains, and tested at interview, as the guide to protection visa interview preparation explains.

Frequently Asked Questions

My visitor visa has condition 8503. Can I still apply for a protection visa?

Yes. Condition 8503 stops you from being granted most other visas while you remain in Australia, but the condition itself excludes protection visas. You do not need a waiver before lodging a Subclass 866 application. You still need genuine protection claims, and you should lodge while your visitor visa is still in effect so that you receive a Bridging Visa A and remain lawful.

I am from Myanmar and my visitor visa expires next week. What should I do?

Get advice now and, if you have genuine claims, lodge before the visa ends. A valid application made while your visitor visa is in effect usually gives you a Bridging Visa A, which keeps you lawful while the Department decides. If the visa expires first, you become unlawful and may be detained, and any Bridging Visa E will start without permission to work. Avoid lodging a rushed account, because it will be compared with everything you say later.

Can I work after I apply for a protection visa?

Not while your visitor visa is still in effect, because condition 8101 continues to apply. When your visitor visa ends, your Bridging Visa A comes into effect. Under the Department's current guidelines, a Bridging Visa A granted to a protection visa applicant is generally granted without a work condition. Check your grant notice before starting work, and never work in breach of your visitor visa, because that can lead to cancellation.

I told the Department I was visiting my son in Perth. Will that be used against me?

It may be raised, but it does not decide your claim. The decision maker can read your visitor visa application and may ask why you said you would return to Myanmar. Many people with genuine fears travel on a visitor visa because no other visa is available to them. Your statement should explain honestly when your fear arose, why you applied to visit, and why you did not say more at the time.

Can my children stay with me while I apply?

Yes, if they are in Australia and included in your application. Your spouse and dependent children who are in Australia can be included in your Subclass 866 application as members of your family unit, even if they came on visitor visas. They will generally receive bridging visas in the same way as you. Children who are still in Myanmar cannot be included, because the visa can only be granted to people in Australia.
